I recognize that it is my responsibility to notify my teacher of any serious illness or injury before every class. I will not perform any movements to the extent of strain or pain.     Release, Waiver and Indemnity Agreement For Participants, Visitors and Volunteers


    The undersigned (hereinafter referred to as "Participant"), being of legal age or signing in conjunction with a parent or legal guardian if not of legal age, desires to enter upon the premises known as “Erin Nes Therapy and Coaching, Equibliss Psychotherapy and Sapphire Woods Stables”, and/or to use or come into contact with horses and/or facilities either owned or controlled by Erin Nes by and/or to receive training, instruction, coaching or counseling from Erin Nes/ Equine Soul Coaching, and being fully aware of the risk of injury and dangers inherent in entering upon said premises and/or the handling or riding of horses, hereby elects voluntarily to enter upon said premises and/or to participate in said activities, and does hereby willingly enter into this Release, Waiver & Indemnity Agreement. 


    THEREFORE, IN CONSIDERATION OF BEING PERMITTED TO ENTER UPON THE PREMISES AND/OR TO USE OR COME INTO CONTACT WITH HORSES OWNED OR CONTROLLED BY Erin Nes Therapy and Coaching, Equibliss Psychotherapy and Sapphire Woods Stables AND/OR TO RECEIVE TRAINING, INSTRUCTION, COACHING OR COUNSELING FROM Erin Nes, PARTICIPANT KNOWINGLY AND EXPRESSLY WAIVES PARTICIPANT’S RIGHTS TO SUE Erin Nes Therapy and Coaching, Equibliss Psychotherapy and Sapphire Woods Stables, THEIR MEMBERS, MANAGERS, EMPLOYEES, AGENTS, SUCCESSORS, HEIRS, AND ASSIGNS, FOR ANY INJURY, DEATH, LOSS, OR DAMAGE CAUSED TO PARTICIPANT OR TO PARTICIPANT’S PROPERTY, AND PARTICIPANT AGREES TO ASSUME ALL RISKS INHERENT IN COMING IN CONTACT WITH HORSES, WHETHER MOUNTED OR NOT, INCLUDING, WITHOUT LIMITATION, THE RISKS OF INJURY, DEATH, LOSS, OR DAMAGE TO PARTICIPANT OR TO PARTICIPANT'S PROPERTY. PARTICIPANT ACKNOWLEDGES THAT PARTICIPANT HAS BEEN GIVEN NOTICE OF THE RISKS INHERENT IN AND INSTRINSIC DANGERS OF EQUINE ACTIVITIES, INCLUDING (i) THE PROPENSITY OF AN EQUINE TO BEHAVE IN DANGEROUS WAYS WHICH MAY RESULT IN INJURY, HARM, OR DEATH TO PERSONS ON OR AROUND THEM; (ii) THE UNPREDICTABILITY OF AN EQUINE'S REACTION TO SUCH THINGS AS SOUNDS, SUDDEN MOVEMENT, UNFAMILIAR OBJECTS, PERSONS, OR OTHER ANIMALS; (iii) CERTAIN HAZARDS SUCH AS SURFACE AND SUBSURFACE CONDITIONS; (iv) COLLISIONS WITH OTHER ANIMALS OR OBJECTS; AND (v) THE POTENTIAL OF A PARTICIPANT ACTING IN A NEGLIGENT MANNER THAT MAY CONTRIBUTE TO INJURY TO THE PARTICIPANT OR OTHERS, SUCH AS FAILING TO MAINTAIN CONTROL OVER THE EQUINE OR NOT ACTING WITHIN THE PARTICIPANT’S ABILITY, AND PARTICIPANT EXPRESSLY AGREES TO ASSUME ALL SUCH RISKS AND WAIVES ALL RIGHTS TO SUE FOR INJURIES CAUSED BY SUCH RISKS. THIS WAIVER AND EXPRESS ASSUMPTION OF RISKS SHALL SPECIFICALLY APPLY TO PARTICIPANT AND TO ANY AND ALL MINOR CHILDREN AND/OR WARDS OF PARTICIPANT, IN ACCORDANCE WITH THE TERMS OF VA. CODE ANN. §3.1-796.132B, AND SHALL BE CONSTRUED TO COMPLY WITH ALL EXCULPATORY TERMS OF THE VIRGINIA EQUINE ACTIVITY LIABILITY ACT, VA. CODE ANN. §§3.1-796.130 et seq. (Chapter 27.5, Code of Va. (1950)). 

