MASPETH WELDING / MASPETH SQUASH- WAIVER

I. HEALTH & SAFETY

In consideration of being allowed to visit, test, experience, practice or spectate the game of squash at Maspeth Welding Inc. / Maspeth Squash LLC and/or use the facilities and amenities, located at 59-12 and 59-30 54th Street in Maspeth, NY 11378, (hereafter known as the “Premises), the undersigned acknowledges, appreciates, and agrees that:

1. I agree that I am in good health and have no disability, impairment, injury, disease or ailment preventing me from engaging in active or passive exercise or which would cause increased risk or injury or adverse health consequences as a result of naïve or abusive exercise. I assume full responsibility for my use of the facility and/or any equipment. Participation includes possible exposure to and illness from infectious diseases including but not limited to MRSA, influenza, and COVID-19. While rules and personal discipline may reduce this risk, the risk of serious illness and death does exist; and,

2. I knowingly and freely assume all such risks, both known and unknown, even if arising from the ordinary or gross negligence of Maspeth Squash LLC; 5912 54th Street, LLC; 5930 54th Street, LLC; Maspeth Welding Inc., JA Holding Corp; Robert Gibralter; Jeffrey Anschlowar; their officers, officials, agents, and/or employees, other participants, sponsoring agencies, sponsors, advertisers, and if applicable, owners and lessors of premises used to conduct the visit (“The Releasees”) or others, and assume full responsibility for my participation; and,

3. I willingly agree to comply with the stated rules and customary terms and conditions for participation as regards protection against any hazards, risks or infectious diseases. If, however, I observe and any unusual or significant hazard during my presence or participation, I will remove myself from participation and bring such to the attention of the nearest company staff immediately; and,

4. I, for myself and on behalf of my heirs, executors, administrators, assigns, personal representatives, successors, assigns, and next of kin, hereby release and hold harmless the Releasees of any liability arising out of the use of the equipment and/or facilities, with respect to any and all illness, disability, death, or loss or damage of any kind to person or personal property, whether arising from the negligence, ordinary or gross, of the Releasees or otherwise, to the fullest extent permitted by law.

II. RULES

SCHEDULING & USE: Use of or visits to the Squash Court shall be by appointment only.

SHOES: I will respect the wood floor and wear only indoor non-marking athletic shoes that are NOT used or worn outdoors. Shoes shall be cleaned of any debris before entering the court.

SAFETY GOGGLES: I will wear safety goggles on the court.

PERSONAL PROPERTY: Visitors shall remove all belongings including all personal items, garbage, equipment and vehicles when vacating the premises. Visitors are urged to avoid bringing any valuables onto the premises. I release the Released Parties of any and all claims, demands, suits, complaints, cause of action or any liability for loss, stolen or damage to personal property.
COVID-19: I will abide by all CDC, State and local regulations.

III. PHOTO / VIDEO RIGHTS

I understand that video production and/or photography may be conducted during my visit. I fully and irrevocably grant Maspeth Squash LLC; Maspeth Welding Inc.; 5912 54th Street, LLC; and Jeffrey Anschlowar, its agents, and its designees, the unqualified right and permission in perpetuity, to reproduce, copyright, publish, broadcast or otherwise use my name, image, likeness, voice, biography or other identification in any and all media now known or hereafter devised, for any commercial or non-commercial purpose at their sole discretion. I waive any right, claim or interest in such use and understand that there will be no compensation or other financial remuneration.

IV. WAIVER

I expressly, willing, and voluntarily assume full responsibility for all risks of any and every kind involved with my visit to the Premises, whether during actual play, prior to playing, following play, or otherwise. Without limiting the generality of the foregoing, I hereby irrevocably release The Releasees from, and hold them harmless from any and all claims, suits, rights, demands, damages, losses or expenses, rights of action, or causes of action, present or future, whether the same be known or unknown, anticipated or unanticipated, suspected or unsuspected, arising out of my visit in its entirety to the premises including but not limited to the use of and/or play, spectatorship, or any other physical presence on the Premises.

This is to certify that I, as parent or legal guardian, with legal authorization to enter this agreement on behalf the minor child above, have read and explained the provisions in this Release Waiver to my child/ward including the risks and his/her personal responsibilities for adhering to the rules and regulations. Furthermore, I confirm that both I and my child/ward understand and accept these risks and responsibilities.

I, for myself and on behalf of my/our and my child’s/ward’s heirs, executors, administrators, assigns, personal representatives, successors, assigns, and next of kin, hereby release and hold harmless the Releasees from any liability, claims, suits, rights, demands, damages, losses or expenses, rights of action, or causes of action, present or future, whether the same be known or unknown, anticipated or unanticipated, suspected or unsuspected, arising out of my child’s/ ward’s use of the equipment and/or facilities, with respect to any and all illness, disability, death, or loss or damage of any kind to person or personal property, whether arising from the negligence, ordinary or gross, of the Releasees or otherwise, to the fullest extent permitted by law.
