This form is to be completed by the person agreeing to become an American Heart Association Instructor seeking Training Faculty (TF) status with Desert Education Solutions, LLC (AHA TC ID: AZ20967).

This is not an application for employment, but it is required to become an AHA TF appointee with Desert Education Solutions, LLC. Any verbal understanding or agreement between the prospective TF or Desert Education Solutions, LLC is superseded by the execution of this Agreement.

TF Commitment:

Teach at least 4 provider courses in 2 years, teach 1 instructor course in 2 years (unless waived by TC), monitor instructors/instructor candidates/Course Directors in accordance with the guidelines of the AHA, strengthen and support the Chain of Survival and the mission of the AHA in my community, conduct myself in accordance with the ECC Leadership Code of Conduct. and avoid any perception of conflict of interest in accordance with the AHA Statement of Conflict of Interest.

1. You acknowledge that you are not employed by the American Heart Association (AHA), Desert Education Solutions, LLC, or any other entity in the teaching or other delivery of AHA courses or acting as TF in discharging the duties associated with the TF appointment.

2. You must bear Instructor card(s) that have been issued through Desert Education Solutions (AZ20967) before any TF appointment will take place.

3. TF designation is NOT TRANSFERABLE among Training Centers, and as such, you will need to reapply with a new TC upon any changes in alignment status.

4. Your status as TF is revokable at any time. It is a privilege and a duty to hold that status within our organization. You will be expected to monitor other instructors as necessary to maintain your status. These people may travel to your facility to be monitored, and it is expected that that is free of charge to the monitored instructor.  If you need to travel to any other location, other than your recorded location of business, you may charge a reasonable fee to facilitate such monitoring, and the fees are in your own discretion, if it is initiated on the part of the instructor.

Failure to facilitate such monitoring, or a refusal thereof, and/or to fail to complete the required Instructor Monitoring Form will result in the TF losing the TF status within our organization. Flexibility and cooperation is sought, so that people from many different areas of the country can be accommodated appropriately.

5.  Instructor courses are only permitted under specific circumstances as outlined in this Agreement under the Instructor Course Regulations section. TFs are not to advertise instructor courses on the AHA Course Finder or personal website without explicit permission to do so from the TCC or authorized designee.

TF may conduct an Instructor Course (IC), subject to the following conditions:

1.  Any IC must be pre-approved by the TCC. The primary criteria for approving an IC is based on the courses currently scheduled and course completion cards issued by the Training Site (TS) that demonstrates the need for additional instructors to service the TS.

2.  Any potential instructor candidate(s) must be approved to attend by submitting the Instructor Inquiry / Application Form.  TF will be notified as to approval or denial of each instructor candidate. TF will not allow registration of any potential instructor candidate without prior approval of DES, LLC TCC or other authorized designee.

3.  If a TF acting on behalf of a TS would like to train an external entity to become a part of the TC, that will not be subject to the general assumptions under Part 1 of this section. However, as a separate entity, the instructor training will be provided by TF, but the servicing of the group will be done exclusively through the TC, unless ALL aspects of handing course paperwork, roster management, card purchasing, and the assignment of cards to students is borne by the training site.  

It is expressly prohibited to resell course completion cards to other instructors aligned in the network.

4.  Any instructor that is trained by TF will be provided with an independent instructor logon to Enrollware, and the TF conducting the course must advise the participants of this. These instructors will be free to submit rosters on their own behalf without approval or assistance from the TS.

By signing electronically below, you acknowledge the Agreement between Training Faculty (TF) and Desert Education Solutions, LLC (TC).

This Agreement is considered perpetual, except in cases of material breach of this Agreement, as evidenced by notice being duly provided to the Instructor by written correspondence (USPS postal mail and/or email), in which this Agreement may be terminated immediately on the part of the TC.

TF agrees that any disputes of this Agreement will be adjudicated according to the laws of the State of Arizona, subject to legal filing by the aggrieved party through the Superior Court of Maricopa County, Arizona. If any specific clause in this Agreement is found to be illegal or unenforceable under Arizona law, the remaining portions are still held to be in full force and effect notwithstanding.

The prevailing party in such a filed dispute shall be entitled to recoup any fees relating to the filing, corresponding attorney representation, and material fees associated with the legal dispute as filed in the legal jurisdiction noted above. 

TF status is revocable at any time for any reason, or no reason stated at all. TF serves at the pleasure of the TC and is not entitled to continued status or renewal.
