This agreement is entered into between Door into Summer Photo Studio Ltd. (hereinafter referred to as "Photographer"), located at 1619 S Main St, Milpitas, CA 93035, Office #108, and the Client identified by the aforementioned name and address (hereinafter referred to as "Client")

1. Services and payment terms.

 Outlined below are the services provided by Door into Summer Photo Studio Ltd. alongside their respective pricing. The Client has selected their desired service type from the dropdown above, and the Client agrees with these terms.

The session fee is due upon booking.

1.1. Mini-session.

The mini-session fee is $490 and includes the following:

~ 15 min phone consultation

~ 30 min time of professionally styled photography (limited with mini session framework)

~ Access to the studio, Client wardrobe, and baby props collection

~ Ordering appointment immediately after the session.

~ 3 images included

~ additional image is 190, buy-2-get-1 free.

 

1.2. Christmas and other Limited edition Mini-sessions

The mini-session fee is $590 and includes the following:

~ 15 min phone consultation

~ 20 min time of professionally styled photography (limited with mini session framework)

~ Access to the studio, Client wardrobe, and baby props collection

~ Ordering appointment immediately after the session.

~ 3 images included

~ additional image is 190, buy-2-get-1 free.

 

1.3. Custom session.

The custom session fee is $1490 and includes the following:

~ Pre-session styling consultation

~ 1.5 - 3 hrs time of professionally styled photography

~ Access to the studio, Client wardrobe, and baby props collection

~ Access to premium accessories collection

~ Professional HMUA service for 1 person

~ 1 ordering 30-90 min ordering appointment.

~ $1000 credit towards the ordering appointment.

 

1.4. Premium session.

The premium session fee is $3690 and includes the following:

~ Pre-session styling consultation

~ 3-5 hrs time of professionally styled photography

~ Access to the studio, Client wardrobe, and baby props collection

~ Access to a premium accessories collection

~ Professional HMUA service for 1 person

~ 1 ordering 30-90 min ordering appointment.

~ $3000 credit towards the ordering appointment

 

1.5. Ultimate session.

The ultimate session fee is $7500 and includes the following:

~ Pre-session styling consultation

~ Full day (up to 10 hrs) hrs time of professionally styled photography

~ Access to the studio, Client wardrobe, and baby props collection

~ Access to a premium accessories collection

~ Professional HMUA service for 1-2 people

~ 1 ordering 30-90 min ordering appointment.

~ $5000 credit towards the ordering appointment

 

1.6. Event

The event photography fee is $350/hr (2 hrs minimum order) and includes the following:

~ 15 min phone consultation

~ time of professionally styled photography (limited with mini session framework)

~ Light and professional equipment 

~ 50 images per hour, edited in our signature event style. 

 

2. Ordering appointment

The images and products are reviewed and selected with the Client and Photographer at the ordering appointment. The ordering appointment is scheduled within 7 working days after the session. The photographer reserves the right to postpone the ordering appointment due to personal circumstances. 

The first ordering appointment is complimentary and includes a 30-90 min meeting with the photographer. 

The balance for the digitals and products is due on the ordering appointment date. All ordering appointments are in-person only in the studio or via software. 

If the Client requests an additional ordering appointment, it is subject to a $250 fee. Rescheduling the ordering appointment for any reason less than 48 hrs beforehand results in a new ordering appointment and is subject to a $250 fee. 

All purchases, made during the ordering appointment, are final and are not subject to refund. 

3. Payment methods

Preferred payment methods include:

• Credit card, the 3,5% commission is paid by Client
• Cash or check (Eugeniya Pasterskaya, photography services), no commission applied
• Wells Fargo transfer (Account number 7046311820, routing number for wire transfers 121000248), no commission applied
• Zelle transfer(+1(408) 707-7632, yourhappyphotos@gmail.com)
• Paypal (yourhappyphotos@gmail.com), the commission is paid by the Client
• Venmo (+1(408) 707-7632)
   

4. Rescheduling and cancellation policy

Upon signature, the Photographer reserves the time and date agreed upon and will not make other reservations for that time and date. Therefore, the session fee is non-refundable.

