SwingTraders Training Institute zealously protects its copyrights and images and will use all legal means available to prevent infringement of such material. For valuable consideration received, I the undersigned, do hereby grant to SwingTraders Training Institute their successors and assigns, for your own benefit and for the benefit of the others, the right to interview me and record, reproduce and publish such interview, in whole or in part, to photograph me, or otherwise record my image, both in still and motion pictures, and record my voice, separately and in synchronization with each other, by any means now known or hereafter to be discovered, together with the non-exclusive but perpetual right to use and duplicate such photographs or other images of me, whether in prints, negatives, slides, videotape, digital, film sequences or other formats and reproduce my voice, separately or in synchronization with such images for the purpose of marketing and promotion.
I hereby waive the opportunity or right to inspect or approve any such copy, text, proofs, negatives, tests, finished films, videotapes, audiotapes, digital images or recordings, and photographs or the uses to which the same may be put. All copies of my image, likeness, and voice created or recorded by you or your designee hereunder shall be the sole and exclusive property of SwingTraders Training Institute including any and all prints and negatives depicting the same.
I hereby acknowledge that the copyright to any performance by me recorded by you or your designee hereunder shall be owned exclusively by you for the term of such copyright, all such rights in and to said performances having been transferred by me to you hereby. We may include one or more special guest or keynote speakers in our program. You agree that you are not relying on this fact in registering and paying for the program. If a guest speaker cancels, the program will continue with no refunds or special credits issued.
You agree that regardless of when payment is made in advance of an event, such payment is earned upon receipt and becomes property of SwingTraders Training Institute. Our cancelation policy applies to in-person and online events.
If the program is canceled for force majeure events, like national disasters, war, pandemics, we will make reasonable efforts to reschedule the program and shall have up to one year to do so. Your registration for and attendance at the Program shall be governed by, construed, and enforced in accordance with the laws of India without regard to its conflict of law’s provisions.
This Agreement represents the entire understanding and agreement between you and SwingTraders Training Institute with respect to the subject matter hereof and supersedes all other negotiations.
The understandings and representations, if any, made by and between you and SwingTraders Training Institute. I hereby warrant that I am eighteen years of age or older, that I am fully competent to execute this agreement, and that no other agreements currently exist which would prevent my transferring these rights to you, or your successors and assigns. I acknowledge that you intend to rely on this release, and the grant of rights herein contained and shall incur significant costs in the production of the referenced work in reliance upon same. As a result, I agree not to institute any legal action to contest the rights conveyed to you herein.
I have read and understood the contents of this agreement/release and I am executing it of my own free will.
