• New Artist Submission -Martello Alley & Martello on Brock

    This form is for applying to be an artist to either Martello Alley or Martello on Brock, and to give you an idea of the roles and responsibilities of the artist and the gallery. Before applying, be sure to READ and UNDERSTAND the terms and conditions of belonging to our collective. Note: in the terms and conditions, "you" shall mean the artist and "we" shall mean the gallery.

  • Who we are: Martello Alley and Martello on Brock are artist collectives. All artists who display their art or handmade works are members. We support each other and our galleries by encouraging and assisting fellow members as required. This includes, but is not limited to, sharing knowledge, sharing social media posts of the gallery and the other member artists, and promoting the gallery for the benefit of all the members. In the same way we also support the local art communities and our beautiful downtown. We believe that art is not just something inside an art gallery - it is everywhere. It is transformative. It changes people and places for the better. It can turn a bleak space into a wonderful, bright, inspiring place, delighting people who visitors and residents alike. As residents of Kingston and area, we are passionate about our city, and the value of an interesting and vibrant downtown. 

    Gallery Representation/publicity: You are expected  to use social media channels to promote your art and your association with our gallery whenever appropriate. You are also encouraged to keep abreast of community events involving the arts, and in particular involving our gallery and if appropriate and convenient, participate in these events. 

    Specifically, you, as an artist, are required to inform through your websites, social media and other means.  We want to see our artists achieve success. Therefore we do not ask for exclusivity between the gallery and the artists. But we would ask that you, upon offering work for sale outside of the gallery, state that you have more work available at Martello Alley and/or Martello on Brock. This will increase your exposure as well as the gallery for future sales. 

  • Providing artwork: All artwork to be accepted and displayed in the gallery must be clean, dry and either appropriately framed or gallery wrapped (canvasses). Art must have appropriate hanging hardware, i.e. D-rings. Art accepted is at the discretion of the gallery. All art coming into the gallery shall not be "dropped off" but must first be submitted online for review and must contain the required mandatory information including, but not limited to, the title, description, price, quantity, dimensions, estimated weight and dimensions in packaging. Art that does not conform to these guidelines will not be accepted by the gallery.

  • Ownership and representation: As an artist in our gallery you retain ownership of all work consigned to or represented by us. You also retain copyright to all consigned artwork in perpetuity, as governed by law. You permit us to use images of your artwork for the promotion of the gallery (online, brochures, etc.). This permission continues even after you are no longer represented by the gallery. We require this so that we are not required to redesign brochures or other media containing an artist's work after the artist is no longer with our gallery. 

    (This applies to fine artist and not music) While within the contract term, should you wish to display your art in permanent or temporary venues other than our gallery, you may do so, provided that you advise us as to where and for how long your work is to be displayed elsewhere outside of our gallery. Any of your artwork removed from our gallery must be agreed to by us and replaced with artwork of similar quality, appearance and price.  

    (This applies to fine artist and not music) You shall not undercut the gallery by offering work directly to customers at a discounted price. Also, you shall not offer identical or similar work at a lower price than the retail price at our gallery.

    If your consigned artwork remains unsold at the end of the contract term, and if the term is not renewed, you must retrieve your work in a timely manner.

  • Pricing: (This applies to fine artist and not music) Retail sales price for each consigned artwork will be established by us in consultation with you.  Factors influencing retail sales price include history of prior sales by you, market demand, size and medium, and our knowledge of our inventory, buyers, and price-points. You agree to abide by our decision regarding price-setting. We will exert all reasonable efforts to close sales of consigned or represented artwork. You agree to provide us, in a timely fashion and upon request, with any necessary documents or information in support of sales, e.g., your biographies, backgrounder on methodologies, etc. 

    Discounts: Discounts may be applied to a sale by either us or you and must be agreed to by both parties before being applied to a sale. (Agreements on discount structures may be obtained either in advance or at time of sale.) Discounts are defined as prices provided to close a sale and are reduced pricing from the Shopify list price. Our gallery fee will be based on the original Shopify list price plus credit processing fee if applicable, and not the discounted amount. 

    Payments: Payment will be provided on the 15th of every month and following the receipt of an invoice from you.

    Instalment payments: (This applies to fine artist and not music) If we accept instalment payment sales, you agree to accept partial payments as received by us.  Artwork will not be released by us to a buyer until full payment is received.  If artwork is released to a buyer before full payment is satisfied, we agree to pay you the full portion owed.  We will provide you with account statements of sales activity for all inventoried work prior to the 15th of every month. 

    Commissioned work: You may agree to allow commissioned pieces through the gallery. The buyer must provide 50% of the total retail cost of the art to us, up front.

    Insurance: We will not maintain insurance for fire/ theft/ vandalism to cover the art inside or outside the gallery. If you have a requirement for this coverage, you must make you own insurance arrangements. Reasonable efforts will be made to protect consigned artwork from accidental damage or breakage or theft.

    Staffing: You may decide to offer to staff the gallery in return for a reduce gallery consignment fee, however we reserve the right to accept or decline your offer.
