WAIVER FOR CONTAINER BACK-LOADING AND DIVERTING

This is to release Gothong Southern Shipping, Lines, Inc. for whatever claims of any kind as a result of NO actual physical inspection of the containers from Gothong Southern ConCare Department as the container/s is/are {classification164} due to the demand of {shippersName} expressly stipulates that Gothong Southern Shipping Lines, Inc. is not liable for loss or damage to cargo when such loss or damage is caused by the nature of the cargo, defect or inherent vice of the cargo, including loss of damage to perishable or temperature controlled items.

As representative(s) of {shippersName} we hereby inform you that we will load to your vessel ____________ on his voyage number ___ from Port of Cebu City to Port of {destination128} without reefer convoy on board. These containers contain FROZEN PRODUCTS which are inside container van number(s); {containerVan202} , {containerVan221}.

In this regard, we are requesting the vessel personnel to monitor our reefer van. Should the reefer van(s) malfunction the vessel personnel will inform the shipper. The shipper shall give instructions to vessel personnel how to fix the problem and crew shall do best effort to carry out the instructions. The crew shall not be held liable for any damage should they be unable to rectify the problem or the reefer van is beyond repair. Gothong Southern Shipping Lines shall not be held liable to any damage that shall arise from the shipment.

(GSSLI)’s vessel, ___________, for voyage number voyage number __________, from the port of Cebu City to the port of {destination128}. {shippersName} acknowledges verifying the integrity of reefer vans number(s); {containerVan202} , {containerVan221} before turnover and understands {shippersName}’s responsibility for overseeing them during transit.

Given the lack of a dedicated reefer convoy, {shippersName} releases GSSLI from any liability arising from malfunctions of the aforementioned reefer vans. {shippersName} kindly request GSSLI’s personnel to monitor the vans and, in case of malfunction, inform {shippersName} for repair instructions.

{shippersName} recognizes that GSSLI’s crew will undertake all reasonable efforts to comply with {shippersName}'s repair instructions. However, GSSLI shall not be held accountable for any damages that may occur if the crew is unable to rectify the issue or if the van is beyond repair.
