    TO FINALIZE YOUR BOOKING, PLEASE READ AND ACKNOWLEDGE ALL OF THE FOLLOWING TERMS AND CONDITIONS IN THIS AGREEMENT AND FILL OUT THE FORM AT THE BOTTOM. Reservations are not guaranteed until this Guest Rental Agreement is signed, a deposit is received and eligibility confirmed by Hacienda Luxury Rentals. Thank you for your reservation.
  • RENTAL AGREEMENT TERMS AND CONDITIONS

    1. RENTER REQUIREMENT

    For legal and accounting purposes, the person placing the reservation must be the same as the credit/debit cardholder. This person is considered to be the Guest. All other persons involved with the rental are considered to be the Guest’s invitees, and all discussions regarding reservation, cancellation and damage policies will be discussed with the Guest, not the Guest’s invitees.

    2. LEASEHOLDER MUST BE 25 YEARS OF AGE. Rentals to sororities, fraternities and high school groups are specifically prohibited.

    3. DEPOSITS AND PAYMENTS

    Reservations made prior to 30 days of arrival date require 50% of the total and the remaining is due 30 days before arrival date. Reservations made within 30 days of arrival date require full payment of the total. a) Any booking accepted within 2 weeks of check-in must be paid by wire transfer. b) Once final payment is received, we will email you the check-in instructions.

    4. CANCELLATION POLICY

    a) Cancel up to 30 days before check-in and get a 100% refund (minus an administration fee of $100USD). Cancel within 30 days of your trip and the reservation is non-refundable. b) Rentals during holidays of Nov 20-30; Dec 15 to Jan 5, March 1-31 are non-refundable. c) Service fee charged by the booking site is non-refundable unless otherwise stated on the booking website.

    5. SECURITY DEPOSIT

    A refundable $1000 Damage Deposit for Hacienda Beach Club/$2000 for 1Homes or purchase Damage Insurance for accidental damages, excessive misuse or theft will be included in your reservation total. Any malicious damage, missing items due to gross neglect or misuse requiring anything more than normal cleaning will be charged against your Damage Deposit or on your credit card. a) Damage Deposit: Damage deposit will be refunded within 30 days after you check-out by via the method that was paid. b) Damage Insurance covers unintentional damages and must be reported by the time you check-out. Any damages that exceed the maximum insurance limit will be charged to your credit card. If you opt for this option, the insurance company shall pay HLRS the damaged amount under the terms and conditions of the Vacation Rental Damage.

    6. PAYMENT: Wire or check.

    7. CHECK-IN and CHECK-OUT TIMES

    CHECK-IN IS 3PM. CHECK-OUT IS 11 AM. (no early check-in please and late check-out after 1pm will incur an extra day of rental). We are happy to accommodate your arrangement when possible. But on days when there are same day check-outs and check-ins, we may charge you for an extra day for late check-outs.

    8. KEY

    Upon check-in, keys will be provided by the Hacienda/1Home front desk. At check-out, please return the keys to the front desk and pay for any incidentals. Guest will be liable for lost keys and charges for the installation of new locks.

    9. UPON ARRIVAL

    Take a look around the unit. If there are concerns or issues with our property, please contact the Hacienda/1Home front desk to have the issue resolved. No refunds or considerations are given unless Hacienda/1Home is notified of problems during your stay. Damages incurred that were not reported during the initial check-in will be charged against your security deposit or your credit card.

    10. NOISE

    Please respect the neighbors and keep noise at a minimum at all times. After 10PM please close the doors and keep any noise, including music inside. Any loud disturbances will be monitored and guests disturbing others will be asked to leave. Any noise complaint or indecent behavior will be sanctioned with a $100 fine the first instance, $500 the second and $1500 any subsequent complaint or instance.

    11. CLEANING FEE

    A Cleaning fee in the amount of $650 dollars for both Hacienda Beach Club Rentals and 1Home rentals is charged for stays up to 7 days to cover normal cleaning and housekeeping expenses (subject to change depending on room rate// additional $75 per night after 7 nights). Daily light cleaning will be available every day while you stay with us. Cleaning fee is non-refundable. If extra cleaning or excessive laundry is required, an additional charge of $50 will be charged against your security deposit or your credit card upon check-out.

    Only registered guests on the contract are permitted on the property at all times. Additional guests are not allowed without written permission from the owner or the management company. Non-registered guests are not allowed at the Beach Club, Fitness Center or Kids Clubs. Any permitted additional guests are allowed in the Residence until 8pm.

     

    13. SMOKING - No smoking. Any detection of smoking inside the property will result in a minimum $300 USD fine and will be deducted from your security deposit.

    14. PETS - No pets are allowed.

    15. ACCESS - Guest shall allow Hacienda access to the property for purposes of repair and inspection. Hacienda shall exercise this right of access in a reasonable manner.

