MODEL RELEASE: I have read and agree to the following statement: I commission Kevin Gallagher and Gallagher-Family Photography, hereafter known as the Photographer, to photograph myself and/or my spouse and/or children (either minor or adult) as well as others listed as persons. I grant the Photographer and Assigns the right to use all images and footage without restriction, including advertising, display, portfolio, and other lawful purposes. The client waives the right to inspect any images produced using the images or footage from the photography session in this contract, and the right to restrict the use of the images or footage from the listed session by the Photographer. I agree that the Content may be combined with other images, text, graphics, film, audio, audio-visual works; and may be cropped, altered or modified. I acknowledge under perjury of law, the persons in this session are my family and fully agree to the wording of this contract. I acknowledge my right to sign away the rights of any minors being photographed during this session. The Client signing this contract warrants that he or she has actual authority to agree to the use of the likeness of all persons, including minors included in the photography session in this manner and shall indemnify and defend Gallagher-Family Photography in the event of litigation arising out of such use.*

COPYRIGHT & POLICIES: I have read and agree to the following statement: As a client of Kevin Gallagher and Gallagher-Family Photography, hereafter known as the Photographer, I acknowledge and understand that the images taken by the Photographer are protected by Federal Copyright Laws. I understand it is ILLEGAL to scan, copy, print or reproduce without the Photographer's permission, and violators of this Federal Law will be subject to its civil and criminal penalties. A limited PRINT RELEASE is supplied with the purchase of my session and associated digital files. I understand the limited print release does not allow selling, screenshots, or altering images in any manner. Reproduction does include, downloading, saving to hard-drive, posting on personal websites/blogs/social media only with photographer acknowledgment and credit. I agree that I have no rights to the Content, and all rights to the Content belong to the Photographer and Assigns. I acknowledge and agree that I have no further right to additional consideration or accounting and that I will make no further claim for any reason to the Photographer and/or Assigns. I acknowledge and agree that this release is binding upon my heirs and assigns. I agree that this release is irrevocable, worldwide and perpetual, and will be governed by the laws of the country/state. It is agreed that my private personal information will not be made publicly available but may only be used directly in relation to the licensing of the Content where necessary (e.g. to defend claims, protect rights or notify trade unions) and may be retained as long as necessary to fulfill this purpose, including by being shared with sub-licensees / assignees of the Photographer and transferred to countries with differing data protection and privacy laws where it may be stored, accessed and used. I represent and warrant that I am at least 18 years of age and have the full legal capacity to execute this release. By choosing "I Agree" I will honor the above statements.*

PORTRAIT SESSION AGREEMENT & POLICIES: I have read and agree to the following statement: I understand that my session is not confirmed until the retainer is paid. Due to weather, cancellations will be made at the photographers discretions. If Gallagher-Family Photography, hereafter known as the Photographer, cannot perform this Contract due to fire or other casualties, strike, Act of God, or other cause beyond the control of the parties, or due to the Photographer's illness or emergency, then the Photographer shall return any deposit or session fee to the Client but shall have no further liability with respect to the Contract. This limitation on liability shall also apply in the event that photographic materials are damaged in processing, lost through camera or media malfunction, lost in the mail, or otherwise lost or damaged without fault on the part of the Photographer. In the event that the Photographer fails to perform for any other reason, the Photographer shall not be liable for any amount in excess of the retail value of the Client order. Additionally, the client is responsible for the Photographer's parking, entrance or other fees required at the location. In case of dispute, both parties will attempt to resolve any dispute arising out of or relating to this Contract through friendly negotiations amongst the parties. If the matter is not resolved by negotiation, the parties will resolve the dispute through mediation. If mediation, is not successful, the parties may proceed to seek an alternative form of resolution in accordance with any other rights and remedies afforded them by law.*

DIGITAL IMAGES: I have read and agree to the following statement: Digital images not included in a purchased package, may be purchased at the given rate by the Client. Digital images purchased will be delivered either via web-based digital download, or email. No physical media delivery item will be provided. If the Client loses or damages his or her digital images, Kevin Gallagher and Gallagher-Family Photography, hereafter known as the Photographer, will not be liable for such loss or damage and may not be able to replace lost or damaged files. It is highly recommended, by the Photographer, that clients immediately back-up any digital files on an external drive or online cloud storage. Digital media files will be available online for 3 months before the online album is closed. Digital images purchased by the Client still remain the property of the Photographer as provided in the MODEL RELEASE and PORTRAIT SESSION AGREEMENT & POLICIES sections of this contract. Digital images available for preview or purchase by the client may not be shared with other persons and may not be resold. Purchased or gratis digital images may be shared under specific print release guidelines. In most cases, upon request a print release document will accompany purchased, gratis, or agreed-upon digital images. Violators of this Federal Law will be subject to its civil and criminal penalties.

PERPETUITY CLAUSE: The Client has requested and agreed that the Photographer has the right to use images as specified in the above clauses checked "I Agree" on the date of this agreement and all dates moving forward until the client revokes this right in writing via email to kevin@photography.gallagher-family.com. It is the obligation of the Client to notify the Photography of this revocation. The client understands any sessions or photographs prior to written revocation are still in effect and cannot be revoked. After the written confirmation, any sessions going forward will require a new signed agreement. By checking I agree, I acknowledge I have the right and authority to make this request for all family members listed above.

APPLICABLE LAW: This contract shall be goverend by the laws of the Country of the United States in the State of California or state where photography session occurred and any applicable Federal Law.

DEFINITIONS: "ASSIGNS" means a person or any company to whom Photographer/Filmmaker has assigned or licensed rights under this release as well as the licensees of any such person or company. "CONSIDERATION" means $1 or something else of value I have received in exchange for the rights granted by me in this release. "CONTENT" means all photographs, film, audio, or other recording, still or moving, taken of me as part of the Shoot. "MEDIA" means all media including digital, electronic, print, television, film, radio and other media now known or to be invented. "MODEL" means persons in photographs and includes their appearance, likeness and voice. "PARENT"means the parent and/or legal guardian of any minor age Model. Parent and Model are referred to together as "I" and "me" in this release, as the context dictates. "PHOTOGRAPHER / FILMMAKER" means photographer, illustrator, filmmaker or cinematographer, or any other person or entity photographing or recording me. "SHOOT" or "SESSION" means the photographic, film or recording session described in this form.

50% Non-refundable retainer for all sessions unless discussed prior to booking.
$0 retainer needed for specialty, loyalty, project session upon written agreement.
Gratuities are accepted for equipment upkeep, etc.
Discounted or alternate pricing will be provided in writing prior to completing form.

Final payments are required on the session date. No digital products will be made available prior to payment in full as per above terms.

Client must discuss and agree to pricing, discounts, and coupons prior to submitting the form. Product prices, discounts, and coupons may not be honored if a written discussion cannot be provided.
