Waiver of Liability and Consent Form

In consideration of the risk of injury that exist while participating during sporting events, camps, off-season, in-season training and in consideration of my desire to participate,I knowingly enter into training at or with persons associated with Sports Performance Institute in Tulsa, OK, weather on site or any off-site location SPI and its staff train at.

I acknowledge that I, the below signatory and participant, (hereinafter “Athlete”), desire to participate in certain activities relating to sporting events, camps, off-season, in-season training, physical activities or other sports-related activities (“Activities”). Further, the undersigned parent and/or legal guardian (hereinafter “Parent”) (“Parent” and “Athlete” are collectively  referred to as “We” and in the event Athlete has reached the age of majority, then We and/or Parent shall refer to said adult Athlete.) also acknowledges that Athlete desires to participate in the Activities. We recognize that there are inherent risks and hazards directly or inherently involved in the Activities, making this a dangerous activity with the potential to cause loss of limb or life. With full knowledge of the facts and circumstances surrounding the Activities, We voluntary undertake these Activities and assume all responsibility and risk for Athlete’s participation in the Activities, including all risk of loss of limb or life, property damage, injury to others, and other hazards to Athlete. In considering these risks and Athlete’s desire to participate in the Activities, We knowingly enter into this Acknowledgement of Assumption of Risk, Release, and Waiver (“Agreement”) with Sports Performance Institute LLC (“SPI”), irrespective of whether the Activities occur at SPI’s on-site location or at any off-site location.

Further, We assure SPI that We have adequate health insurance necessary to provide for and pay any medical costs that may directly or indirectly result from Athlete’s participation in the Activities, and We will indemnify and hold SPI, its affiliates and agents, harmless for any harm resulting from the Activities. Additionally, We assure SPI that there are no health-related reasons or problems which may preclude or restrict Athlete’s participation in the Activities, and We are aware that SPI is a 24/7 access facility. As a result, there will be days where no staff will be on site, and We assume all risk of injury while in the facility.

We also agree to allow SPI, and its affiliates and agents, to do what they deem reasonably necessary in case of an accident to help treat Athlete if a parent or legal guardian is unavailable at that time. Parent further authorizes SPI, and its affiliates and agents, to perform examinations and treatments for the Athlete without my presence or the presence of any other parent and/or legal guardian.

We hereby release the SPI from any liability whatsoever arising out of Athlete’s participation in the Activities, including but not limited to, any damage to my property or the property of others and injury to me or to others, including loss of limb or life or to others through my participation in the Activities. We agree to the foregoing terms in their entirety for the good and valuable consideration of SPI allowing Athlete’s participation in the Activities, the receipt and adequacy of which is hereby acknowledged. We execute this document with full knowledge of the contents and consequences stated in this Agreement.

MEMBERSHIP AGREEMENT

Sports Performance Institute LLC (“SPI”) offers annual and month to month memberships for fully facility access and for gym access only MONTH MEMBERSHIP 

MONTH TO MONTH MEMBERSHIPS 

If you are entering in the annual membership with SPI, you agree to the following:

* $65/m billed the 1st of each month Full Facility. Family Membership 

* $25/m billed the 1st of each month Gym Only.

* $45/m billed the 1st of each month over Gym Only. Family Membership

FAMILY MEMBERSHIP IS FOR ONLY PEOPLE RESIDING IN YOUR HOUSEHOLD!

* * TO CANCEL YOU MUST GIVE A 30 DAY NOTICE BEFORE NEXT BILLING CYCLE

 * You also agree that you will respect the facility and its staff. Any destruction, improper care of equipment, abusing membership privileges for non-members, not picking up cages/gym/field after yourself, theft and not obeying posted signs can result in automatic membership cancellation. No refunds will be issued for termination of Membership for violation of rules. 

*We are a 24/7 365 facility which means at times there will not be anyone present, but SPI maintains a 24hr live monitored and recorded security system to protect not only us, but you as well. 

 

 

 

GUEST PASS OPTIONS AVAILABLE FOR ADD ON

* Guest pass add on available for all the annual membership plans and can be added or removed at any time. If you do not have the add on, guest daily fee is $25.

 

REGISTRATION FEES

EACH MEMBERSHIP IS SUBJECT TO A (1 TIME) REGISTRATION FEE, AND DUE AT TIME OF SETTING UP MEMBERSHIP. REGISTRATION FEE IS $50.00

 

BILLING

* You agree to notify SPI with any card changes or declines with new details as soon as possible.

* For any payment declined or returned, you may be subject to $10.00 processing fee to bring account current. 

* If your account declines, you will be notified within two (2) days of the transaction and you are expected to respond as soon as possible.

* If you go longer than thirty (30) days without payment or notice, your access cards and apps will be frozen. SPI may refer the account for collections and you may be responsible for any fees incurred by SPI. 

CLUB ENHANCEMENT/RATE GUARANTEE FEE

Club enhancement/Rate Guarantee Fee. This fee will guarantee that your rate won't increase for the life of your membership. This also helps us with updates and maintenance needs around the facility.  The annual $39.00 Club enhancement fee will be billed annually to your account on January 15th each year. (if you sign up after Jan 15th, you will be charged a month after your registration on the 15th of the next month.)
