RELEASE, WAIVER, CONSENT AND INDEMNIFICATION AGREEMENT

WARNING: By signing this Release, Waiver, Consent and Indemnification Agreement ("Agreement") you will waive certain legal rights, including the right to sue.

CONSENT: I hereby give consent to participating in all activities associated with and held on property owned, leased or in any way used by Whiskey Creek Ranch, LLC near Grace, Idaho (the "Hunt"

ASSUMPTION OF RISKS: I am aware that participating in the Hunt, involves inherent risks, dangers and hazards including but not limited to the following: all manner of injury including death, catastrophic injury or permanent disability resulting from, among other things: sudden physical trauma; illness; physical exertion; slipping; falling; animals both on and off roadways including but not limited to: bears, wolves, moose, beavers, raccoons, lynx, cougars, coyotes, dogs, ducks, geese, sandhill cranes, poisonous snakes, insects and spiders; falling trees and tree branches; the use of vehicles; erosion and general condition of the land, both on and off roadways, creating rough, hazardous, and dangerous driving and walking conditions; I acknowledge that hunting is an inherently dangerous activity, and I understand that my participation in hunting can lead to serious bodily injury and death; I acknowledge and understand the risks of handling firearms and being near others that have firearms in their possession. I acknowledge and understand the risk of injury from ammunition and shot from guns in my possession or from guns in others possession; I hereby state that I am aware of these risks and 

freely accept and fully assume all such risks, dangers and hazards and the possibility of personal injury, death, property damage or loss, that may result from any participation in the Hunt.

RELEASE OF LIABILITY, WAIVER OF CLAIMS AND INDEMNITY AGREEMENT: In consideration of approval for me, or my guardian child, to participate in the Hunt, I agree and confirm as follows (initial all):

TO RELEASE THE RELEASEES from any and all liability for any loss, damage,
injury or expense that I/my guardian child may suffer, or that my next of kin may suffer, as a result of my/my guardian child’s participation in the Hunt, due to any cause whatsoever, INCLUDING NEGLIGENCE, BREACH OF CONTRACT OR BREACH OF ANY STATUTORY OR OTHER DUTY OF CARE whether such loss, damage, injury or expense was reasonably foreseeable.

TO HOLD HARMLESS AND INDEMNIFY THE RELEASEES from any and all
liability for any theft or damage to property of, or personal injuries to, or wrongful death
of, myself, my guardian child, or any third party, resulting from my participation in the
Hunt, and will defend any and all suits that may be brought against Releasees as a
result of any such injuries or damage caused directly or indirectly by me/my guardian
child and will make good to, and reimburse, Releasees for any expenditure that any of
them incur reason of such injuries or damage.

It is my responsibility to ensure that I/my guardian child have adequate medical,
personal health, dental and accident insurance coverage, as well as protection for
personal possessions.

I understand that the Hunt I/my guardian child participate in may be conducted at
sites that are remote from available medical assistance and that Whiskey Creek Ranch,
LLC will not have medical personnel on site, and nonetheless agree to proceed with
such activities in spite of the possible absence of medical assistance.

I understand that any equipment provided for my/my guardian child’s protection
may be inadequate in preventing serious injury.

This Agreement shall be effective and binding upon my heirs, next of kin,
executors, administrators, representatives and assigns in the event of my death or
incapacity.

In entering into this Agreement, I am not relying upon any oral or written
representations or statements made by the Releasees other than what is set forth in this
Agreement.

In entering into this Agreement, I confirm that I/my guardian child have a valid
license(s) allowing myself/my guardian child to possess firearms and participate in the
Hunt.

In entering into this Agreement, I confirm that I/my guardian child have received
proper instruction regarding firearm use and safety, and that I/my guardian child am
competent to safely use the firearm(s) that I/my guardian child will use I the Hunt, and
that I/my guardian child have lawful possession of the firearm(s).

In entering into this Agreement, I hereby grant the Releasees non-revocable
permission to capture my image and likeness in photographs, videotapes, recordings, or
any other media (collectively, “images”). I acknowledge that the Releasees will own
such images and further grant the Releasees permission to copyright, display, publish,
distribute, use modify, print and reprint such images in any manner whatsoever related
to the Activities, including without limitation, publications, advertisements, brochures,
website images, or other electronic displays and transmissions thereof. I further waive
any right to inspect or approve the use of the image by the Releasees prior to its use. I
forever release and hold the Releasees harmless from any liabilities arising out of the
use of images in any manner or media whatsoever, and waive any and all claims and
causes of action relating to use of the images, including without limitations, claims for
invasion of privacy rights or publicity.

This Agreement shall be governed by, construed, and enforced in accordance with the
laws of the State of South Carolina, without giving effect to the principles of conflict of
law thereof.

I HAVE READ AND UNDERSTAND THE AGREEMENT AND I AM AWARE THAT BY
SIGNING THIS AGREEMENT I AM WAIVING CERTAIN LEGAL RIGHTS WHICH I/MY
GUARDIAN CHILD OR MY HEIRS, NEXT OF KIN, EXECUTORS, ADMINISTRATORS
AND ASSIGNS MAY HAVE AGAINST THE RELEASEES. (Participants under 18 years
of age must have a parent or legal guardian complete and sign this document.)
