In consideration of the use of equipment provided by WEBKO BOAT RENTALS, INC., whether as a renter, operator, passenger or user, and other good and valuable consideration, the receipt and sufficiency of which are hereby acknowledged, the undersigned, for themselves and their spouses/dependants, legal representatives, heirs, successors and assigns (hereinafter "Releasor", collectively), hereby RELEASES, WAIVES AND DISCHARGES WEBKO BOAT RENTALS, INC., their owners, members, agents, employees, heirs, successors and assigns (hereinafter "Releasee", collectively) from all liability for any and all loss or damage, and any claim or damages resulting therefrom, on account of injury to Releasor's person or property, even injury resulting in death, caused by the use or operation of Releasee's equipment.

BEFORE SIGNING. In consideration of the use of Releasee's equipment, Releasor hereby freely agrees to and hereby makes the following contractual representations and agreements: Releasor acknowledges that the use and operation of, and riding on, boats and personal watercraft is an inherently dangerous activity, due either to the negligence of Releasor or due to circumstances beyond the control of Releasor. Releasor fully realizes the dangers of using and operating such equipment and FULLY ASSUME THE have an adequate safety plan in effect and to comply with regulations and standards governing the use and operation of such equipment, including but not limited to the items listed on the attached "Safe Use of Boats and Watercraft" form. For Releasor, its heirs, executors, administrators, legal representatives, assignees, and successors in interest (collectively "Successors") RELEASOR HEREBY WAIVES, RELEASES, RELEASEE FROM ANY AND ALL RIGHTS AND CLAIMS which Releasor has or which may hereafter accrue to Releasor and from any and all damages which may be sustained by Releasor directly or indirectly in connection with, or arising out of, Releasor's use and operation of said equipment.

RELEASOR UNDERSTANDS THAT THIS FORM AND RELEASE IS A CONTRACT WITH LEGAL CONSEQUENCES. RELEASOR HAS BEEN ADVISED TO READ IT CAREFULLY

RISKS ASSOCIATED WITH SUCH USE, OPERATION, AND RIDING, and Releasor further agrees to

RELEASOR HEREBY WAIVES ANY AND ALL WARRANTIES REGARDING THE CONDITION OF THE EQUIPMENT PROVIDED BY RELEASEE.

Releasor has no physical or medical condition which to its knowledge, would endanger itself or others if it used and operated such equipment or would interfere with its ability to safely use and operate such equipment. Releasor is not in the habit of becoming under the influence of any substance that might impair its ability to safely use and operate such equipment. Releasor agrees, for itself and its successors, that the above representations are contractually binding, and are not mere recitals, and that should Releasor or its Successors assert any claim in contravention of this agreement, the asserting party shall be liable for the expenses (including legal fees) incurred by the other party or parties in defending, unless the other party or parties are finally adjudged liable on such claim for willful and wanton negligence, gross negligence, or recklessness.

In addition, Releasor, whether as a renter, operator, passenger or user, and other good and valuable consideration, the receipt and sufficiency of which are hereby acknowledged, for themselves and their spouses/dependants, legal representatives, heirs, successors and assigns, AGREES TO BE

OPERATING RELEASEE'S EQUIPMENT. Said damages shall be paid promptly to Releasee upon Releasee's demand. In the event that a dispute exists as to the cause or extent of said damage,

RELEASOR SUBMITS HIMSELF/HERSELF TO THE JURISDICTION AND VENUE OF EITHER THE MAGISTRATE COURT OF ELBERT COUNTY, GEORGIA, THE STATE COURT OF ELBERT COUNTY, GEORGIA, OR THE SUPERIOR COURT OF ELBERT COUNTY, GEORGIA FOR RESOLUTION OF SAID DISPUTE.

Releasor agrees that this agreement may not be modified orally, and a waiver of any provision shall not be construed as a modification of any other provision herein or as a consent to any other provision herein or as a consent to any subsequent waiver or modification. This Agreement, and the application and interpretation thereof, shall be governed exclusively by the laws of the State of Georgia. This agreement shall be construed under Georgia law. Every term and provision of this agreement is intended to be severable. If any one or more of them is found to be unenforceable or invalid, that shall not affect the other terms and provisions, which shall remain binding and enforceable.
