This Agreement is made for the Client and Kiarne Randall ‘’Photography by Kiarne’’. 

AGREEMENT

This agreement contains the entire understanding between Mrs K Randall and the client. The only way to add or change this agreement is to do so in writing, signed by all parties. In the event that any part of this agreement is found to be invalid or unenforceable, the remainder of this agreement shall remain valid and enforceable. 

RESERVATION

A signed contract and retainer fee are required to reserve the date and time of the event. If the event is postponed, or cancelled by the client, the retainer fee is non-refundable. The photographer holds the right to reschedule due to severe weather to protect the equipment. If the client cancels within 72 hours, they forfeit the original holding deposit and will incur a further $50.00 holding deposit to secure the new date. The photographer holds the right to choose to waive the first reschedule fee, however if there is a second occurrence this will always result in a new holding deposit needed of $50.00. The client agrees to confirm the schedule one-week prior to the event. Notification of any changes in schedule or location must be made in a timely manner and confirmation of receipt must be obtained from the photographer. In the event the client wishes to cancel, a weeks notice must be given.

RESPONSIBILITIES

The client and the photographer agree that cooperation and punctuality are essential to accomplish the goals and wishes of all parties. Shooting commences at the scheduled start time and ends at the scheduled end time. If the client does not arrive at the appointed time for the event, shooting will commence at the scheduled start time and end at the scheduled end time. All additional time beyond the scheduled end time may be billed to the client at the discretion of the photographer.

Mrs K Randall is not responsible for compromised coverage due to causes beyond the control of the photographer, including but not limited to arrival time of client, children not participating and weather conditions. Mrs K Randall is not responsible for backgrounds or lighting conditions which may negatively impact or restrict the photo coverage. The photographer will do their best to capture the best moments of the shoot, however they will not be held accountable for failure to deliver images of any individuals or any objects. If the session cannot take place due to extreme weather conditions such as extremely high temperatures or unexpected storms, Photographer and Client will reschedule on an agreed upon date with no additional charge, as stated above. The Photographer agrees to do their absolute best to get the best images of all participants. It is the photographer's responsibility to provide an online gallery of (the agreed amount) edited photographs within a two week time frame to the email supplied by the client in the completed questionnaire.  The Client also notes the photographs cannot be altered, edited, sold or published for advertising other businesses without written consent from the Photographer. Credit must be given when posting on social media and/or websites. Edits will be made in colour or black and white, in the Photographers composition and style. If you request further retouching changes, there may be an additional charge. Raw images will not be supplied, original photographs are not included, only edited images will be supplied. The Photographer retains the right to edit the photographs and omit any image. It is understood that Photographer will not deliver every exposure taken. Client agrees to abide by Photographer’s editing decisions. 

The photographer will not tolerate bullying, harassment, intimidation tactics of any kind. If the photographer is feeling harassed or feeling unsafe, the photographer will leave without refund. Any damage to the photographers gear, which is the clients fault, will be at the expense of the client/individual responsible, which will be invoiced and due within 14 days of the incident. The Photographer holds no responsibility for safe keeping of images (originals or edits), after final delivery. Once the final gallery has been delivered, the client is responsible for making a backup of all photos from the digital download. The Photographer is not responsible for client dissatisfaction due to the print method. If for some reason the photographer is unable to deliver the pictures, a full refund will be given, but cannot be held legally responsible. The Photographer is not responsible for any injuries that happen to other individuals during the shoot. The Client will not hold Photographer or the owner of the property liable for any injury that may occur during the session. The Photographer is not responsible for any damage to clothing and/or property. The Photographer is not responsible or stings or bites that may occur from being outdoors.

 

MODEL AND MEDIA RELEASE

The Client understands that Mrs K Randall may use these photos on their website, social media and other forms. The final post production and editing styles, effects, and overall look of the images are left to the discretion of the photographer. 

OWNERSHIP

The client acknowledges that Mrs K Randall is the owner of the photographs produced by Mrs K Randall, however she is allowing access to use of these photographs to the client. If you are wishing to choose to use your photographs in a competition, advertising, or submitting in a publication, please request, advise and credit ''Photography by Kiarne''.

PAYMENT SCHEDULE

A non-refundable deposit of $50.00 must be paid when reserving the date for the event. The remaining payment must be paid prior to the shoot, unless agreements have been approved by the photographer. No part of any order, including previews, will be delivered until the balance is paid in full. The charges in this Contract are based on Photographer’s Standard Price List. This price list is adjusted periodically, and future orders shall be charged at the prices in effect at the time the order is placed.
