THE BALANCE OF ALL SHOOTS ARE DUE 72 HOURS BEFORE YOUR SCHEDULED SESSION. IF THE PAYMENT IS NOT PAID AN APPOINTMENT CANCELLATION NOTICE WILL BE SENT AND YOU WILL NEED TO RESCHEDULE. WE WILL NOT PREPARE YOUR SET UNLESS THE BALANCE IS PAID. A THEMED SHOOT CANNOT-BE CHANGED TO ANOTHER SHOOT AND THE THEME CANNOT BE CHANGED ONCE DEPOSIT IS PAID.
Images will be sent to you to download within 14 days. Please download them immediately. The link will expire in 30 days. TREASURING MOMENTS PHOTOGRAPHY is not responsible for your images after that date. TREASURING MOMENTS PHOTOGRAPHY has copyright of all images produced and will use them for self promotion which includes posting on social media sites and sharing with potential customers. You understand that proofs are property of TREASURING MOMENTS PHOTOGRAPHY and you do NOT have a right to crop or alter. During your photography session you or anyone else is not permitted to take any personal pictures. No videos, facetime, or snapchat etc. during photo session. YOU WILL BE ASKED TO LEAVE IF THIS IS DONE which means you wont be able to pick the images you want edited. Please only bring people necessary to be here for your shoot.
NO REFUNDS OR EXCHANGES!!!. Your appointment has a start time and an end time. Please arrive on time for your appointment as it will end as scheduled and we may not be able to provide all images. If you need more time it’s $45 each half hour and must be paid beforehand if we are available. If you are 30 minutes late, your shoot is cancelled. You may reschedule a shoot as long as it’s done in advance, specifically at least a 72 hour notice is required and within 90 days of original booking. If you or your child are experiencing COVID related symptoms the day of your shoot, please do not come; contact us right away but at least 5 hours before your scheduled appointment is required to reschedule with no penalty. You must reschedule at least 15 days out. Reshoots and refunds are not given for behavior of person being photographed as we will spend time making every effort to get cooperation but It is the client’s responsibility to ensure cooperation. Client agrees that they are financially responsible for any damage to our property by unruly or unattended children. A same day rescheduling charge and a request to reschedule a shoot with less than a 24 hour notice is $50.
Treasuring Moments Photography reserves the right to reschedule due to sickness, weather, equipment malfunction and any circumstances beyond our control.
The client releases us of any responsibility regarding the personal injury that may be obtained during a photo session including you or your child falling off of props, you leaving your child unattended on props, any reaction to food whether it be an allergic reaction or choking during consumption.
You pick the images you want edited immediately after your shoot. If you are unavailable because you are late or for any other reason we will select your images for you. We do not release unedited photos and we do not edit every photo taken.
Fees
In consideration for the photography services provided by PHOTOGRAPHER, CLIENT agrees to pay a retainer in order to lock in the date. This is the introductory price. CLIENT agrees to pay the photographer a non-refundable retainer totaling 50% ( fifty percent) of the total price of the photography services upon signing this contract. The initial retainer payment reserves the photographer’s time . PHOTOGRAPHER agrees to not advertise availability of this same time slot to any other potential clients. If CLIENT cancels this shoot for any reason, the initial retainer payment will not be returned to CLIENT. The balance of the payment for photography services must be paid in full no later than 72 hours before the SHOOT
Scheduling and Pre Consultation
TREASURING MOMENTS PHOTOGRAPHY and client will collaborate in all schedules and arrangements for services to be provided. The client is required to notify the photographer to collaborate on a specific shoot idea. If is very important that the photographer know about key elements in advance so that important images will be taken.
Returning of Images
TREASURING MOMENTS PHOTOGRAPHY will try to return the images in a timely fashion, however, because of the mass number of images that may be taken during your session as well as others she is given the maximum of two weeks to return the images.
Failure to Perform
If the photographer totally fails to perform this contract due to fire, flood, vehicular accident, casualty, fatality, act of God, or other cause beyond the control of the photographer, then the photographer shall refund all monies paid by the clients but shall have no further liability with respect to this agreement. In the unlikely occurrence of an illness or injury that prevents us from photographing your Session we will promptly inform the client of this.
By signing below I ("client") certify that I am at least 18 years of age. I have read and agree to this portrait agreement/contract and fully understand the contents thereof. I have the legal authority to grant these permissions and accept all responsibility for such. I release the Photographer, and her legal representatives/assigns, from any and all claims and/or liability relating to all photography sessions.This contract incorporates the entire understanding of the parties. Any modifications of this contract must be in writing and signed by both parties.
