A) Payment for the stud service will be one (1) puppy from litter hereinafter referred to as STUD FEE PUPPY. The following terms will apply:
1) SDO will get choice of first-pick puppy of the opposite sex as that being solely owned by BREEDER to be chosen at 6 weeks of age or sooner or second-pick puppy of the same sex as that being solely owned by BREEDER to be chosen at 6 weeks of age or sooner (A.K.A "second overall pick of the litter").
2) In the event only one (1) puppy is born, A.K.A. a “singleton”, BREEDER has the following options:
a) BREEDER may keep singleton and accept a free rebreed for pup-back as payment under the same terms and conditions (same BITCH, same STUD, shipping & collection fees still apply). If rebreed should again produce a singleton BREEDER will choose which of the two singletons BREEDER will transfer to SDO as payment. SDO will then refund BREEDER all costs for the shipment of two (2) semen collections and pay BREEDER half the cost of cesarean if applicable. Upon SDO accepting STUD FEE PUPPY this contract will be fully executed. In the event BITCH fails to conceive on rebreed BREEDER must pay SDO stud service fee of $2,500.00 after which this contract will be considered fully executed, or
b) BREEDER may keep singleton and decline a free rebreed. BREEDER must then pay SDO the stud service fee of $2,500.00. This contract will be considered fully executed.
3) BREEDER will attach no contract or terms to the STUD FEE PUPPY.
4) SDO will not owe BREEDER any puppies back from the STUD FEE PUPPY nor owe BREEDER any money for this puppy regardless of what BREEDER sells littermates for.
5) STUD FEE PUPPY will be Registered by SDO with the AKC on Full Registration. SDO will be free to register and show STUD FEE PUPPY in other registries.
6) The SDO will be the sole owner on the STUD FEE PUPPY’s registration; BITCH’s owner(s) will not be added on the registration as owner(s) or co-owner(s).
7) As sole property of SDO, SDO will be free to sell or otherwise place STUD FEE PUPPY with or without breeding rights at SDO's discretion and at a price of SDO's choosing. STUD FEE PUPPY will not be sold, leased, given, or auctioned to a pet shop, pet broker, pet wholesaler, laboratory, puppy mill, high volume breeder/commercial kennel, shelter, agency, or any person who deals with the resale of animals.
8) STUD FEE PUPPY will bear the PEERLESS name as part of its registered name, the entirety of which will be chosen by SDO.
9) BREEDER is required to have the STUD FEE PUPPY thoroughly examined by a licensed veterinarian at 8 weeks of age at BREEDER’s expense. This examination must include a fecal flotation test that screens for Coccidia and Giardia. IF STUD FEE PUPPY has not been fully vaccinated, BREEDER agrees to test for Canine Parvovirus at the expense of SDO. Bloodwork and/or ELISA test to check for Parvovirus will be paid for by SDO on initial 8 week health check only - BREEDER will be responsible for payment of 2nd Parvo test if STUD FEE PUPPY fails health screening and Parvo is suspected at 2nd health check. STUD FEE PUPPY must be found to be in good health and free of parasites and disease before being released to SDO. SDO will have STUD FEE PUPPY evaluated by a licensed veteranarian within 72 hours of transfer. Due to their highly transmittable nature and lethality, certain diseases can cause devastating loss of life and pose an imminent threat to other animals in SDO's care as well as SDO's reputation, livelihood, and may impact the ability of SDO to continue to have animals at SDO's home. Examples of such diseases are Canine Parvovirus, Canine Distemper and Rabies. If STUD FEE PUPPY is found to be effected by any of these diseases at the initial 72 hour vet check after transfer the penalty shall be $10,0000.00 and any other applicable damages awarded by legal action/proceedings.
a) If due to injury, serious illness, or death the STUD FEE PUPPY is unsuitable as payment at 8 weeks of age BREEDER agrees to give SDO their choice of an alternate puppy from the same litter regardless of BREEDER’S commitment to other buyers. Alternate puppy will not be BREEDER's 1st pick unless BREEDER so chooses. SDO reserves the right to decline alternate puppy if puppy is found to be ill by a licensed veterinarian. If alternate STUD FEE PUPPY is declined by SDO BREEDER agrees to pay SDO a stud fee of $2,500.00 for stud services rendered.
b) If STUD FEE PUPPY is found to have parasites or some other mild illness that can be easily medically treated, BREEDER will keep the puppy and have it treated by a licensed veterinarian at BREEDER’s expense until such time as the veterinarian recommends reevaluation. A second health evaluation with a licensed veterinarian and an additional wide spectrum fecal flotation test (to incude Coccidia, and Giardia) at BREEDER’s expense will be required to confirm STUD FEE PUPPY’s recovery before being released to SDO. STUD FEE PUPPY must then be suitable for transfer to SDO by 12 weeks of age unless mutually agreed upon or as recomended by a vereranarian in an addendum to this contract. If STUD FEE PUPPY is still deemed ill by veterinarian by 12 weeks, SDO reserves the right to decline STUD FEE PUPPY as payment and BREEDER agrees to pay SDO $2,500.00 for stud services rendered.
c) If STUD FEE PUPPY is found to have a heart murmur greater than a grade 2 at initial 8 week health check BREEDER will notify SDO immediately and agrees to seek a second opinion at BREEDER's expense. Heart murmurs above a grade 2 will disqualify STUD FEE PUPPY as payment. BREEDER agrees to give SDO their choice of alternate puppy from the same litter regardless of BREEDER's commitment to other buyers (not 1st pick of litter unless BREEDER so chooses). If heart murmur isn't found until 72 hour vet check after transfer BREEDER will be notified immediately. For heart murmurs above a grade 2 SDO will seek 2nd opinion at BREEDER'S expense. If confirmed by 2 veterinarians, STUD FEE PUPPY with a heart murmur above a grade 2 will be returned to BREEDER at BREEDER's expense and BREEDER must pay SDO $2,500.00 for stud services rendered. Heart murmurs below a grade 3 will not require further action from either party and this contract will be fully executed.
10) Transportation of STUD FEE PUPPY will be arranged and paid for by SDO. SDO will pay BREEDER $.50 per mile round trip to deliver STUD FEE PUPPY to BREEDER’s nearest major airport.
11) Transportation will take place within 10 days of a clear health check.
C) BREEDER will pay SDO $150.00 per SHIP-MATE canister that is not returned within 30 days of breeding. SDO will provide BREEDER with a prepaid shipping label to facilitate return.
D) BREEDER understands and agrees that SDO will NOT sign the litter registration until STUD FEE PUPPY has been transfered to SDO and all shipping costs incurred have been paid.
E) If STUD should die or become too sick/injured to breed prior to stud services taking place BREEDER will be notified. A free rebreed will be offered (to same BITCH from same STUD (shipping & collection costs still apply) for a missed breeding due to sickness or injury. If BREEDER declines rebreed this contract will be considered fully executed.
F) If BITCH should die or become too sick/injured to breed prior to stud services taking place BREEDER will notify SDO. In the event of sickness/injury, BREEDER will be given the oppurtunity for a rebreed on following cycle (shipping & collection costs still apply). In the event of BITCH's death, BREEDER will be given the oppurtunity to transfer stud credit to a different female owned by BREEDER which must be approved by SDO. If SDO does not approve of 2nd female this contract will be considered fully executed.
G) SDO reserves the right to terminate this agreement prior to breeding for any reason they see fit. If this happens any shipping or collection costs that have been paid will be fully refunded within 5 business days.
