The tenant expressly declares that he will use the surf equipment with the greatest possible care, in accordance with art 1094 of the CC, in accordance with the rules and practices of the sport of electric surfing whose rules and materials declares to know the tenant. The lessee is obliged to take good care and take all necessary precautions to protect the material. E.g. (Do not approach rocks; Do not sit on the material in the sand / rock, etc.).
Damages to themselves and / or to third parties, caused by improper or reckless use of the leased material (or transferred free of charge) will be the sole responsibility of the lessee.
The lessee declares having reviewed said material before leaving with JETSURFFUERTEVENTURA personnel, and in any case having declared in writing in this same contract, the defects that the rented material may already have.
The lessee acknowledges having received the rented material in good condition and functioning, with the necessary accessories for its correct use.
The lessee acknowledges having received instructions for the correct use and maintenance of Jetsurf by JETSURFFUERTEVENTURA.
The lessee is obliged to use the leased material with the greatest care and in accordance with the rules and practices of the sport of electric surfing whose rudiments the lessee declares to know. It is expressly prohibited to:
Go more than 5 km / h less than 100 meters from the beach.
Approach less than 100 meters from the beach during rental time. Except in situations where the tenant returns to the beach due to the conclusion of the rental time or to change the boards with the second rented.
Enter the swimming area.
Approaching rock áreas and approach less than 200 meters from the port of Corralejo.
Approach with the board less than 50 meters from swimmers, surfers, boats etc.

The client will be responsible in case of loss, theft, partial or total deterioration of said material; in these cases the client declares to accept with this contract to pay JETSURFFUERTEVENTURA the expenses charged to the repair or change of the material in case of breakage or deterioration.
A security deposit will be held on your credit card to respond in case of breach of its obligations for situations of loss or total or partial deterioration of the rented material. Therefore, the client expressly authorizes the payment in account or of said deposit in whole or in part, according to the evaluation of the damages (which the personnel of JETSURFFUERTEVENTURA carries out for this purpose). Said deposit will be returned to the client once this contract has ended and the good condition of the material has been reviewed.
In any case, JETSURFFUERTEVENTURA is exempt from all liability arising from personal and / or material damages including those self-inflicted by the client, as well as to third parties, that occur as a result of the correct and incorrect use of the material or for breach of obligations assumed by the client expressed in the previous paragraphs.
The tenant declares to be in perfect health and with the necessary conditions for the practice of sports. You should take into account our recommendations according to your level and the conditions of the beaches.
Surf material will be delivered to the place established by the landlord or designated person for that purpose and will be returned at the date, time and place agreed by the lessor of the material and the lessee.
The lessee is responsible for being insured with adequate coverage against risks that may arise during the rental period. The landlord is not responsible for claims for accidents, injuries, blows or damages caused to himself or to third parties during the rental period.
It is prohibited to assign, lend, sell, exchange or transmit in any of its forms (with or without profit), the surf equipment leased to persons or entities other than those stipulated in this contract.
The lessor may unilaterally terminate the contract in advance in case of default by the lessee, for misuse and / or failure to comply with the Jetsurf rules. In this case, the lessor may take immediate possession of the material in the place where it is located, without the lessee being entitled to any claim or compensation, given its contractual breach
The surf equipment will be returned in the same delivery conditions, if it is not, the tenant must report the damage. The following replacement costs are imposed by the lessor and are accepted in this contract by the lessee expressly:

By the mere fact of renting a Jetsurf board and practicing it, it is assumed that, due to the characteristic characteristic of the activity, when performed in a natural environment, by the lessee, it is accepted and is aware of the certain risk that It can involve the activity.
The lessee undertakes not to be intoxicated and / or under the influence of narcotic, relaxing, exciting and / or hallucinogenic substances, as well as of medications that may impair the intellectual, volitional and / or motor skills during the use of the material Jetsurf rental.
The lessee declares to know how to swim freely for at least 100 meters and that there is no impediment or medical prescription that makes it impossible to carry out the Jetsurf activity.
I undertake to assume and leave JETSURFFUERTEVENTURA, its partners, administrators, agents and representatives harmless, of all liability to third parties arising from and / or resulting from fortuitous cause, force majeure and / or breach by me of the rules and / or for committing any imprudence, negligence and / or pain on my part.
The images, photos, videos, etc. .. taken during the rental period may be used for advertising purposes only by JETSURFFUERTEVENTURA (social networks or other means), so that the tenant customer expressly transfers the rights that may correspond to exclusivity of JETSURFFUERTEVENTURA.
In proof of acceptance and conformity of the foregoing, and for the record, the parties sign this contract in duplicate at the place and date outlined in the heading.
