FOOD TRUCK SERVICE INCLUSIONS:
Kitchen staff, driver, disposable servingware, napkins, stationary food & beverage service as described above.
SERVICES NOT INCLUDED:
Photography, videography, florist, runners, added décor, entertainment, additional lighting, sound or A/V needs, additional design needs, or printing services.
GUARANTEES:
The signer ("Client") shall email Big Mozz, Inc. ("Caterer") written notice of the final estimated attendance of the event 7 days before the Event Date. The billed headcount may not decrease from the estimate, but may increase. Caterer may contact venue to confirm headcount. If the day-of headcount is higher than stated, client agrees to pay additional per person charge within 7 days after the Event Date. Client is billed by the total number of guests at the venue with access to Caterer's services. "Unlimited" service for food & beverage implies Caterer will endeavor to serve its full menu for the duration of the booking with minimal wait times; however, it is possible that some items may run out during service.
Breakage/Loss: client assumes full responsibility for any damage or loss of any equipment, including but not limited to tents, tables, chairs, vehicles, and signage incurred by caterer above normal wear and tear.
Client will be responsible to pay all expenses and reasonable attorney's fees associated with any action brought to recover unpaid contract fees due to caterer.
PAYMENT SCHEDULE:
$949 deposit is due 30 days prior to event date. Your event date will not be held until that amount is paid. The deposit is refundable until 30 days prior to the event.
Remaining balance (18% gratuity + any additional headcount, mileage, and options) is due 7 days prior to the event date.
NY State sales tax (8.875%) will be added to all invoices except gratuity.
REFUNDS & CANCELLATIONS:
Please note that any payments made are non-refundable and refunds only apply to remaining balances. All cancellations must be sent in writing to catering@bigmozz.com. Client has the option to apply the non-refundable payments to a secondary date if the change is made greater than 7 days before the event. No refunds are given if the event is cancelled within 7 days of the event date. Caterer may cancel and refund client at any time and for any reason without penalty, and will endeavor to uphold the service start time to the best of its ability.
LICENSING:
Caterer warrants that it currently holds a valid license under the laws of the State of New york to perform this work in compliance with all applicable local, state, or federal statutes and regulations.
REPRESENTATIONS:
Each party promises to the other party that it has the authority to enter into this contract and to perform all of its obligations under this contract.
TERM AND TERMINATION:
This contract ends on the date of the event, unless the client or the caterer ends the contract before that time. If one of the parties chooses to end the contract prior to project completion, the client is responsible for paying for all work and costs incurred up until that date.
This agreement expresses the entire understanding between the caterer and the client with respect to the subject matter hereof and may not be changed, modified, or terminated except in writing. If any provision of this agreement is adjudged to be void or enforceable, same shall not affect the validity of this agreement or of any other provision hereof. This agreement shall be governed by the state of new york & the parties hereto agree to submit to jurisdiction in the state of new york. The parties hereto agree to the foregoing as evidenced by their signatures below.
By signing this contract, client understands and accepts the terms.