     

    IF PARTICIPANT IS A MINOR OR OTHERWISE UNDER A LEGAL DISABILITY, THIS AGREEMENT SHALL BE SIGNED BY PARTICIPANT’S PARENT OR LEGAL GUARDIAN. BY SIGNING, THE PARENT OR LEGAL GUARDIAN AGREES (i) TO WAIVE THE PARENT'S, GUARDIAN'S, AND PARTICIPANT'S RIGHTS TO SUE THE PARTIES NAMED IN THE FIRST PARAGRAPH; (ii) TO ASSUME, ON BEHALF OF THE PARENT, GUARDIAN, AND PARAGRAPH; (ii) TO ASSUME, ON BEHALF OF THE PARENT, GUARDIAN, AND PARTICIPANT, THE RISKS SET FORTH IN THE IMMEDIATELY PRECEDING PARAGRAPH, IN ADDITION TO ALL OTHER RISKS OF COMING INTO CONTACT WITH HORSES; AND (iii) TO INDEMNIFY AND HOLD HARMLESS Erin Nes Therapy and Coaching, Equibliss Psychotherapy and Sapphire Woods Stables , THEIR MEMBERS, MANAGERS, EMPLOYEES, AGENTS, SUCCESSORS, HEIRS, AND ASSIGNS FROM ANY LOSS, CLAIM, SUIT, OR JUDGMENT RESULTING FROM ANY INJURY, DEATH, LOSS OR DAMAGE SUSTAINED OR CLAIMED BY PARTICIPANT (OR PARTICIPANT'S PERSONAL REPRESENTATIVE), AND FURTHER TO INDEMNIFY Erin Nes Therapy and Coaching, Equibliss Psychotherapy and Sapphire Woods Stables, THEIR MEMBERS, MANAGERS, EMPLOYEES, AGENTS, SUCCESSORS, HEIRS, AND ASSIGNS FROM ANY AND ALL COSTS OF DEFENDING SUCH CLAIMS, INCLUDING ATTORNEYS' FEES. 


    It is expressly agreed by Participant and any parent or guardian whose signature appears on this document that this Release, Waiver & Indemnity Agreement shall be governed and construed as being sufficient to satisfy the assumption of risk and waiver requirements necessary to relieve equine activity sponsors and equine professionals from liability under the Virginia Equine Activity Liability Act, and that Erin Nes is covered by the provisions of that Act. This Release, Waiver & Indemnity Agreement shall be governed and construed by the laws of the Commonwealth of Virginia, regardless of where any injury or loss shall occur. In the event that any portion of this Release, Waiver & Indemnity Agreement shall be declared unenforceable, such declaration shall not affect the remaining terms of this document, which shall survive intact. 


    Participant has been advised to wear closed toe footwear at all times while coming in contact with horses, and to wear protective headgear at all times while riding, and expressly assumes the risk of injury resulting from failure to do so and/or from selecting headgear or footwear which does not adequately protect against injury. Participant has been provided a copy of the Barn Rules.

    Procedures for Reopening of Equine Facilitated Psychotherapy and Related Equine Activities

    I highly value your well-being and your desire to be involved with the horses through equine facilitated psychotherapy. In an informed attempt to prioritize the health and well-being of my clients, volunteers, and our community, as coronavirus impacts our daily lives, I want to assure you that I remain committed to providing the quality of care you deserve.  


    You can choose to return to face to face sessions, or to continue our weekly tele mental health sessions for as long as you deem necessary.


    We at Erin Nes Therapy and Coaching, Equibliss Psychotherapy and Sapphire Woods Stables are using a combination of physical distancing, cleaning and sanitizing schedules to reduce the risk of COVID-19 transmission.  However, it should be noted that no mitigation steps will eliminate the risk completely. 


