Letting, Marketing, Sales and Transfers of Properties in Bendor Village
(Extracts from the Company Rules of the Bendor Village Home Owners’ Association NPC)
A. Letting of residential properties in Bendor Village
To summarise, the main requirements are:
Copies of ID documents of prospective tenants must be provided to the secretary before finalisation of a lease agreement.
Prior arrangements must be made for fingerprint access for the tenant with the secretary.
The lease agreement must be submitted to the secretary of the Home Owners’ Association before tenants are allowed to move in.
To elaborate, further particulars are:
Members may only let their properties if they are in full compliance with the rules of the Home Owners’ Association.
Written confirmation must be obtained from the Home Owners’ Association prior to the finalisation of a lease with a tenant.
The names and copies of identity documents of tenants must be provided to the secretary (together with contact details and e-mail addresses) with the request for permission to let a property and particulars of the proposed lease.
The member is held liable for the actions of his tenants and the visitors of his tenants, including contractors, delivery vehicles, domestic workers and gardeners.
Members letting properties are also obliged to maintain their gardens and swimming pools in a clean, neat and tidy condition at all times.
Members letting properties must make provision in their rental agreements that the tenant is bound to the rules of the Bendor Village Home Owners’ Association.
All persons who wish to occupy properties in Bendor Village as tenants of members must also consent to have their criminal records examined and for this purpose, agree to have their fingerprints taken by the Home Owners’ Association.
In view of this rule and the limitation on the number of tenants occupying any property (two persons per bedroom on the approved building plans, with a maximum of eight per property), members are strongly advised to include the following two clauses in rental agreements for properties in Bendor Village as well:
The lessee agrees and consents thereto that the Bendor Village Home Owners’ Association shall be entitled to examine the criminal record of the lessee and any other adult intending to occupy the property, and for this reason agrees to have his/her (and any other adult intending to occupy the property) fingerprints taken by the Home Owners’ Association or its agents.
The lessee confirms that the following persons (including all adults and children) will occupy the property during the currency of the lease (and no other persons, without the prior written consent of the lessor):
B. Marketing of properties in Bendor Village
Estate agents will not be allowed access unless they have permission from the particular property owner or occupant.
No advertising boards may be displayed in front of the house that is for sale, anywhere within the boundaries of Bendor Village and not at the entrance to Bendor Village.
Houses may not be placed on show. Potential buyers wishing to view the property must be accompanied by the estate agent who has the permission of the particular property owner or occupant.
Where a house is to be sold by public auction, the auctioneers must make arrangements with the secretary at least seven days before the day of the auction.
