  • Welcome to your closing!  We represent the Buyer in North/South Carolina, to make sure they have free/clear title (among other things).  However, we will also represent you through a limited capacity to produce the documents you need for closing, if you so choose (this is usually the most efficient and cheapest).

    You may choose to hire a different attorney at your own cost.  Be aware that two attorneys can double the cost to you.  It is your right to pay a different attorney independently, though.  Regardless of whether you choose us (most common) or someone else, this package is hugely important!

    Your closing is delayed indefinitely until we receive this from you.   It can be faxed to us (866.535.8589) or emailed to any email address (preferably your paralegal that is assigned to the file).  Until we receive this information, we do not do a title search because we do not have your information that is needed to perform that title search!  Your Social and Date-of-Birth may be used to confirm judgments/liens and other information.  It's also used for government reporting purposes.  Our e-mails are secure and our private system is heavily guarded by a private network and various security protocols. 

    We use this to order mortgage payoffs, which can take a week to receive from your lender.  If you delay sending this to the firm by a week, and the title search takes a week, it can easily push your closing to 21 days (or longer).  It is imperative to return this as soon as possible!

    North Carolina Properties: Per North Carolina Statute §45A-4 Good Faith Settlement Procedures Act:

    Closing funds may not be released prior to deed recording.

    All States: Closing proceeds will be in the form of a check or a wire. Closing proceeds will never be actual cash money.

        

  • Prior Title Policy

  • If you have this title policy, please provide it with this information sheet. This can save you $300! If you provide us with your prior title policy, we can use that to reduce the number of years we have to search, which saves you money. You can obtain this by calling the law firm that you used to do your closing: ask that they fax the policy to us or, at least, give us the name of the company they used so that we can request it from that company (you may also email it to us or fax: 866.535.8589).

  • AUTHORIZATION FOR THE RELEASE OF INFORMATION

  • I (we), the undersigned parties hereby release, remit, authorize and direct your respective companies to release all necessary loan information and date to the following person(s) and/or entities:

    1.             24 Hour Closing and any of its employees

  • AUTHORIZATION FOR 24 Hour Closing TO PREPARE DOCUMENTS, LIMITED ENGAGEMENT

  • It is arguably unethical for any Party to force another Party to use a particular Attorney or settlement agent for any work, including real estate closings. That being said, it is typical that buyer and seller use the same Attorney for a real estate closing, due to the Attorney's familiarity with the file and because it is usually cheapest to do so.  Otherwise, two law firms may charge you duplicative fees.  24 Hour Closing will endeavor to ensure clear/free title to Buyer, but does not guarantee to Seller such as 24 Hour Closing represents Seller in a limited capacity.  Seller remains responsible for any undiscovered title defects and errors and warrants that they will be quickly rectified if notified by 24 Hour Closing (even after closing).

    (documents such as the deed, lien waiver, 1099, etc).  The cost is usually $450, which is usually far cheaper than hiring your own Attorney. You are not charged this amount unless the transaction is completed, and this will be factored into the purchase contract and sales price. 24 Hour Closing only represents Seller for the limited purpose of conducting the closing (no attorney/client privilege or client relationship) and will not investigate tax consequences, adequate purchase price, any Realtor related questions, wholesaler/investor related issues or anything beyond the preparation of seller documents.  It is your responsibility to ensure that adequate sales price, through the use of a N.C. licensed Realtor, has been obtained

  • If your real estate closing involves a mobile home or other personal property that may be titled by the North Carolina DMV, it becomes necessary for our firm to send a request to the NC DMV that includes your VIN and other personal information to ascertain whether any liens have been recorded against title. Your Signature below is authorization to allow a title searcher at Pinyan Law Office PLLC or 24 Hour Closing to request such information. 

  • Award Keys

  • It is typical for 24 Hour Closing to award keys at the closing table, which may be 2 or 3 hours before physical recording and disbursement.  No negative repercussions of this action has ever been encountered by 24 Hour Closing and we strongly believe that a vacant, unmonitored property has more liability than allowing Buyers to move in 2 hours early. You agree to hold 24 Hour Closing and either/both Realtor(s) harmless of any such complication that may result from either action:  handing keys over at closing or you choosing to hold keys until recording. 24 Hour Closing will not hold keys in the office.  If Seller chooses not to deliver keys at time of closing, they may alternatively ask their Realtor to hold keys for Buyer pickup upon recording.

  • DEBTS EXPLAINED

  • As referenced above, it is typical for Sellers to use the same Attorney as the Buyer. Engagement of 24 Hour Closing by you does not obligate 24 Hour Closing to be responsible for your debts (HOA, taxes, mortgage, judgments, etc). 24 Hour Closing will perform a diligent search to attempt to address any such applicable debts because Buyer will often require the purchase to be backed by Title Insurance. However, this title insurance (Buyer paid) does not cover your obligations, either. Should a debt of any sort be missed for any reason (very rare), you continue to be liable for such debt and agree to coordinate and attempt to remedy that debt as requested by 24 Hour Closing or applicable title insurance company.   It is your duty and responsibility to immediately notify 24 Hour Closing of any taxes/insurance/liens/mortgages or other encumbrances to your Property that are not on the HUD/CD.  It remains your responsibility to timely pay these if they are missed by fault of any Party.

  • Privacy, Laws, Conflicts

  • It appears that our government enjoys changing privacy laws, sometimes daily.  If you wish to limit our authority to use your information to request these payoffs in any way, please hire independent legal counsel. 

    Please report any known, perceived or possible Conflicts of Interest IMMEDIATELY, to HML and refuse to sign this form until discussed with 24 Hour Closing.  By signing this document, you realize that 24 Hour Closing has possibly represented various Parties in this transaction in a previous real estate closing as Buyer, Seller, Agent or another associated Party (maybe even as an owner of a Party or Property associated).  We conduct thousands of closings and have likely dealt with associated Parties before.  You waive any possible conflict that this may represent unless you notify 24 Hour Closing in advance and hire independent legal counsel (at your own cost).  Please notify us IMMEDIATELY if you do not waive the right to our representation of you in any manner/capacity.

  • Due to the high levels of internet crime and wire fraud, we have partnered with CERTIFID for sending out wire proceeds. CERTIFID is a 2nd level review system to detect for potential fraud and verify your identity. This system has been put in place to protect your funds. This process may take up to 24-48 hours and funds will not be wired prior to satisfactory verification of identity and approval through the CERTIFID system. If you do not want to wait for 24-48 hours after closing for funds, please opt to receive a check after closing.  We will collect your choices for disbursement at closing. If you do opt for a wire transfer, please make sure to bring your account information with you to closing.
