4. Transfer of Title. At the end of the fourteen (14) day trial period, title to the Adopted Animal shall automatically transfer from CPR to Adopter. The Adopted Animal’s microchip shall be registered to CPR; however, CPR retains no ownership rights or responsibilities to the Adopted Animal or accepts any liability for the Adopted Animal as a result of said registration. CPR makes no warranty of merchantability regarding the Adopted Animal and does not warrant that it has clear title to the Adopted Animal. Adopter assumes the risk of any prior claims and agrees to hold CPR harmless from any liabilities or injuries resulting from the adoption of the Adopted Animal.
5. Adoption Fee. The adoption fee is $400, $450 for puppies under one year of age. This is a non-refundable fee after the initial fourteen (14) day trial period as described above from time of adoption commitment.

6. Spaying/Neutering. No animal will be adopted out before it is spayed or neutered unless specifically stated. IF NOT YET NEUTERED, WILL BE PROVIDED BY CPR IF NEUTERED AT ASPEN ANIMAL HOSPITAL as governed by PCTFA under Colorado Agricultural Laws.
7. No Representations/Hold CPR Harmless. While CPR endeavors to notify Adopter of any behavioral or temperament issues with the Adopted Animal, Adopter acknowledges and accepts that the Adopted Animal’s behavior and demeanor cannot be guaranteed and is not warranted because animals have the capacity to act unexpectedly and because an animal’s history may be unknown. Adopter assumes the risk of potential behavioral problems and agrees to hold CPR harmless from any liabilities or injuries to, including, but not limited to, Adopter, Adopter’s family, Adopter’s neighbors, or workers hired by Adopter to perform work in Adopter’s home, resulting from the adoption of the Adopted Animal listed above.
Adopter acknowledges that the Adopted Animal is adopted “as is” and that no implied or expressed warranties have been made by CPR in reference to breed, health, training or temperament of Adopted Animal. CPR provides the information it has about Adopted Animal, including any vaccination or veterinary records but cannot certify to the completeness or accuracy of such documentation. Any description of breed is a guess. Adopter is advised to have DNA testing done at his/her expense prior to adoption if Adopter lives in an area with breed restrictions.
Adopter acknowledges and agrees that animal bites or other injuries to humans and other animals do occur and that all animals can carry and transmit parasites, diseases, including zoonotic diseases that can be transferred from animals to humans. Adopter understands that CPR will not be responsible for the transmission or transfer of any disease or parasite to other animals or people in the adopting household and no attempt will be made by me or anyone on my behalf to hold CPR responsible.
8. Care of the Adopted Pet. Adopter agrees to provide the Adopted Animal with access to his/her house, fresh water, wholesome food, adequate outdoor exercise and affection. Adopter agrees to ensure Adopted Animal’s safety, including, but not limited to, protection from other animals, traffic, and other dangers. Adopter shall not permit the animal to ride in the back of a pickup truck. Adopter shall leave an ID tag with his/her name, address and phone number on the animal at all times. Adopter shall confine the Adopted Animal in a yard with an adequate fence or other means as discussed in the application and agrees to not let the Adopted Animal roam freely. CPR does not believe in chaining animals or dog “runs” and strongly discourages such practices by Adopters.
9. Home Inspection. Adopter agrees that a representative of CPR may periodically wish to see the animal, Adopter's residence and the living conditions which Adopter provides for the animal. Adopter shall permit periodic examinations of the animal, Adopter residence and the living conditions for the animal. Adopter agrees to surrender the animal to a representative of CPR if, for any reason, in his/her sole and absolute discretion, he/she considers the conditions provided by Adopter for the animal unsuitable. Adopter shall keep CPR formed of any address change.
10. Veterinary Care. Adopter, at his/her sole expense, agrees to have the Adopted Animal examined by a licensed veterinarian within 1 month of adoption for heart worm prevention and a fecal float and not less than yearly thereafter. In case of illness or injury, Adopter agrees to seek prompt veterinarian care. Adopter agrees to keep all required vaccinations current for the Adopted Animal, including, but not limited to, rabies and that the Adopted Animal will receive preventative medication if necessary. Adopter, at his/her sole expense, shall be responsible for all vet care after adoption.
11. Lost Adopted Animal. Adopter agrees to take all reasonable efforts to find the Adopted Animal if it is lost, including but not limited to, (a) filing a lost animal report with the local police, animal control, animal shelter and local veterinarians, (b) posting lost animal signs, and (c) contacting CPR so that CPR can offer additional advice and support. Adopter authorizes any animal control agency to release the Adopted Animal back to CPR if the Adopted Animal is found running at large or is brought to a shelter facility for any reason. Adopter understands that Rescue may not return Adopted Animal to his/her care if there has been a breach of this agreement.
12. Breach of Agreement. If Adopter breaches any terms of this Agreement, or if the Adopted Animal is abused or neglected or otherwise endangered, Adopter agrees to immediate surrender and transfer of title of the Adopted Animal to CPR upon written demand.
Adopter acknowledges that breach of this agreement will result in travel costs, court costs and attorney fees payable by Adopter if legal action or travel is necessary for CPR to recover Adopted Animal. Adopter understands that Adopted Animal has intrinsic value and is notreplaceable, so if Adopted Animal is euthanized, lost or otherwise unable to be returned to CPR due to the negligence or intent of Adopter to circumvent Rescue's right to repossess Adopted Animal, I Adopter will be in breach of this agreement and will be subject to pay liquidated damages to the Rescue in the amount of $2,500.00 in addition to all attorney's fees and costs and actual damages incurred as a result of the breach.
13. No Liability. CPR is not liable for any claims, legal actions, losses, injuries, damages, costs, expenses, or liabilities whatsoever in connection with Adopter's adoption and ownership of the Adopted Animal, including, but not limited to, losses, injuries, damages, costs, expenses, or liabilities incurred by members of Adopter's family, Adopter's neighbors, or workers hired by Adopter to perform work in Adopter's home.
