MEMBERSHIP AGREEMENT
The undersigned ("Member"), desires to become a member of Ferri Fit and agrees to the following terms and conditions:
PARQ
Member represents and warrants that all facts stated in the Physical Readiness Questionnaire (PARQ) submitted by Member are true and correct. the PARQ is incorporated herein by reference and made a part of this Agreement.
PAYMENT OF MEMBERSHIP FEES
All payments to Ferri Fit are final and can be made by one of the following options: Annual Payment (Under this option, a payment must accompany the Application.) Or Monthly Direct Debit (Under this option, the first payment must accompany the Application and the Member agrees to pay the then-current monthly Membership Fee each month thereafter through automatic withdrawals as per the Direct Debit Agreement signed by the member.
MEMBERSHIP TERM/CANCELLATION PERIOD/AMENDMENTS
All memberships of Ferri Fit either month-to-month or annual (when paid in full), and payments are due in advance. Monthly Direct Debits will not be cancelled without thirty (30) days written notice, either by certified mail, hand-delivery to the management of Ferri Fit, or by electronic means (i.e., email). No refunds will apply. If you wish to reduce your Gym membership a minimum of 30days notice is required and would be effective from the 1st Direct debit date on or after the notice period. If you wish to increase your Gym membership you are required to pay the difference in fees if you wish to start immediately and it is before the Direct Debit date, or start from the next payment date.
HOURS OF OPERATION
Ferri Fit’s opening hours are 6am to 9pm closing 1pm to 3pm Monday to Thursday, 6am to 7.30pm Friday and 8am to 1pm Saturday and 9am to 1pm Sunday. These hours are subject to change and written notice will be provided. In the event of an emergency or conditions out-with the control of Ferri Fit, including but not exhaustive of weather conditions or lack of Electricity and/or Water, Ferri Fit will endeavour to contact all members with any closure information.
LIABILITY
Member recognizes that there are hazards and risks connected with physical fitness training. These risks include, but are not limited to, abnormal blood pressure, fainting, heart disorders and heart attack, dehydration, heat exhaustion, sprains, muscle strain, blisters, stress fracture, shin splints, tendonitis, cartilage tears, bursitis, back pain and bruising of joints. Exercise beyond one's physical limits and/or accidents involving exercise equipment may result in serious injury or even death. Member agrees to defend, indemnify and hold harmless Ferri Fit against any loss, damage or expense incurred by reason of any claim or liability based upon personal injury (including death) or property damage arising out of the negligent or intentional action of Member. Member further agrees to release Ferri Fit and its owners, officer, agents, employees and/or affiliates from any and all liability arising out of injury to Member, and further agrees to defend, indemnify and hold Ferri Fit, its owners, officers, employees and/or affiliates free and harmless from against the same. Member acknowledges that surveillance cameras are in use for the protection of the Facility, its equipment and its members. Member hereby consents to being photographed and/or recorded for such purposes.
RULES AND REGULATIONS
Member acknowledges that Ferri Fir operates under rules and regulations established for the safety and protection of its members, and agrees to be bound by such rules and regulations, as well by the rules and regulations subsequently approved and posted or otherwise published by Ferri Fit. Such rules and regulations in effect from time to time are incorporated into this Agreement by reference. Facilities, equipment, hours, service, regulations and policies are subject to change from time to time, without prior notice, in the sole discretion of Ferri Fit. Member agrees to accept such reasonable change(s) as a condition of membership. Member additionally recognizes:
·       Under no circumstances shall Members move exercise equipment or use the equipment in any manner not authorized by Ferri Fit.
·       Members will not misuse the equipment.
·       All equipment shall be wiped down by Members after each use and returned to the correct place.
·       This membership is for the named Member only, and Members will not give access to another individual.
·       Members will declare any injuries, illnesses or medical requirement to staff as required and will comply if advised not to use equipment.
·       Members must be at least eighteen (18) years of age, unless otherwise authorised.
·       Members shall conduct themselves in a quiet, well-mannered fashion as to not cause any disturbance which may interfere with the use and enjoyment of the Facility by any other member. Profanity or indecent language and/or behaviour will not be tolerated. Any conduct deemed by Ferri Fit, in its sole discretion, to be offensive, potentially harmful, dangerous or abusive will not be tolerated, and shall be grounds for termination of the Members membership by Ferri Fit.
·       Ferri Fit shall not be responsible for any lost or stolen items.
·       Members should not occupy any equipment for an extended period of time. Members should allow others waiting to use such equipment to work into their rotation.
·       The climate of the Facility is controlled by Ferri Fit and is set to provide the optimum exercise environment for the majority of its members. Members shall not change any environmental controls.
PROHIBITED ACTIVITIES
·       Alcohol, drugs (including steroids), and smoking are prohibited within the Facility.
·       Members must not use the Facility or engage in any activity at Ferri Fit whilst under the influence of drugs, alcohol, or medication that may impair their ability to operate the equipment.
·       No weapons of any kind are allowed.
·       No photography, videotaping, filming or audio recording is permitted within the Facility without the express written consent of Ferri Fit management.
·       Ferri Fit reserves the right, in its sole discretion, to limit the consumption of food or beverages, or to the use of outside equipment within the Facility.
Please note this list is not exhaustive and Ferri Fit as mentioned above reserve the right to amend the list of rules, regulations and prohibited activities at any time with no prior notice. These will be displayed within the facility.

APPROPRIATE CLOTHING/FOOTWEAR
Ferri Fit requires that members wear appropriate clothing and footwear whilst in the Facility. Appropriate clothing includes gym shorts, T-shirts, jogging suits, aerobic wear and sweat outfits. Street clothing and jeans are not considered appropriate clothing.
SUSPENSION AND TERMINATION
I understand that Ferri Fit may suspend or terminate my membership at any time, in it sole and absolute discretion, for non-payment of Membership Fees or for violation of any of Ferri Fit rules/regulations and policies, and that in so doing, Ferri Fit assumes no further liability to adhere to the terms of this Agreement.
DATA PROTECTION/GDPR
Ferri Fit will not share any personal data without prior consent with any third-party organisations or other service users. All personal information, including names, addresses, DOB, Telephone numbers and email addresses will be stored in a secure location with limited access. Only the owners and employees of Ferri Fit will have access to personal information about members. There may be instances when we will contact you via post, email, telephone, social media or SMS messaging. If you do not wish to be contacted by any of these methods please detail this in writing.
The Ferri Fit Gym has 24hour CCTV internally and externally which is recorded and stored on a secure server only accessible by the owners and employees of Ferri Fit Gym. The CCTV is used solely to ensure the safety of service users and crime prevention. The CCTV footage will be examined and shared with the Police if requested for crim prevention purposes.
ACCEPTANCE & AGREEMENT OF TERMS
As a Member, I understand that I am entitled to use the Facility within the scope of the membership that I have selected, and that I am obligated to pay my fees regardless of whether or not I use the Facility. I agree to promptly update Ferri Fit of any change in my contact information (including address, telephone number or email address) medical information including injury or illness and any change in credit information. I certify that I have read the foregoing Membership Agreement, and that by signing below, I acknowledge that I understand and agree to be bound by all of the terms and conditions hereof. I acknowledge that Ferri Fit reserves the right to make amendments to the Terms and Conditions within the membership agreement at any point and will give 6weeks notice prior to them taking effect.
