Release of Liability and Hold Harmless Agreement ("Agreement"), is made as of this day between Isaiah's Place, Retreat and Learning Center 501c3, and its members, officers, directors, agents, employees, volunteers, and any other person or entity acting on its behalf (hereinafter referred to collectively as "Organization") and the persons(s) executing this document (hereinafter referred to as "Participant".

The organisation’s activities fall within the TEXAS Livestock Activities, Under Texas Law, an equine professional or sponsor is not liable for an injury to or the death of a participant in equine activities resulting from the inherent risks of equine activities, pursuant to Chapter 87 Liability for Equine Activities. I am aware that activities involving horses can be a hazardous activity and I am voluntarily participating in these activities with the knowledge of the danger involved, hereby agree to accept any and all risks of personal injury or death or property damage, and verify these statements by my electronic consent.

In consideration for Organisation’s equine services and participating in - or observation of - its equine activities including but not limited to horse assisted learning and instruction, Participant hereby releases, waives, and forever discharges Organisation of all actions of whatever kind arising from bodily injury, death, or property damage which relate in any way to Organisation’s equine related services and activities so long as such injury, property damage, or death is not caused by an intentional, wilful, or wanton act or omission of Organisation (i.e. Participant releases Organization from liability for damages caused by Organisation’s negligent acts or omissions only). Participant further agrees to indemnify Organisation for, and hold Organisation harmless from, all judgments, claims, demands, attorneys' fees, and costs arising from any such action.

This release is given on behalf of Participant and Participant's spouse, legal representatives, administrators, executors, heirs, and assigns, and in the case of any child or children of Participant's, on behalf of them and their legal representatives, administrators, executors, heirs, and assigns. This release is an ongoing release that does not expire and remains in effect until Participant has revoked it in writing provided to Organization. 

PARTICIPANT ACKNOWLEDGES THAT HE/SHE/THEY HAS/HAVE CAREFULLY READ THIS RELEASE, UNDERSTANDS THAT HE/SHE/THEY IS/ARE KNOWINGLY AND VOLUNTARILY ASSUMING ALL RISKS ASSOCIATED WITH BEING ON OR AROUND HORSES, INCLUDING SERIOUS BODILY INJURY, DEATH, AND PROPERTY DAMAGE, AND RELEASES ORGANIZATION FROM ALL LIABILITY FOR BODILY INJURY, DEATH, OR PROPERTY DAMAGE RESULTING FROM ORGANISATION’S NEGLIGENCE AND SHALL INDEMNIFY AND HOLD ORGANIZATION HARMLESS FROM THE SAME.

Unless otherwise noted, parents electronic consent also gives permission for Isaiah's Place Program, IP Equine Connection to use anonymous photographs and written reflections of EAL participants for educational presentations, research, &/or marketing materials.
