    This Agreement is between Inspirada Community Association, hereinafter known as "ICA" and:

              • In consideration for the use of the premises, the Renter agrees to abide by the following Terms and Conditions:

                Eligibility. Renter must be in good standing with the Association, and by executing the contract, agrees to rent the Association facilities in accordance with the policies, rules, and regulations adopted by the Inspirada Community Association Board of Directors.

                Facility Use. Inspirada Rules and Regulations apply at all times when using the Solista Community Center, Event Garden, and Pavilion areas. The Renter is contracting for the exclusive use of certain rooms specified in this Agreement for the times specified in this Agreement and for the non-exclusive use of adjoining restrooms. The unreserved areas of the Community Center remain open for the use and enjoyment of the Association members.

                Association staff or vendors will be on-site to perform a walk-through of the area prior to set up in the rental area and immediately following the conclusion of the rental. The purpose of the walk-through is to identify any cleaning and damage issues within the rental space. Otherwise, no Association staff or vendors are available to the Renter to assist with the event.

                The facility is available for rental Monday through Friday, 5:00 p.m. to 9:00 p.m., and Saturday and Sunday from 9:00 a.m. to 9:00 p.m. The Solista Community Center is not available for commercial use. The Renter who has signed the rental agreement must be on-site during all hours of the rental time.

                Parking. The Community Center has street parking available.

                Rental Time - Rental Fees. The rental time refers to the hours requested by the Renter and must be specified on the reservation contract at the time of execution. The time of the reservation begins when the Renter enters the building to begin set-up, and until the final individual departs after clean-up. Hours needed for set-up and clean-up must be included in the rental time.

                Any rental furnishings/equipment may not be left behind for pick up at a later date or time. If an event exceeds the rental time agreed to in the contract, any hour or portion thereof in excess of the agreed-upon time shall be charged at 1.5 times the hourly rate. 

                Resident Rate.    
                Hourly Rate $15 per hr/2 hr minimum  
                Security/Cleaning Deposit $200 refundable after event  

                Resident Rate – For private events for residents in good standing with the Association. This rate includes non-profit organization events.

                Pools. *NO POOL PARTIES ARE ALLOWED. The rental of the Community Center does not grant guests access to the pool. Therefore, the Community Center may not be rented out for pool parties or in conjunction with any type of gathering at, or involving the pool facility. Solista Village pools are for the exclusive use of Inspirada residents and their invited guests as stated in the pool rules, and therefore are not available for private use by any group or individual.

                Park Use. The Solista Event Garden and Pavilion area are available on a first-come, first-served basis unless the Inspirada Community Association has an event scheduled. While the Event Garden and Pavilion are first-come-first-serve, parties or gatherings larger than 25 attendees are not allowed. Minimal decorations are allowed and cannot include staking of any kind, or impeded upon the public right-of-way (i.e. sidewalks, entrance/access points, etc.) 

                Usage of the Event Garden and Pavilion shall follow the same rules as an official reservation. Courtesy Patrol will conduct an inspection report at the beginning and end of each event. Failure to cooperate with the inspection protocols may result in the party being asked to leave the premises.

                The areas must be left clean; all trash and decorations removed. Residents or the event organizer will be responsible for any damage.

                Noise must be kept to a minimum to not disturb others. DJ’s or loud stereo systems are NOT allowed.

                The Association will not provide any additional resources; tables, chairs, etc. to events in the Event Garden or Pavilion (areas used on a first-come-first-serve basis).  

                The Association/Courtesy Patrol reserves the right to ask parties to leave the premises if any of the rules/guidelines are violated in any manner.

                Signage. A limited amount of directional signage may be placed at pre-approved locations inside and outside the facility. Renter must submit a directional signage proposal for preferred locations to the Association no less than ten (10) business days prior to the event. The Association shall have the right, in its sole discretion, to determine the final wording, location, and method of sign placement, and the Renter shall be responsible for producing and placing the signs.