    16. SERVICES - All services must be contracted through the Hacienda Beach Club & Residence to ensure the safety of our clients and properties. Unauthorized outside service providers, such as for cleaning, chef or butler, spa services, etc, are NOT permitted and will be subject to fines.

    17. WIFI – Internet is available at no additional charge. If you experience connection issues during your stay, we recommend sitting closer to the router for a better connection.

    18. BEACH CLUB AND POOL – As a guest of this property you have access to all available amenities. This includes the beach club with beach chairs and the use of non-motorized water activities. Food and beverages ordered at the pool or restaurant may be billed to your room and charged to your credit card by the Hacienda when you check-out. Any outstanding debts will be deducted from your security deposit. No glass containers, including bottles and glassware, are allowed in the pool area. No recreational flotation devices are allowed in the pool areas. Certain exceptions will be made for infants and small children. Frisbees, footballs and others similar throwing objects are not allowed in the pool.

    19. PARTIES - Unless an event has been organized and event fees have been paid, there are no events, parties and/or large groups permitted in this property. Any unauthorized event will result in immediate eviction from the property and a deduction of a minimum of $500 USD event fee from the security deposit. No refund will be given.

    20. DAMAGE AND MISSING ITEMS - Guests on the premises are responsible for any and all damages or missing items on the property caused during their stay. The expense of missing items, including towels or any other contents in the house will be deducted from the security deposit.

    21. AIR CONDITIONING – Please do not run the A/C with windows and doors open. This can result in damages to the system and guests will be subject to repair charges.

    22. LOCKED AREAS – Any area that is locked off is “OFF LIMITS” and is the area of the homeowner and not part of your rental agreement. Tampering with the locks will result in a fine and can be grounds for dismissal and/or removal.

    23. PARKING - Guests are welcome to park up to two cars in the garage during the duration of the stay.

    24. SECURITY CAMERA - For your safety, there are outdoor security cameras as well as gatekeepers who monitor visitors arriving and leaving the property to ensure there are no more than 6 persons in the unit.

    25. GARBAGE – Please do not leave garbage on the patio. It can get windy and result in garbage blowing into neighboring patios and common areas. Any neglect will result in charges to guests. Please use the receptacles provided.

    26. MAIDS/HOUSEKEEPING – The villa staff is at your disposal for any reasonable needs inside the villa. Any items needed may be requested.

    27. TOILETS – DO NOT FLUSH anything other than toilet paper. No feminine products should be flushed at any time. If it is found that feminine products have been flushed and has clogged the system, you may be charged damages which will be deducted from your security deposit.

    28. STORMS - If there is a storm or hurricane, no refunds will be given unless:

    The state or local authorities order mandatory evacuations in a "Tropical Storm/Hurricane Warning area" and/or

     A "mandatory evacuation order has been given for the Tropical Storm/Hurricane Warning" area of residence of a vacationing guest.

     B The day that the authorities order a mandatory evacuation order in a "Tropical Storm/Hurricane Warning," area, we will refund: a) Any unused portion of rent from a guest currently registered; any unused portion of rent from a guest that is scheduled to arrive, and wants to shorten the stay, to come in after the Hurricane Warning is lifted; and any advance rents collected or deposited for a reservation that is scheduled to arrive during the "Hurricane Warning" period.

    29. LIABILITY - Owner/HLRS attempts to properly maintain the vacation rental. The vacationer agrees to immediately notify the Hacienda or 1Home of any maintenance problem so that the situation can be remedied as soon as possible. We will do our best to have tradesmen attend to the problems but may not be able to fix everything over holidays and weekends. Under no circumstances will any of the rental money be refunded or returned because of the condition of the house. Owner and HLRS are not responsible for any inconveniences that may occur for which he has no control. This includes, but is not limited to power outages, adverse weather conditions, mandatory evacuation, construction, a mechanical failure such as pool, hot tubs, television, etc. No refunds will be given for occurrences beyond the owner’s control. Owner/HLRS shall not be held liable for any injuries that may occur to Vacationers or their guests as a result of the acts of said Vacationers and guests. Owner/HLRS is not responsible for any theft or damage to vacationer’s belongings during their stay at the vacation rental. Upon written or electronic endorsement, vacationers agree that they have read and understood this agreement. The vacationer accepts all terms, conditions, and restrictions without exception.

    30. VIOLATION OF TERMS - Should any of the stated terms of this contract is violated, pets, smoking, maximum occupancy, etc., your reservation/security deposit will be automatically forfeited – in full. In addition, you will be liable for any additional costs resulting from the violation.

    31. CANCELLATION BY OWNER – In rare circumstances where the unit is inhabitable, we would cancel a reservation. Such cases include physical damage to the property due to fire, flood, hurricane, storm, natural disaster, etc. HLRS shall not be held liable for any financial damages incurred by the vacationer as a result of this type of natural disaster.
