U.S. Customs and Border Protection (“CBP”) has the right to inspect any shipments imported into the United States, and You, the importer, are required to bear the cost of such inspections. 

As part of our general services agreement with {importer} ("You"), TEMPLATE provides a Customs Inspection Fee Waiver (“CIFW”). Pursuant to this waiver, We will pay your proportionate share of Customs Inspection Fees (as defined below), in connection with the importation of eligible container(s), up to a maximum of $5,000.00 USD per container. 

“CES” means a Centralized Examination Station approved by the CBP where a container is transported to undergo an intensive exam. 

“Custom Inspection Fees” means the fees assessed for a Customs Inspection.

“Customs Inspection” means a non-intrusive x-ray of a container or tailgate/backdoor exam of a container, conducted at the CBP port of entry or an intensive exam of a container completed at a CES.

The CIFW is not insurance. This CIFW does not apply to any shipments that are in violation of any applicable law, including but not limited to U.S. economic or trade sanctions, and We will not make any payments with respect to such shipments. 

The CIFW is limited solely to Custom Inspection Fees on eligible containers, as identified by Us, and does not apply to inspections of excluded categories of containers. Excluded categories include but are not limited to: containers holding prohibited and restricted content as listed on the CBP website, containers holding products that fail to comply with the regulations of the U.S. Consumer Product Safety Commission, and containers holding agricultural products, goods or commodities.

You understand and agree that the CIFW shall remain in effect as to all eligible containers, until You revoke the CIFW by written notice to Us. If You revoke the CIFW, You will be responsible for all Customs Inspection Fees incurred with respect to the container(s). All such Customs Inspection Fees will be added to your final balance due.