              • Furnishings. The facility is provided with a standard of furnishings established by the Association Board of Directors. The Renter is encouraged to review the current furnishings in the space. Furniture, equipment and supplies that are the property of the Association shall not be moved and/or removed from the facility by the rental party. Per the renter’s request, which is required during the application process, the tables and chairs only may be moved. The renter must submit a diagram showing the requested furniture arrangement no less than ten (10) business days prior to the event. The furniture on the carpet; the sofas, side tables, side chairs, are not allowed to be moved. The requested tables and chairs may be arranged by the Renter.

                Renters, Committees, clubs, or groups desiring to have a specific furniture setup for an event, meetings, or activities should file a room set-up plan with the Association staff no later than ten (10) business days in advance of the event.

                In addition, all tabletops must be covered prior to use. Standard furnishings include 3 tables (4'x2.5') with 10 chairs, a sofa, credenza, wall-mounted television, 6 armchairs, and 3 end tables. *Subject to change without notice.

                The Renter is responsible for setting up any requested tables or chairs. Tables and chairs to be provided pursuant to this Agreement are those owned and used by the Association for such purposes. Tables and chairs are being provided "as is" and "with all faults." Available tables and chairs may be selected in the payments section of this agreement. Renters are allowed to provide their own tables and chairs.

                If additional furnishings or equipment are to be delivered to the site, the Renter should make arrangements to accept delivery of these items as well as supervise their subsequent pick-up. The Association accepts no responsibility for delivery/pick-up and does not have space to store items prior to or following the scheduled event. Please arrange for delivery/pick-up during the scheduled rental time.

                Food and Beverage. Food must be either pre-packaged or pre-made (i.e. sandwich trays, takeout, delivered, or catered). Renters may also use a licensed caterer of their choice. Please inform your caterer that the kitchen is for serving only and the Association provides no additional supplies or equipment. Renters are responsible for providing a copy of all required licenses to the Association no less than ten (10) business days prior to the event.

                Alcoholic Beverages. Alcohol may only be provided, sold, and served by a licensed bartender, caterer, or individual with a valid liquor license, all of whom must provide the Association with a copy of the license, along with a certificate of insurance.

                *The Association assumes no responsibility for the consumption of alcohol; however, should any minors be found in possession of alcohol, the Association reserves the right to immediately terminate the event with no refund of security deposit or fees.

                Renters are responsible for providing a copy of all applicable licenses and Certificates of Insurance to the ICA no less than ten (10) business days prior to the event. ICA assumes no responsibility for the consumption of alcohol; however, should any minors be found in possession of alcohol, ICA reserves the right to immediately terminate the event with no refund of security deposit or fees.

              • Decorating. Renter may decorate the facility at his/her expense. Decorations may not be attached to the walls, doors, windows, ceilings, or light fixtures. Open flames, including but not limited to, lit candles, chafing dish warmers, tiki torches, and pyrotechnics are not permitted inside or outside the Solista Community Center. The Association reserves the right to limit or prohibit decorations or props that could, in the Association’s sole discretion, unreasonably increase the electrical load.

                Music/Entertainment. Renter may arrange for entertainment at his/her expense; however, additional power sources that could increase the electrical load cannot be used. The Association has the right to determine the appropriate volume of music.

                Utilities. Renter acknowledges that the Association cannot guarantee an uninterrupted supply of electricity, water, heat, air conditioning, or other utilities and that the renter will hold harmless the Association from any claim of damage arising from the loss of a utility. The Association will be diligent in restoring any interrupted utility where it is within its power to do so.

                Clean-up. Renter is required to return the facility back to the original state following the conclusion of the event. The Association will provide trash cans with one liner for each. Additional liners must be provided by the Renter. Before leaving the premises, the Renter shall remove all garbage, leftover food, decorations, or other materials brought into the facility. All garbage shall be deposited in the commercial dumpster located outside the facility. In the event that the Renter has not cleaned the area properly, additional clean-up shall be charged at the rate of $50 per staff hour and will be withheld from the security deposit. In addition, should the carpet require professional cleaning after an event, the cost of that service will be deducted from the security deposit.

