THIS DOCUMENT OPERATES TO EXCLUDE LIABILITY AND DEALS WITH ASSUMPTION OF
RISK AND JURISDICTION.THESE CONDITIONS WILL AFFECT YOUR LEGAL RIGHTS,

As a condition of use of the facilities owned by Horseplay Niagara Inc. and the animals provided by Horseplay Niagara Inc:
THE UNDERSIGNED hereby assumes all risks of personal injury, death or property loss resulting from any cause whatsoever including but not limited to the inherent risks of horseback riding and related activities including unpredictable behaviour of the animals, collision with natural or man-made objects, falls, dismounts, failure of equipment or otherwise, or negligence, breach of contract, or breach of statutory duty of care on the part of Kathryn Buttigieg and their employees and agents (the operators), Anthony Buttigieg or any one or more of them. The risks include those foreseen and unforeseen, known or unknown.
THE UNDERSIGNED agrees that the operator shall not be liable for any such personal injury, death or property loss and releases the operators and waives all claims with respect thereto.
THE UNDERSIGNED agrees that the operator shall not be liable for exposure, personal injury, death or property loss relating to the inherent risk of infection from the COVID-19 virus.
THE UNDERSIGNED agrees that any litigation involving the operators shall be brought within the Province of Ontario and further agrees that these conditions and any rights, duties and obligations as between the operators and the undersigned shall be governed by and interpreted in accordance with the laws of the Province of Ontario.
THE UNDERSIGNED agrees to adhere to the written and oral instructions of the operators and to act responsibly at all time as a prudent handler of animals. In the event that services are provided to a person under the age of eighteen years, the undersigned as authorized legal parent or guardian agrees to indemnify the operators from any and all claims, actions, causes of actions or suits brought by such minor or in his or her name including all defence costs on a solicitor-client basis for personal injury, death or property loss resulting to the user of the facilities under the age of eighteen years of age.
The UNDERSIGNED agrees to grant the operators permission to use their likeness in photographs and videos in any and all of its publications, including print or electronic, without payment or any other consideration. The UNDERSIGNED agrees that the operators are not responsible for damage or loss to any cell phones, cameras or other items taken on the horses with them.
