    EVENT GUIDELINES AGREEMENT

  • Thank you for your interest in fundraising to benefit the PTSD Foundation of America & Camp Hope (“PTSD Foundation” or “we” or “our”).

    Please carefully review this Third-Party Fundraising Event Guidelines Agreement (“Agreement”). By signing below, you, the undersigned (referred to herein as “you”) agree to abide by the following guidelines and to be bound by these terms.

  • What Does This Agreement Cover?

  • This Agreement covers fundraising events and activities hosted or operated by a third-party in support of the PTSD Foundation where the PTSD Foundation has no obligations related to the event (referred to in this Agreement as an “Event”).

  • Getting Your Event Approved

  • Please complete this Agreement and the attached Event Form for approval

    1. The PTSD Foundation must first approve your Event before you may promote or hold your Event.
    2. Your Event must comply with all applicable local, state, and federal laws, rules and regulations.
    3. The PTSD Foundation reserves the right to approve or not approve any Event in its sole discretion.
  • Promoting Your Event

    • Upon approval of your Event, the PTSD Foundation will, at your request, provide you with a copy of its logo(s) for use solely in connection with your marketing materials for the Event. You may not alter or modify any such logo without written permission from the PTSD Foundation
    • The PTSD Foundation must pre-approve all marketing materials with its name or logo(s) on them before they can be used
    • You may not list the PTSD Foundation as the sponsor of your Event.
    • You may list the PTSD Foundation as the beneficiary of your Event (e.g., “all proceeds to benefit the PTSD Foundation of America”)
    • You are responsible for marketing and promoting your Event.  While the PTSD Foundation cannot actively market or promote your Event, the PTSD Foundation may, in its sole discretion, mention your Event to our members through, without limitation, our website, newsletters, or social media accounts
    • The PTSD Foundation cannot provide you with mailing lists (e.g., for volunteers or donors) and cannot distribute any materials on behalf of your Event, solicit donations or collect money on behalf of your Event.
    • The PTSD Foundation cannot guarantee that any of its staff, Board Members, or volunteers will attend your Event
  • Expenses for Your Event

    • All costs and expenses related to your Event are solely your responsibility.
    • Unless otherwise agreed in writing, the PTSD Foundation will not reimburse you for any expenses related to your Event and you may not charge anything for your Event to the PTSD Foundation.
    • The PTSD Foundation cannot provide you with its tax-exempt number/letter for purchases for your Event.
  • Proceeds from Your Event

    • All accounting related to your Event is solely your responsibility.
    • You may not establish a bank account or other financial transaction account in the name of the PTSD Foundation or any of its related organizations.
    • For donations made directly to the PTSD Foundation, please provide individual donor and donation information (including donor name, address, date and amount of donation) so that we may provide donor acknowledgement letters as may be required by law.
    • You must notify the PTSD Foundation before seeking donations/support from any third-party businesses or organizations to ensure that fundraising efforts do not overlap.
    • Please submit all donations and proceeds from your Event to the PTSD Foundation within thirty (30) days of your Event. The PTSD Foundation reserves the right to audit your books and records related to your Event for up to one year from the Event.

  • Insurance and Liability for Your Event

    • You are solely responsible for obtaining insurance coverage for your Event.
    • If you are conducting a sporting event (e.g., marathon, race, ball game, etc, you must require all participants to sign a liability waiver that expressly waives any claim against the PTSD Foundation.
    • You are solely responsible for obtaining any and all permits required in connection with your Event.
    • You agree to indemnify, defend and hold harmless the PTSD Foundation, including its directors, officers, employees, agents and volunteers, from and against any and all suits, claims, demands, liabilities, damages, costs and expenses (including reasonable attorneys’ fees) arising out of or relating in any way to you, your business, your organization, and the fundraising activities authorized hereunder.
    • YOU UNDERSTAND AND AGREE THAT THE PTSD FOUNDATION WILL NOT BE HELD LIABLE, DIRECTLY OR INDIRECTLY, IN CONNECTION WITH YOUR EVENT.

    This Agreement is effective as of the latter of the two signature dates below and will remain in effect until one (1) year following the Event unless otherwise terminated. Either party may terminate this Agreement at its convenience. In the event of termination, all funds collected under this Agreement must be remitted as specified above and any terms in the Agreement which by their nature should survive termination will survive. This Agreement and the related Event Form constitute the entire agreement and understanding between the parties with regard to the subject matter herein and therein. Any amendment or other modification to this Agreement must be in writing and signed by both parties. This Agreement is binding on and shall inure to the benefit of the parties hereto and their respective successors and assigns. Any dispute related to this Agreement will be governed by and construed in accordance with the laws of the State of Texas without giving effect to any choice or conflict of law provision. The parties agree to submit to the jurisdiction of the federal and state courts located in Harris County, TX. This Agreement may be executed in counterparts, each of which shall be deemed an original, but which together shall be deemed one and the same agreement. A signed copy of this Agreement delivered by e-mail or other means of electronic transmission shall be deemed to have the same legal effect as delivery of an original signed copy of the Agreement.

    I, THE UNDERSIGNED, HAVE READ AND AGREE TO THE TERMS AND CONDITIONS OF THIS AGREEMENT AND HAVE BEEN DULY AUTHORIZED TO ENTER INTO THIS AGREEMENT.

  • 1) Events are scheduled on a first come first serve basis. While we make every attempt to ensure the PTSD Foundation of America will be properly represented at your event we are limited by our staff. 2) We prefer events be booked at least 2 weeks in advance to ensure sufficient planning & preparation. 3) Please provide us with as much detail as possible. Our staff is fully capable of assisting in many areas each having a diverse background. The more details you provide the better able we are to match the best person for your event. 4) the fundraiser portion of this application may take 2-3 business days for approval.
