RELEASE OF LIABILITY, WAIVER OF CLAIMS,

ASSUMPTION OF RISK and INDEMNITY AGREEMENT

Please note, that by signing this agreement, you give up the right to sue for any injuries or damages, howsoever caused.

To: Brian Lynch Basketball and their directors, officers, employees, representatives, agents and volunteers.

In consideration of Brian Lynch Basketball allowing me to participate in Brian Lynch Basketball athletic activities, I, as parent or legal guardian of a minor participant, release from liability and waive all rights to sue Brian Lynch Basketball, their employees, officers, volunteers and agents, collectively, (the business) from any and all claims, including claimsof the business' negligence, resulting in any physical injury, illness (including death) or economic loss I, or the minor participant, may suffer or which may result from my or the minor participant's participation in these activities.

I am voluntarily allowing participation in this activity. I understand that there are risks associated with participation in this activity, such as physical and/or psychological injury, pain, suffering, illness, disfigurement, temporary or permanent disability, death or economic loss. These injuries or outcomes may arise from the participant's own or other's actions, inactions, or negligence, or the condition of the activity, location or facility. Nonetheless,I assume all risks of participation in this activity, whether known or unknown to me as legal guardian of a minor participant.

3. I, as parent or legal guardian of a minor participant, agree to hold the company harmless from any and all claims, loss or damage to my personal property, liabilities and costs, including attorney's fees, as a result of participation in this activity. If the company incurs any of these types of expenses, 1 agree to reimburse the company.

I am the parent and/or legal guardian of the participant. I have read this document and I am signing it freely. I understand the legal consequences of signing this document, including(a) releasing the company from all liability on the participant's behalf; (b) waiving my and the participant's right to sue the company; and (c) assuming all risks of participant's participation in this activity. I allow the participant to participate in this activity. I understand I am responsible for the obligations and acts of the participant as described in this document. I agree to be bound by the terms of this document.

WAIVER/RELEASE FOR COMMUNICABLE DISEASES INCLUDING COVID-19 ASSUMPTION OF RISK/WAIVER OF LIABILITY / INDEMNIFICATION AGREEMENT

In consideration of being allowed to participate on behalf of BRIAN LYNCH BASKETBALL athletic program and related events and activities, the undersigned acknowledges, appreciates, and agrees that: Participation includes possible exposure to and illness from infectious diseases including but not limited to MRSA, influenza, and COVID-19. While particular rules and personal discipline may reduce this risk, the risk of serious illness and death does exist; and, I KNOWINGLY AND FREELY ASSUME ALL SUCH RISKS, both known and unknown, EVEN IF ARISING FROM THE NEGLIGENCE OF THE RELEASEES or others, and assume full responsibility for my participation; and, I willingly agree to comply with the stated and customary terms and conditions for participation as regards protection against infectious diseases. If, however, I observe any unusual or significant hazard during my presence or participation, I will remove myself from participation and bring such to the attention of the nearest official immediately; and, I, for myself and on behalf of my heirs, assigns, personal representatives and next of kin, HEREBY RELEASE AND HOLD HARMLESS BRIAN LYNCH BASKETBALL, their officers, officials, agents, and/or employees, other participants, sponsoring agencies, sponsors, advertisers, and if applicable, owners and lessors of premises used to conduct the event ("RELEASEES"), WITH RESPECT TO ANY AND ALL ILLNESS, DISABILITY, DEATH, or loss or damage to person or property, WHETHER ARISING FROM THE NEGLIGENCE OF RELEASEES OR OTHERWISE, to the fullest extent permitted by law.

I HAVE READ THIS RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND SIGN IF FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT.

This is to certify that I, as parent/guardian, with legal responsibility for this participant, have read and explained the provisions in this waiver/release to my child/ward including the risks of presence and participation and his/her personal responsibilities for adhering to the rules and regulations for protection against communicable diseases. Furthermore, my child/ward understands and accepts these risks and responsibilities. I for myself, my spouse, and child/ward do consent and agree to his/her release provided above for all the Releasees and myself, my spouse, and child/ward do release and agree to indemnify and hold harmless the Releasees for any and all liabilities incident to my minor child's/ward's presence or participation in these activities as provided above, EVEN IF ARISING FROM THEIR NEGLIGENCE, to the fullest extent provided by law.

Please be advised that throughout training sessions, pictures and/or videos may be taken during various drills. The purpose of videoing the players is to help them review what they are doing and see what adjustments need to be made. It will also be used from time to time to send to the players for their review and observation in the learning process. Lastly, we will also use the pictures and videos on our social media outlets to show some of the drills we do in our training. All digital media is to be used as a training tool and for our social media only.