    Prior to returning to Erin Nes Therapy and Coaching, Equibliss Psychotherapy and Sapphire Woods Stables for equine facilitated psychotherapy sessions, a Waiver of Liability Relating to COVID-19 and Infectious Diseases must be signed by all clients/ participants and volunteers. Please note that:


    All clients/ participants MUST cancel their participation in equine and equine facilitated psychotherapy activities if: 


     You have symptoms of COVID-19 (fever of 100.4F or greater in the past 3 days, cough, sneezing, sore throat, headache, shortness of breath or difficulty breathing) or have been in close contact with someone who has symptoms. 
     You know you have been exposed to COVID-19 or have been in close contact with someone who has been exposed. 
     You have recently traveled to any high exposure area listed by the CDC or have been in close contact with someone who has traveled there, or you have tested positive for COVID-19. 

    If you are sick with COVID-19 or think you might have COVID-19, please contact me right away to take additional preventative measures.


    Erin Nes will regularly monitor national and local conditions and immediately take steps to limit and mitigate any rebounds or outbreaks in accordance with the Virginia governor’s guidance. I reserve the right to restart or pause our activities depending on the news and conditions of COVID-19.


    These are unprecedented times, and the well-being and safety of everyone are my top priorities. 

     


    Mitigation procedures are reevaluated as needed and amended as often as needed.

    ALL clients/participants are required to wear face masks.
    There will be a hand-washing stations with soap available for use. Staff, and clients will be required to wash their hands with soap and water for 20 seconds (in accordance with CDC guidelines) upon arrival and departure. 
    A modified schedule of clients will be put in place with abundant time in-between sessions for cleaning of equipment and to ensure no overlapping of clients/participants.  
    Physical Distancing: All staff, volunteers, and clients MUST keep six feet (6’) from others at all times.
    Equipment: Brushes, tack and areas in contact with clients will be cleaned and/or sanitized AFTER EACH SESSION. 
    Arena gates will be cleaned after EVERY client session. 
    Cleaning Supplies will be made abundantly available to staff, volunteers, and clients and placed around the farm for ease of accessibility.
    The restroom (in the Club House) will be well stocked with sanitizing wipes, hand sanitizer, and disinfectant spray bottles. Instructions will be posted for proper sanitation before and after each use. 
    Maximum Capacity: No more than 2 people are allowed in the activity areas at one time. This includes staff, volunteers and clients. Family members and caretakers must stay in their vehicle or bring their own seating if they would like to sit outside and watch; if the latter, they must maintain Virginia's 6 foot social distancing guidelines. 

    Property Limitations 
    The Tack Room and Feed Room are STAFF ONLY. 

     


    Assumption of Risk, Policy Adherence and Waiver of Liability Relating to Infectious Diseases


    The novel coronavirus, COVID-19, has been declared a worldwide pandemic by the World Health Organization. COVID-19 is extremely contagious and is believed to spread mainly from person-to-person contact. 


    Erin Nes, representing Erin Nes Therapy and Coaching, Equibliss Psychotherapy and Sapphire Woods Stables have put in place preventative measures to reduce the spread of COVID-19; however, we cannot guarantee that our participants and volunteers will not become infected with COVID-19. Please be advised that there are inherent risks when participating in equine-assisted activities and therapies such as: 

    • Horses’ coats, nylon equipment (lead ropes) and leather equipment (such as reins and saddle) cannot be completely disinfected. 

    There are also some issues that may INCREASE your inherent risk of infection such as: 

    • Underlying medical condition (such as immunocompromised conditions) or age over 60. 
    • Struggle to maintain physical distancing. 
    • Unable to comply with wearing a mask or hand washing guidelines. 

    By signing this agreement, I acknowledge the risks associated with COVID-19 and assume this risk voluntarily (or my child if under 18) that by attending equine related activities at Erin Nes Therapy and Coaching, Equibliss Psychotherapy and Sapphire Woods Stables I may be at risk for increased exposure that may result in personal injury, illness or death.


    I have read and agree to adhere to Erin Nes Therapy and Coaching, Equibliss Psychotherapy and Sapphire Woods Stables Procedures, including the New Sick Policy and Mitigation Measures to help stop the spread of COVID-19. 


    I understand that if I do not abide by Erin Nes Therapy and Coaching, Equibliss Psychotherapy and Sapphire Woods Stables’ Procedures and Safety Precautions, including the new Sick Policy and Mitigation Measures, Erin Nes can deny participation in further activities.
