Easement Contract: The undersigned hereby requests the City of Byron Utilities System (“City”) to provide and install on the premises, a yard service line and all necessary matters, fittings, and equipment so as to deliver the above utility services to the meter location thereon; and, in consideration of the city’s investment in so doing, the undersigned hereby has granted/grants to the city, its successors and assigns, a right-of-way and easement under, on, along, through, and over said premises in and upon which to install and maintain such above-described service line and equipment. It is understood that such service line and equipment shall be and remain the property of the City of Byron. The city shall have, and I hereby give, the unqualified right to enter thereon at any time, remove, and repossess said service line and all related equipment; any and all damages and costs in connection therewith or sustained during the city’s exercise of any rights herein are hereby expressly waived by the undesigned. Pursuant to and as provided in Sec. 40-6 of the Code of Byron, the undersigned agrees to protect, and shall be liable for, any and all damages to any of the city’s property, service line, and related equipment, wherever located. The undersigned agrees and consents to the addition of amounts of any damages and/or repairs to the normal and regular utility bill.
Current charges are due upon receipt of bill. Failure to receive your bill does not relieve your obligation to pay; a 10% penalty is added after the 10th of the month. If bill is not paid by the 20th of the month, your account(s) will be added to the delinquent list, incur an additional $40.00 fee per meter, and your service(s) will be subject to immediate disconnection. The total amount due on your account must be paid to reconnect service. Returned check policy: on any returned check you agree to a service charge not to exceed $30.00 or 5 percent of the face amount of the instrument, whichever is greater, plus the amount of any fees charged to the City by its financial institution. Collection Costs: If your account is placed with collections to collect what you owe, you will pay 15% of the amount you owe as attorney’s fees, plus court costs.
