NON-REFUNDABLE RETAINER CONTRACT

This Contract is A NON-REFUNDABLE RETAINER CONTRACT and is used to place a hold, or retain a puppy. NON-REFUNDABLE means the retainer WILL NOT be returned at the purchaser's request AT ANY GIVEN TIME.

Definitions:

• Retainer: $500 fee paid by the Buyer to the BREEDER to compensate iHeart Mini Aussies for their ongoing work with animals, administrative duties, customer service, social media, and other necessary task
  • A retainer is ALWAYS non-refundable. Once the deposit is placed the customer is acknowledging that the services have already been rendered
     
• Puppy Selection: This represents placing a retainer on an available specific puppy

• A Pick Retainer: This represents placing a retainer for a spot in line for a not yet born litter (bred or not bred) OR a puppy born and pending evaluations

• Draft Day: Puppy selection process used by the BREEDER on certain litters

3. RETAINERS

• Funds Accepted at NO fee: Zelle, Cash, PUBLIX money order, Bank Transfer/Wire. We will no longer be accepting PayPal in any form.
  • If sending a money order, it must be sent USPS 1 or 2 day Priority mail, with tracking provided to Seller before seller places puppy on hold. Seller will hold puppy for THREE days from the time they place the retainer in the mail and tracking is provided.
  • In the event the retainer is not received in THREE days, the said puppy will be made available again by the seller.

• Future Pick Retainer: If retainer are placed prior to puppies being born for a pick puppy, picks must be chosen per current policy for that litter
  • It is up to the discretion of the BREEDER when selections, or “Draft Day” will begin.
  • iHeart Mini Aussies does NOT disclose any other buyer’s preferences to other buyers, followers, potential buyers, or the public
  • Puppy selection via Draft Day is made based on Waiting List order, and not color/gender/eye preference
• If you pay a pick puppy retainer prior to the litter being born or the eyes opening and the color or eye color you want is not produced, the retainer will not be refunded. The retainer will be retained for pick of future litters via transfer policy. Eye color may change the price per policy
• If you are buying a specific (AVAILABLE) puppy you can NOT transfer your retainer to another puppy or litter after the retainer has been placed.
• If the estimated height at maturity of the puppy changes prior to full payment of puppy and the buyer decides the said puppy is no longer desired, there will not be a retainer refund or discount.
• In the event death or injury while still in the care of iHeart Mini Aussies, the retainer will be refunded in full.
• The Seller has the right to refuse sale or return payment without explanation and at any given time while puppy remains with iHeart Mini Aussies, voiding the sale and agreement.
• Any payment will be processed back to the Buyer’s account provided in this agreement
• Final payment is due at pick up in cash 

4. PICK UP

All puppies must be picked up within 48 hours of passed a Health Certificate, at the designated pick up location date and time

• Buyer will be charged a $25/day boarding fee starting on day three after the Health Certificate
• All additional vetting expenses are separate from boarding and are the financial responsibility of the buyer

5. Out of Town/State/Country

• If you are Out of State or Out of Town, you MUST make your ticket and travel plans FLEXIBLE AND REFUNDABLE as no Seller can guarantee a release date until after the Health Certificate is passed and complete

• The seller is not responsible for any of Buyer’s expenses or hardships that may occur with a puppy or litter that is not released on the expected date.

• The seller is not financially responsible for Buyer’s travel fees or expenses in the event of puppy death

LATE TRANSFER:

​Late transfer is a transfer done AFTER you have selected a specific puppy. In this situation there is a $250 transfer fee. This transfer fee applies Please DO NOT do a late transfer. It is very stressful for us. We can NOT restock puppies they are not products. We keep the puppy ON HOLD or RESERVED and pass over many qualified families FOR WEEKs because YOU had already committed to a puppy. We have also done weeks to months of customer service, breeder support, check ins, social media engagements WITH YOU SPECIFICALLY and now we need to start over again and QUICKLY. Please do your best to not transfer after a puppy has been selected so. If you need to late transfer complete the transfer form and submit the $250 late transfer fee within 24 hours. We will set up a time to rematch you with a future puppy.

TRANSFERS DO NOT TRUMP OTHER DEPOSIT HOLDERS

Transferring to a different litter will not allow you to TRUMP or BE PLACED IN FRONT OF ANOTHER DEPOSIT HOLDER. Transfers will go to the next availble spot in the litter requested/floating deposit list.

I, the undersigned buyer, have read, understand, and agree with all of the terms and conditions set forth in this non-refundable retainer contract. I agree to not make any attempts to reverse payments or retainers as I acknowledge that the services are rendered at time of payment.
