  • This Agreement is made and entered into by and between Baldwin Hill Conservation Cemetery (Seller), a nonprofit cemetery association incorporated under the laws of the State of Maine, and Purchaser:

  • Interment Right with Plot Location Determined at Time of Burial

    The Seller covenants and agrees that upon payment of the full purchase price, it will grant a single right of interment in one burial plot at the Baldwin Hill Conservation Cemetery in Fayette, Maine. The exact location of which will be established by the Cemetery just prior to interment.

    Limitations

    The Purchaser shall acquire no rights whatsoever in the ownership of real estate in the Cemetery but rather only the right of interment at a plot location to be determined at a time just prior to interment. Purchase of an interment right is solely for the right to be interred and does not include any associated services or products.

    Assignment of Interment Right

    Purchaser shall have the right to assign the interment right granted hereunder but said assignment will only be effective when Seller has been notified in writing of said assignment and the assignment has been recorded in the records of the Cemetery.

    Refund and Abandonment of Interment Right

    Purchase of the interment right granted through this agreement is non-refundable. Purchaser's right to burial will be considered abandoned, and the purchase price forfeited, if at any time the Cemetery receives notice or reliable information that Purchaser has been interred elsewhere and if said interment right has not been officially assigned to a new owner.

    Purchaser’s Agreement to Abide by Seller’s Rules and Regulations

  • Baldwin Hill Conservation Cemetery Rules and Regulations

    Rules for Burial

    • Baldwin Hill Cemetery does not accept embalmed remains for burial.
    • Baldwin Hill Cemetery does not permit the use of outer burial containers, burial vaults, or liners of any kind.
    • Only biodegradable materials may be used for burial containers, buried during interment, or placed as decoration on gravesites. Natural fiber shrouds, caskets made from local non-exotic wood, and wicker or other plant materials are all acceptable burial containers. All items buried or placed on the grave must be biodegradable and of natural character: no plastics or significant metal components are allowed. Uncoated steel screws and nails are acceptable for casket construction.
      – On Memorial Day, Veterans’ graves can be temporarily adorned with non-biodegradable decoration such as flags. Decorations must be removed the Wednesday after Memorial Day.
    • Native stones may be used as memorial markers of interment sites.
      – The stone memorial must not exceed 300 square inches in area, as viewed from above and must lie flat or be partially buried and not extend more than 3 inches above the surface of the soil. Stones must not disrupt or disturb the integrity of the interment.
      – Stones may be engraved and shaped (natural shapes preferred), but not polished or painted. Engraving and other memorial content must be deemed appropriate by the Cemetery, and the placement of a memorial must be within the defined plot limit.
    • Approved non-invasive native plants may be planted on interment sites.
      – In order to allow for grave and cemetery maintenance, planted trees are not permitted.
      – No imported mulch, top-dressing, landscape fabric, or edging is allowed.
    • Baldwin Hill Cemetery will maintain the Cemetery in perpetuity; however, it does not guarantee any specific condition of gravesites, memorial markers, or memorial plantings.

    The above rules are in accordance with the Green Burial Council Standards for a Conservation Cemetery.

    Owners of Interment Rights are asked to inform funeral directors, memorial companies, etc., of these requirements.

    Cemetery Property Rules

    • Apart from service dogs as stated in Maine law, dogs are not allowed on Cemetery grounds or in the surrounding Baldwin Hill Conservation Area (Conservation Area).
    • Hunting and trapping is not allowed on Cemetery grounds or in the surrounding Conservation Area.
    • Off-road vehicles are not allowed within the Cemetery or surrounding Conservation Area, aside from those used to assist with mobility impairments.
    • Bikes may be used on the gravel access road but are not allowed within the Cemetery.
    • No camping and no fires within the Cemetery or surrounding Conservation Area
    • Commercial foraging of mushrooms, fiddleheads, ginseng, blueberries, wildflowers, fir tips or other natural resources is prohibited.
    • Geocaching within the Cemetery or surrounding Conservation Area is not allowed.
    • No unmanned aerial vehicles (drones) are allowed to be flown over the Cemetery or Conservation Area without permission.
    • Unauthorized burial of, or tampering with, any object in the Cemetery is strictly prohibited.

    • Indemnification

      Purchaser hereby releases and forever discharges Baldwin Hill Conservation Cemetery
      of Winthrop, Maine, its successors or assigns (hereinafter collectively the “Releasees”) from all damages, injuries, suits, claims and demands whatsoever, including from negligence, which Purchaser, its successors or assigns may ever have for any personal or bodily injury, or property damage arising out of or resulting from, in whole or in part, the funeral and cemetery process.

      The Purchaser further agrees to defend and indemnify The Kennebec Land Trust against all such suits, claims and demands by any third party, including invitees and others, and to hold them forever harmless therefrom.

    • 30% or more of Interment Right sales income will be designated by Seller to a cemetery Perpetual Care Fund, in accordance with Maine State law.

    • By adding your eSignature below, Purchaser agrees to the terms of this Agreement. A representaive from Baldwin Hill Conervation Cemetery will counter-sign this agreement once payment is received. The Purchaser will then receive the signed copy via email. Please keep this copy for your records, and send a copy to the funeral home you will work with. Baldwin Hill Conservation Cemetery will also keep records of the agreement.