• If the client wishes to reschedule the session more than 48 hours before the scheduled time, the Photographer will make a reasonable effort to accommodate the request at no additional charge.
• Rescheduling requests made less than 48 hours before the scheduled session will incur a rescheduling fee of $250.
• In the event of a cancellation less than 48 hours before the scheduled session, the session fee is non-refundable.
• If the client fails to appear for the photo shoot or arrives more than 30 minutes late, the Photographer reserves the right to adjust the duration of the session and the quantity of images produced based on the remaining time.
• If the client is more than 30 minutes late or fails to appear for the session entirely, the Photographer reserves the right to cancel the session, and the session fee is non-refundable.
• Clients are allowed a maximum of 2 rescheduling attempts. After 2 reschedulings, the Photographer reserves the right to cancel the session, and the session fee is non-refundable.

5. Reshoot policy

If a reshoot is requested due to artistic preferences of the Client, the following fees are applied:

• Mini session $490,
• Limited edition Mini session $590,
• Custom session $290
• Premiums session $690
• Ultimate session FREE

The credit towards the ordering appointment is retained from the previous session (except for the mini session), specifically:

• Custom session $1000
• Premiums session $3000
• Ultimate session $5000

6. Editing policy

All photo retouch is completed in accordance with Photographer’s portfolio and is subject to the creativity of the photographer and her personal artistic editing style.

At Door into summer photo studio, retouching services are tailored to the session type. The following levels of service are available:

6.1. Event Retouch

The service includes the following services:

• Color Correction: Ensuring accurate color representation and overall image consistency.
• Exposure Adjustment: Balancing brightness and contrast for optimal image quality.
• Crop and Straightening: Cropping and aligning images for better composition.
• Sharpening: Enhancing image sharpness for clarity.
• Noise Reduction: Minimizing digital noise in low-light or high-ISO images.

The revision service is not included in event retouching. 

If requested, the service is subject to $10 per image fee for event retouch and a $50 per image fee for standard retouch. Additionally, if further meetings with the Photographer are requested, they are subject to a fee of $100 per hour.

 6.2. Mini session retouch

• Hair Retouching: enhancing hair appearance and style, removing flyaway hair.
• Facial Countoring: refining facial features and contours.
• Teeth Whitening
• Basic Clothing Adjustment: adjusting small wrinkles or folds in clothing for a polished look.

The revision service is not included in mini-session retouching. If further adjustments are requested, the service is subject to a fee of $50 per image. Additionally, if further meetings with the Photographer are requested, they are subject to a fee of $100 per hour.

6.3. Standard retouch

• All Event Retouch Services
• Basic Object Removal
• Advanced Skin Enhancing 
• Body Contouring: adjusting body proportions for a more flattering look.
• Hair Retouching: enhancing hair appearance and style, removing flyaway hair.
• Facial Countoring: refining facial features and contours.
• Teeth Whitening
• Basic Clothing Adjustment: adjusting small wrinkles or folds in clothing for a polished look.
• Face swap (under 6 parts)
• Background texture enhancement 
• Composite shots
• Artistic effects at the Photographer's discretion.

The standard retouch is offered for custom, premium, and ultimate sessions for all images, that are not included in wall art order. 

Revision service includes up to 60-minute meetings with the Photographer, whether in person or via software. If further adjustments are requested, the service is subject to a fee of $50 per image. Additionally, if further meetings with the Photographer are requested, they are subject to a fee of $100 per hour.

6.4. Wall art retouch

• All Standard Retouch Services
• Custom Skin and facial features enhancing
• Custom body contouring 
• Makeup change or re-editing 
• Teeth alignment, small teeth details adjustment 
• Pupils and iris alignment
• Detailed Clothing Adjustment
• Extended family (more than 8 people) and corporate group advanced composite images 
• Multiple image part replacement (over 6 parts)
• Advanced artistic effects at the Photographer's discretion.
• Hand painterly effects

Wall art retouching is offered at no charge for every image purchased as wall art. Unlimited revisions are included. 

If the wall art retouch is requested for a digital image (not ordered as wall art), it's subject to a $100/image charge.

The photographer reserves the right to refuse the Client's request for changes if it is determined that such changes would compromise the image quality or deviate from the photographer's artistic vision.

7. Delivery terms

If the delivery date is not specified by the Client, the final edited digital images will be delivered within 15 calendar days after the ordering appointment.

After delivery of the images, it is the Client's responsibility to approve them for printing. The final products will not be sent for printing until the Client's approval is obtained.

Once the Client approves the final editing of the images, products will be delivered within 1 calendar month.

