• Student Agreement (the "Agreement", hereafter)

    In consideration for participating as a student in any martial arts and fitness program and/or class offered and conducted by Bergmen Group, Inc. under the brand name "STAND OUT" (referred as "STAND OUT" hereafter):

    1) I certify that I am at least eighteen (18) years of age. If under eighteen (18), the parent or legal guardian undersigning below executed this Agreement on my behalf.

    2) I am in good physical condition and fully able to participate in this program. I am fully aware of the risks and hazards connected with the participation in martial arts and fitness, including physical injury or even death, and hereby elect to voluntarily participate in the program, knowing that the associated physical activity may be hazardous to me and my property.

    3) I understand that the program may test my physical and mental limits, and that STAND OUT and its personnel, including volunteers, are not responsible for adapting the program to any health issues or conditions I may disclose or display.

    4) I VOLUNTARILY ASSUME FULL RESPONSIBILITY FOR ANY RISKS OR LOSS, PROPERTY DAMAGE, OR PERSONAL INJURY, INCLUDING DEATH, that may be sustained by me, or loss or damage to property owned by me, as a result of participation in this program.

    5) I hereby RELEASE, WAIVE, DISCHARGE, AND COVENANT NOT TO SUE, STAND OUT, their officers, servants, agents, employees and volunteers (hereinafter referred to as “Releasees”) from any and all liability, claims, demands, actions and causes of action whatsoever arising out of or related to any loss, damage, or injury, including death, that may be sustained by me, or to any property belonging to me, while participating in physical activity, or while on or upon the premises where the event is being conducted.

    6) It is my expressed intent that this Agreement shall bind the members of my family, if I am alive, and my heirs, assigns and personal representative, if I am deceased, and shall be deemed as a RELEASE, WAIVE, DISCHARGE, and CONVENTION TO SUE the above named Releasees.

    7) I agree to comply with the code of conduct established by STAND OUT.

    8) STAND OUT may take photos and videos of students for educational or promotional purposes. I give consent and authorization to STAND OUT for the use, reproduction, editing, and publication of photos and videos identifying me. I waive and forever release STAND OUT from and against any and all claims, demands or causes of action arising out of, or associated with, STAND OUT’s use of these photos or videos.

    9) In signing this online form, I acknowledge and represent that I HAVE FULLY READ this Agreement, UNDERSTAND IT AND SIGN IT VOLUNTARILY as my own free act and deed; no oral representations, statements or inducements, apart from the foregoing written agreements have been made; and I EXECUTE THIS RELEASE FOR FULL, ADEQUATE AND COMPLETE CONSIDERATION FULLY INTENDING TO BE BOUND BY SAME.
