Cadenza Violins Rental Agreement
Terms and Conditions*

RENTER acknowledges that, before taking possession of the equipment described herein, it is in good playing condition and good repair. RENTER assumes full responsibility for all rented equipment. PROTECTION PLAN (insurance on the Rental Account) includes coverage for Accidental Damage and Fire for instrument, Bow, and Case up to $150 dollars per incident. RENTER is responsible for 30% of repair costs above $150. If the Instrument or the Bow are damaged beyond repair, a 30% fee of the total equipment value will be charged. Strings are covered by the protection plan if they are broken or damaged. The Protection Plan does not cover damage resulting from misuse, neglect, improper handling or storage, exposure to excessive heat, cold, or humidity, water damage, or failure to exercise reasonable care. This plan is effective only for ACTIVE accounts; past-due accounts are not covered. Rental Payment Options: VISA/MASTER CARD PAYMENT - The Monthly Rental Fee will be automatically deducted from an authorized credit card account by the 5th of each month. This process will continue for the duration of the equipment rental, or until the customer notifies us to discontinue payments. A rental may be terminated at any time; however, the instrument must be RETURNED to the shop before the next rental payment to stop charges. 1-Year Contract Card Payment- Prepay 11 months and receive 1 month free. RENTER acknowledges that there will be no refund for the remaining term of the contract if the instrument, bow, and case are returned during the contract period. The renter also acknowledges that additional payment will be required for the remainder of the contract if needed. After the yearly contract ends, the renter can switch to monthly payments or continue with the yearly contract. Should the residence address/telephone/ payment information at which the rented equipment is changed from the one listed on this contract, the RENTER agrees to provide CANDEZA VIOLINS with the updated information. Renter MAY CANCEL the contract at any time, provided that all charges are paid in full, by returning the instrument, bow, and case to CADENZA VIOLINS. Returns after the 15th of the month may be subject to be charge of the full month’s rent. The INSTRUMENT, CASE, AND BOW are the property of CADENZA VIOLINS. RENTER is in default if payment is not made on time or if the terms of the RENTAL CONTRACT are violated. Under default, RENTER grants to CADENZA VIOLINS the right, without advance notice, to recover the instrument, case, and bow at any place, any time, by any legal means, for no payment of charges. In addition, the RENTER will be liable for reasonable collection and attorney’s fees if the RENTAL CONTRACT is referred to a collection agent or attorney who is not a salaried employee of CADENZA VIOLINS, and court costs. A signed RENTAL CONTRACT will authorize the school system your child attends during the duration of this contract to provide my current address to CADENZA VIOLINS upon request. A signed RENTAL CONTRACT will also authorize CADENZA VIOLINS to pick up the instrument, case, and bow (serial number and description as listed on the rental form) at my child’s school at any time the RENTAL CONTRACT is violated. CADENZA VIOLINS may modify this Rental Agreement upon written notice to RENTER. Changes will take effect on the date stated in the notice. RENTER may terminate the Agreement before that date by returning the equipment. Continued possession or rental after the effective date constitutes acceptance of the revised terms.
RENT TOWARD PURCHASE PROGRAM

Rental payments may be applied toward the purchase of this instrument or a larger/more expensive instrument as follows:

Rental Credits
- 100% of the Basic Monthly Rental Fee (excluding Protection Plan and Sales Tax) paid during the first ten (10) months will be credited toward the purchase price.
- After the first ten (10) months, 80% of the Basic Monthly Rental Fee will be credited each month toward the purchase price.
- Total rental credits applied toward any instrument, case, or bow may not exceed 80% of the total purchase price.
- Rental credits may only be applied toward the current instrument or an instrument of greater value.
- Rental credits must be used within seven (7) days of termination of this agreement. Unused credits expire and will not be retained.
- Rental credits are calculated independently for each signed Rental Agreement and cannot be combined.
Ownership and Termination
- This is a rental agreement. The Renter is not obligated to purchase the instrument.
- The instrument remains the property of the Shop unless and until the purchase price is paid in full.
- The Renter may terminate this agreement at any time by returning the instrument in accordance with the terms of this agreement.
- Monthly rental charges continue until the Shop receives notice of termination and the instrument is returned or the instrument is purchased and paid in full.
Purchase Option

The instrument may be purchased at any time by requesting a payoff balance calculation. The remaining balance must be paid in full at the time of purchase. Ownership transfers only upon receipt of full payment.
