  • Letter of Agreement

  • This Letter of Agreement (LOA) is made and entered into the following date:

  • by and between 

  • and the Northeast Area Health Education Center (NE KY AHEC).

  • I. While the two organizations agree to work together, final authority for all areas relating to the appropriate Accreditation Standards for Continuing Education will be retained by the NE KY AHEC. Areas in which the NE KY AHEC retains final authority include:

    • Final selection of the activity title,
    • Final approval of all activity announcement literature,
    • Final approval of all materials distributed in conjunction with the continuing education activity,
    • Final approval of the activity schedule and amount of credit to be awarded,
    • Final approval of the process for determining the basis upon which credit will be awarded,
    • Final approval of faculty,
    • Final approval of activity content and activity type,
    • Final approval of learning assessment activity, and
    • Final approval of the activity evaluation form.
  • II. Additionally, the NE KY AHEC will:

    • Maintain all records for a minimum of 7 years,
    • Issue statements of credit as needed,
    • Mitigate all grievances which are submitted in writing,
    • Ensure that the Standards for Commercial Support requirements are met
      (financial relationship disclosures, resolution of conflict of interest, commercial support and financial disclosure to participants, etc.),
    • Conduct an assessment of the educational needs of the targeted audience
    • Provide guidance to faculty (to include the nature of the target audience, teaching methodology, development and use of instructional materials and learning assessments, and the development of appropriate objectives),
    • Review and approve all materials and information (including audio-visual aids and educational materials) so as to assure that the activity provides an in-depthpresentation with fair balance and full disclosure, and 
    • Summarize feedback for learners and faculty through activity evaluation forms.
  • III. The cosponsoring organization agrees to:

    • Remit payment of $________ to the NE KY AHEC in recognition of the work done.
    • Cooperate with the NE KY AHEC and will, in all areas which relate to the Continuing Education Standards, follow the directions given to them by the provider.
    • Obtain a written authorization from the NE KY AHEC Continuing Education Coordinator prior to printing/final preparation of audiovisual aids.
    • Obtain a written authorization from the NE KY AHEC Continuing Education Coordinator prior to printing of educational materials.
    • Submit proper documentation to the NE KY AHEC in a timely manner, as outlined in the Co-Sponsorship policies of the NE KY AHEC.
  • IV. This letter of Agreement shall remain in full force and effect for one calendar year
    (12 months) from the date of signature of both parties unless terminated by mutual agreement.

  • V. In the event that the cosponsoring organization fails to comply with the requirements stated within this Letter of Agreement, the provider has the option to decline to provide continuing education credit to participants and/or withhold payment as defined in the fee terms.

  • VI. Any or all disputes that may arise under the terms of this Letter of Agreement shall be mitigated by the designated agents of the agreeing parties.