If re-editing is requested, the re-edited digital images will be delivered within 15 calendar days after the request is made. Upon receipt, it is the Client's responsibility to approve them for printing.

The Photographer is not responsible for any product delivery delays caused by approval delays on the Client's side.

8. The Client shall assist and cooperate with the Photographer in obtaining the desired photographs, including but not limited to specifying persons and/or scenes to be photographed; and taking time to pose for photographs at the Photographer’s direction.

The Photographer shall not be responsible for photographs not taken as a result of the Client’s failure to provide reasonable assistance or cooperation.

The Photographer shall not be responsible for photographs not taken as a result of the Client’s failure to arrive on time.

 

9. The client understands that photography and editing by nature is an art, subject to the creativity of the photographer and her personal artistic style. The client understands that he/she has chosen the photographer because of her photographic style, and will grant the photographer the right to exercise her creativity in the interest of creating the best images possible. If a reshoot is requested due to artistic preferences of the Client, following fees are applied in accordance to Paragraph 5. 

Photographer will make a good faith effort to achieve the Client's desired results. However, photography is a subjective art form, and children are unpredictable and may experience behavioral or attention-related problems during the Session. The Photographer is not responsible for undesired child mannerisms including, but not limited to, type of smile, crying, shyness, grumpy, non-cooperation, or refusal to take photos.

Client acknowledges that If the Client, Client’s parents, guests, or Client's child does not or cannot cooperate during the session, Client is still responsible for full payment under this Agreement.

 

10. The Client understands that all the children under the age of 18 have to be supervised by the Client at all times. 

The Client is financially responsible for any damage, caused by kids in the studio, including photography and studio equipment, studio props, furniture or any other Photographer's property. 

11. In the event of an unforeseen medical emergency in which the photographer can not perform the Photoshoot, the photographer will make a reasonable effort to reschedule the photoshoot for another day or refund.

12. If the photographer cannot perform this agreement in whole or in part due to a fire or other casualty, acts of God or nature or terror, or other cause beyond the control of the parties or due to the photographer's illness or injury, then the photographer will refund all fees to the Client(s) but shall have no further liability with respect to this agreement.

In the event that photographic materials are damaged in processing, lost through camera malfunction, lost equipment, stolen, or otherwise lost or damaged without fault on the part of the photographer, the photographer agrees to reschedule another session at no extra fee to do a reshoot.

13. The Photographer retains copyright in the photographs and hereby grants the Client unlimited but non-exclusive rights to use or reproduce the photographs for which the Client pays.

14. The Client agrees not to alter delivered images, publish / print only original images provided by Photographer, and do not publish/print altered images, specifically including, but not limited to, Instagram filters, crops, and all other software adjustments and alterations without Photographer’s written permission.

15. Copying, snapshotting or saving images from the Client's ordering appointment is strongly prohibited. If the Client copies, snapshots or saves images via any method listed above, or any other method, the Client will be invoiced for the cost of EACH digital image, at the photographer’s current price per digital file. 

I have read and understood this agreement, including the terms and conditions, and agree to be bound to them.

 I am the parent or legal guardian of any minor(s) named above and have the legal right and authority to execute the model release stipulations named in this contract on behalf of the minor. *

Evgeniya Pasterskaya and Door into summer photo studio permission to use and publish the images taken in the session for any lawful purpose, including for example for such purposes, as an illustration, advertising, and web content as examples for her portfolio.

I am the parent or legal guardian of any minor(s) named above and have the legal right and authority to execute the model release stipulations named in this contract on behalf of the minor. 

Door into summer photo studio by Eugeniya Pasterskaya the right to take photographs of me, my family, and my property in connection with the above-identified subject. 

 

Door into summer photo studio by Eugeniya Pasterskaya the right to copyright, use, and publish the same photographs and media containing photographs in print and/or electronically.

Eugeniya Pasterskaya and Door into summer photo studio retains the copyright on all images and reserves the right to use the images for advertising, display, publication, social media, and/or other purposes for our portfolio.

Digital files and previews remain the exclusive property of Door into summer photo studio by Eugeniya Pasterskaya.

Under no circumstances, can a client use these images for profit, commercial endeavors, professional display, or in competition.

SHARING images and links on the web from its main source are highly acceptable and encouraged to show family and friends your beautiful images.   

I have read and understood this agreement, including the terms and conditions, and agree to be bound to them.
