• Motion to Request Removal of Ballot Counting Devices

  • I   *   *   of   *   , New Hampshire call upon my town committee requesting to motion the removal of all ballot counting devices used for any and all upcoming elections and return to paper ballot hand count voting to avoid the following;

    • Under NH Chapter 656:40 electronic ballot counting devices are adopted and used only on a trial basis. This trial period has failed due to lack of consistent results with accurate votes cast compared to hand recounts in NH.
    • Issues with these devices are only discovered though hand recounts, if allowed.
    • Hand recounts challenging the machine count, may only be requested by candidates if, and only if, they desire a recount, and they meet NH Chapter 660 requirements. This has a huge potential to miss corrective action through lack of oversight, observed in the most recent voting cycles, by anyone other than partisan candidates and board members who have a personal vested interest in a specific outcome.
    • Issues with ballots used for these devices noted in the Windham Audit Report included, by not limit to, different paper thickness, s-folds, and c-folds are caused overvotes where the device could not read and fails due to the ballot properly. This anomaly of discounting votes was revealed during the hand count process, where many were miscounted as “overvotes”, and omitted from the election calculation.
    • Overvotes cannot be adjudicated properly, if they are not observed.
    • The recent election data gathered from all towns with machine ballot counting devices did not align with independent internal audits conducted by NHVoterIntegrity.org
    • US Department of Justice cautions on July 27th , 2021 against conducting post-election ballot counting device audits, such as the SB 43 Windham Audit, as such audits may cause voter intimidation, coercion and violate Civil Rights Act of 1960, Voter Rights Act of 1965 and the National Voter Registration Act of 1993. This agenda is to be brought forward at the next scheduled town meeting, and I respectfully request an email reply of receipt and follow-up email with the scheduled meeting date where this has been added to the agenda, at least 5 days prior to that date.
