VOLUNTEER AGREEMENT
Northern California Weimaraner Rescue is dedicated to rescuing and improving the lives of Weimaraners through adoption, fostering, education, fundraising and other means. In my capacity as a NCWR volunteer I agree to the following:
1. Policies and Procedures. I agree to abide by the policies and procedures communicated to me during the course of my volunteer activities. I understand that I am responsible for reviewing all the materials given to me . I understand and agree these policies are in place to protect me, and Northern California Weimaraner Rescue (hereinafter NCWR).
2. Waiver and Release. I hereby release and forever discharge and hold harmless NCWR and its successors and assigns, affiliates and adoption partners from any and all liability, claims, and demands of whatever kind or nature, either in law or in equity, which may arise from volunteer work with NCWR. I understand and acknowledge that this Waiver discharges the NCWR from any liability or claim that I may have against NCWR with respect to bodily injury, personal injury, illness, death, or property damage that may result from my participation in NCWR’s volunteer programs. I also understand that NCWR does not assume any responsibility for or obligation to provide financial assistance or other assistance, including but not limited to medical, health or disability insurance, in the event of injury, illness, death or property damage.
3. Health Insurance. I expressly waive any claim for compensation or liability on the part of NCWR formy medical expenses. I realize and am aware that my own health insurance coverage will provide forany necessary medical treatment or care. I further understand that I am not covered as a volunteer by NCWR under California State Worker’s Compensation Laws.
4. Transportation. When driving a vehicle to perform volunteer services for NCWR, I agree to maintain a valid driver’s license and at least the State-required minimum amounts of automobile insurance on my vehicle and to indemnify and hold NCWR harmless from any claims arising from and/or related in any way to any NCWR animal’s presence in my vehicle. NCWR does not provide auto liability insurance for volunteer drivers.
5. Medical Treatment. I release and forever discharge NCWR from any claim whatsoever which arises or may hereafter arise on account of any first-aid treatment or other medical services rendered in connection with an emergency (injury) during my time with NCWR.
6. Assumption of the Risk. I understand that time volunteering with NCWR may include activities that may result in injury. I expressly and specifically assume the risk of injury or harm in all activities undertaken asa part of my volunteer responsibilities and release NCWR from all liability for injury, illness, death, or property damage resulting from my activities undertaken in the capacity of volunteer with NCWR. I understand that working with animals presents some risks, and that there are possibilities of injury that may result from contact with animals, such as scratches, bites, and allergic reactions, which may occur when performing volunteer services.
7. Photographic Release. I hereby grant NCWR, and the photographer, permission to use my likeness in a photograph or video in any publication, digital and print, and without payment of any kind. I grant and convey unto NCWR all right, title and interest in any and all photographic images and video or audio recordings made by or for NCWR during my work with NCWR, including but not limited to, any royalties, proceeds, or other benefits derived from such photographs or recordings.
8. Conduct. I agree that as an NCWR volunteer, I represent NCWR, and I promise not to engage in any activity - whether physical, verbal or written - that may cause harm to the reputation of NCWR. I agree tobe a role model for the humane treatment of animals, at home as well as while volunteering with NCWR.
9. Confidentiality. I understand that NCWR records and discussions regarding previous and new pet owners are to be kept confidential.
10. Oversight. I agree to accept supervision and support from the NCWR staff and understand that they will provide me with feedback to ensure my safety or to help me perform my volunteer duties most effectively.
11. Bite Policy. I understand that if I am bitten or witness a bite, NCWR requires me to report the bite immediatelyto the local Animal Control and to NCWR. NCWR’s policy is to report any bites where the skin may be broken. Failure to report may result in immediate termination from NCWR’s volunteer program.
12. Volunteer. I understand and agree that if accepted as a volunteer, all services performed by me will be performed on a strictly voluntary basis, and that I will receive no remuneration, pay or compensation of any kind; and that I am not an employee of NCWR.
13. Dismissal. I understand that failing to observe the above terms and conditions along with the policies and procedures of NCWR could result in my immediate dismissal from the volunteer program.
14. Other. I expressly agree that this Waiver is intended to be as broad and inclusive as permitted by thelaws of the State of California. This Waiver shall be governed by and interpreted in accordance with the laws of the State of California. I agree that in the event that any clause or provision of this Waiver shall be held to be invalid by any court of competent jurisdiction, the invalidity of such clause or provision shall not otherwise affect the remaining provisions of this Release, which shall continue to be enforceable.
