This Demand Letter is concerning specific actions that the Broward County School Board has taken to defy recent bills and executive orders signed by our Governor Ron DeSantis. We feel that this represents a dereliction of duty and their Oath to protect the children of Broward County Public Schools. Parents delegate our responsibility to educate our children to the School Board. It is our right to undelegate that responsibility from the school board, especially in cases where they are failing the students. As a concerned parent of a school age child and/or resident of Broward County, I bring the following concerns to the attention of the Broward County School Board:

  • Florida Gov. Ron DeSantis signed an executive order to issue emergency

rules for "protecting the rights of parents, making face masks optional across the

state in schools and leaving it up to parents. Any rebates, intimidation,

manipulation or grooming of children to participate in activities regarding a minor's health, including staying away from friends, obstruction of airway by mandating a mask while on school property or on the bus, staying at home for prolonged periods, covid testing or vaccination, without consent of the parents is unlawful. Anyone creating and adopting any such polices shall be liable, to the fullest extent of the law for every health concern arising out of the above- mentioned violations of rights and health care policies. We demand that the School Superintendent and the District School Board cease and desist immediately and in the future from any policies that mandate forced mask wearing, social distancing, covid testing and/or experimental vaccination proof as condition for free and equal participation in education, or as means to discriminate against or segregate children. We Demand that the School Board post the Mask Manufacturer Data/Claims that says their Masks are designed / made to prevent the transmission of Covid. Please provide proof/evidence that a Mask prevents the

We Demand that any attempt to incorporate Critical Race Theory and Social Emotional Learning, which is inextricably tied to CRT is a violation. These methods encourage implementation of the Social Emotional Competencies found

on the ADE website. On June 22nd, 2021, Ron DeSantis signed House Bill 5, House

Bill 233 and Senate Bill 1108 - target how civics education and debate topics will

be discussed from kindergarten through higher education. On June 10th, Florida

board votes to ban critical race theory from state. Committing racial

discrimination in the name of ending racial discrimination is both illogical and

illegal. It goes against the exceptional principles on which our nation was

founded. Implementing CRT and antiracist programming, in a way that treats

individuals differently, on the basis of race, creates a racially hostile environment.

We Demand a Remedy for: the Broward County School Board has made it difficult to obtain Form 681 Religious Exemption, which allows for families to claim religious exemption from vaccines for their children. The Broward County

  • School Board Website has a weblink for Form 681, which instead directs the user to Form 4699 Religious/Tribal Observance Attendance Waiver Form. Form 4699 is not a Religious Waiver Form for Vaccines. Further the website directs the user to

"Florida SHOTS (State Health Online Tracking System)" which does not provide

the ability to search for form 681 or download the form. Parents must call the

Department of Health at 954-467-4705 for information. The process should be

made easier for Parents to obtain Form 681 Religious Exemption. By making this

process difficult, Broward County School Board has violated Article 1, Section 3 of

    the Florida State Constitution.

We Demand an end to the Proclamation signed by all Broward County School Board members which "opposes the "Fairness in Women's Sports Act."

This Proclamation goes against SB 1028 "Fairness in Women's Sports Act" that

was signed by Governor Ron DeSantis on June 1st, 2021. The School Board is

defying Florida Legislature and a Bill that sites US Congressional Legislation from

the116th and 117th Congress. I believe that the School Board is not protecting our

girls whose rights are Protected by the Florida Constitution Article 1 Declaration

We Demand a Remedy to all the above points. If you fail within 15 days

after this Demand Letter was mailed, I/we will be forced to pursue legal action

and see the recovery of any damages and attorney's fees against you. Failure to

respond will result in an Affidavit that will be filed with all parties involved

including the Governor, Attorney General, Florida House of Representatives and

Florida Senate. Any delay or postponement by in taking any legal action against

you should not be construed as a waiver of any of the rights or remedies

available. This letter should not be interpreted as an election of remedy, hereby

reserving all available rights and remedies. Additionally, this letter should not be

construed as a waiver of any other right, which is not mentioned specifically

herein. You are further put on notice to preserve any evidence related to the

demand herein. If legal action is pursued, this letter will be presented as evidence