                Damage To Facility. Renter agrees to pay the cost of restoration for any damage to the facility that occurs as a result of the rental. The Association shall in its sole discretion and authority determine the appropriate level of restoration.

                Security/Cleaning Deposit. A security/cleaning deposit is collected at the time this Agreement is signed by all parties. This deposit shall be returned in full approximately forty-five (45) days after the conclusion of the event provided that the premises is left in its original condition and no additional charges are incurred. The deposit refund will be made out to the Renter named on the rental contract. The Association may apply the security/cleaning deposit to offset any additional fees or damages payable by the renter to the Association pursuant to this Agreement. Should there be damages or additional charges, the security deposit may be held until such time as restoration is complete and/or all additional charges have been tabulated. If Renter is an Inspirada property owner, Renter acknowledges and agrees that additional costs above the amount collected in the security/cleaning deposit may be added to the homeowner's account and become due and payable as if such charge were an assessment. If Renter is not an Inspirada property owner, Renter acknowledges and agrees that any expenses incurred in collecting funds from Renter cost not covered by the security deposit, including but not limited to, attorney's fees and court fees, shall be the responsibility of the Renter.

                Payment. Signed contracts and payments must be submitted to the Association no less than ten (10) business days prior to the event. Payment may be made by personal check, cashier’s check, or money order, made payable to Inspirada Community Association or ICA.

                Cancellation and Termination. The Association reserves the right to terminate this Agreement without prior notice and without refund of deposit if, in its opinion, the renter has, in the application, provided false or misleading information, has defaulted in providing anything required by the Agreement, or is in breach of any term or condition of this Agreement. The Renter may cancel this Agreement upon giving written notice to the Association and will receive a refund of deposits on the following schedule:

                30 calendar days or more - 100% of all funds deposited  
                29 - 8 calendar days - 75% of all funds deposited  
                7 calendar days or less - 0% of room rental but 100% of all other funds.  

                Upon failure to make any payment in a timely manner, the Association shall be entitled to thereupon immediately terminate this Agreement and have no further obligation to the Renter hereunder. The Association shall not be liable to the renter for any damages resulting from its cancellation of any event scheduled hereunder.

              • Hold Harmless. The Association does not assume any responsibility for property lost or stolen from the premises or for personal injuries sustained on the premises during the Renter's use of the premises and the Renter hereby agrees to indemnify and hold harmless the Association, its officers, directors and employees from any and all losses, costs, claims, demands, damages, expenses, or liabilities of any kind, including attorney's fees, resulting from injury to or death sustained by any person or damage to property of any kind that arises out of or is in any way related to the event held by the Renter on the Association's premises. Renter further agrees to indemnify and hold harmless the Association, its officers, directors and employees from any and all losses, costs, claims, demands, damages, expenses, or liabilities or any kind, including attorney's fees, resulting from any default by Renter of any of its obligations arising under this Agreement.

                Insurance. Non-Resident and Commercial Renters, as defined in the Inspirada Community Association Board policy, shall provide to the Association no less than ten (10) business days prior to the event a certificate of liability insurance with a minimum coverage of $1,000,000.00 for each person/occurrence naming Inspirada Community Association as an additional insured.

                Applicable Law. Renter agrees to abide by all applicable federal, state and local laws including, but not limited to, payment of taxes and room capacity limits. This Agreement shall be interpreted in accordance with the laws of the State of Nevada.

                Attorney’s Fees. In the event that any action is brought by any party to enforce its rights hereunder, the prevailing party in such action shall be entitled to recover from the non-prevailing party its attorney's fees and court costs, as determined by a Court and not the jury.
