A. Fees:
Client agrees to pay the Massage Therapist a deposit of 50% of total due at the time of booking to secure their appointment date. OR full amount can be paid. This is a non-refundable retainer fee that goes toward your session. The balance is due the date of Scheduled Event. The fee covers the time of the Massage Therapist, equipment and linens provided by the Massage Therapist. There will be a $150 charge back fee for insufficient funds and a new method of payment will be required. A daily fee of $100 will be added to payments not paid in full by the end of the scheduled event.
B. Location Costs & Fees
If there are any costs/fees associated with the location the client has chosen for their booking, you, the client, will be responsible for those fees. The Massage Therapist will not guarantee or arrange payment on any location. $30 Travel fee covers travel within 30 minutes/miles of Orderville, UT. Any location outside of these limits will be subject to an additional charge of $1.00/minute-mile as part of the agreement.
C. Rescheduling
If an illness or situation prevents a session from taking place, client may reschedule their session at least 48 hours prior to their date without penalty. Should client fail to give 48 hours notice, or decide to completely cancel the scheduled event without notice, this deposit fee is forfeited and will not be refunded. Massage Therapist reserves the right to reschedule due to illness, weather, equipment malfunction, or other circumstances beyond their control.
D. Liability
Massage Therapist is not responsible for any injuries inflicted upon any participating parties if they have not disclosed complete medical history. Client(s) will be responsible for themselves and release Massage Therapist from any claims against their person.
D1. COVID-19 LIABILITY RELEASE, RELEASE OF LIABILITY AND AGREEMENT NOT TO SUE, INDEMNIFICATION, HOLD HARMLESS, LIMITATION OF WARRANTY.
Masks not required! If you feel more comfortable and want to wear one that is your choice. I will not be wearing one. We all know that these are uncertain times. The risks of COVID-19 are not well understood and there is controversy among the experts on how the virus can spread and difficulty in scientifically determining whether anyone has the virus at any moment in time. In consideration for providing massage and spa services, by signing below you agree to accept all responsibility for the risk that you may contract COVID-19. While we are taking client safety and the safety of our staff very serious, by implementing sanitation and scheduling procedures, we cannot guarantee that any of these measures will completely protect you from contracting COVID-19. I agree that if I take any steps to make a claim for damages against WANT MASSAGE BY EMALENE LAKE, its agents, employees or any other released parties arising out of receipt of massage services during an Event, I shall be obligated to pay all attorney's fees and costs incurred as a result of such claim. I acknowledge that I can go elsewhere to have massage and spa services and I acknowledge that WANT MASSAGE BY EMALENE LAKE is not the only establishment where I can obtain massage. By signing this agreement, I acknowledge that I am free to go to other massage businesses who may not require my agreement to accept responsibility for contracting COVID-19 and I chose to have a massage or spa services. Please do not sneeze on the therapist, lick doorknobs or light switches and remember to wash your hands after using the bathroom or petting animals. WANT MASSAGE BY EMALENE LAKE RESERVES THE RIGHT TO TURN AWAY ANYONE THAT VISIBLY PRESENTS SYMPTOMS OF COVID OR OTHER ILLNESS THAT MAY AFFECT THE MASSAGE THERAPIST OR OTHER CLIENTS.
E. Cooperation of Guests and Other Service Providers
The Client is responsible for the conduct of the guests. Co-ordination with other service providers may be necessary to complete all the massages as scheduled. The Client should share the massage schedule with other service providers to make sure that there are no conflicts with times. In addition, happenings during the Scheduled Massages should be planned to make the best use of time for all. The Massage Therapist will not tolerate verbally or physically abusive behavior. If the Client is unable to control the conduct of the guests or if the conduct of any of the Event guests damages any of the equipment of the Massage Therapist, it will result in the early or immediate departure of the Massage Therapist. The Client understands that in such an event, no refund will be given.
F. Arbitration
Any controversy or claim arising out of or relating to this contract, or the breach thereof, shall be settled by arbitration, administered in accordance with the Commercial Arbitration Rules of the American Arbitration Association, administered by a licensed Arbitrator in the jurisdiction closest to the Massage Therapist’s office and the arbitration award may be entered for judgment in any court having jurisdiction thereof. Notwithstanding the foregoing, either party may refuse to arbitrate when the dispute is for a sum less than $200. In no event shall an award in an arbitration initiated under this clause exceed the contracted price of the controversy in dispute.
