Waiver
1. Agree that I understand the inherent dangers of kayaking and assume all risks willingly. 2. Agree to indemnify and hold harmless QKC, their agents, employees, corporate sponsors and those corporations that have allowed QKC to use their property for QKC operations, with or without compensation for such (collectively the “QKC Indemnified Parties”), from all claims , damages, losses, injuries and expenses arising out of or resulting from participating in the activities described herein. I further agree to release, acquit and covenant not to sue the QKC Indemnified Parties for all actions, causes of actions, claims or damages, damages in law or remedies in equity of whatever kind, including negligence by QKC Indemnified Parties arising out of my participation in the kayaking program, my use of QKC equipment or any other QKC sponsored activity. This release shall be binding upon my family, assigns, heirs and administrators. Moreover, if the QKC Indemnified Parties are forced to defend any action, lawsuit or litigation by myself, my executors, or my heirs, on my family’s or my behalf, I agree to pay the QKC Indemnified Parties’ costs and attorney’s fees if they successfully defend such action, lawsuit or litigation. 3. Agree to wear a safety life vest at all times, to yield to all other boats and water craft, and to otherwise practice common sense water safety procedures. I further agree to limit my use of the kayaks to daylight hours and take responsibility for listening to the weather report and staying out of the water when small craft advisories are in effect or thunderstorms are predicted. I understand that use of alcohol and/or drugs is strictly prohibited while, and prior to, using the kayaks. 4. Agree that I will not allow anyone to use QKC kayaks and equipment that is not currently a member in good standing of the QKC. I further understand that my membership can be revoked if I allow the use of CKC kayaks by unauthorised persons. 5. Certify that I have no known health conditions that would affect my ability to kayak safely, including but not limited to visual or auditory impairments or medications that impairs function, or other disabling conditions. 6. I agree that I will abide by all club rules.

Membership Rules
Park legally and appropriately at the Jubilee park , Park Street site.At the Lake Hayes shed site all paddlers are to park above the toilets and walk down to the shed ..No…parking in front of the toilet area…map below to be followed.Kayaks are to be used in daytime only (sunrise to sunset) After sunset all boats must have a clearly visible white light . No paddling solo after sunset . PFD vests must be worn at all times when kayaking. No one is to kayak under the influence of alcohol, drugs or medications that could impair your ability to kayak safely. QKC members are not to allow non-members to use any QKC equipment, and are not to share our lock code with non-members. Kayaks are not to be used when in low visibility or when bad weather has been forecast. It is the members’ responsibility to check weather forecasts before heading out. Kayaks are expected to yield to all other boats on the Lake. Do not assume they can see you, large boats are not manoeuvrable. It may be impossible for them to avoid you. Kayaks, paddles, or life vest may not be removed from the boat shed for any purpose other than kayaking directly in the adjacent waters. Transporting kayaks to other locations is strictly prohibited. Club members it is first come first served to use club boats. The above rules are to be followed without exception! Members in violation of any of these rules will forfeit their QKC membership privileges and dues. Club members are to treat the boats with care, any damage will be repaired at the members expense. Safety Recommendations – We also suggest that you: Paddle close to the shoreline – it will be easier for you to get to shore if you capsize. If you need to cross, choose the shortest route to minimize your exposure in the channel, make sure there are no approaching boats, and cross quickly. Do not linger in the middle of the Lake. Avoid the water taxis and water taxi stops. Paddle with a partner – this is particularly important if you are venturing out away from the Frankton arm area. Pack a safety kit. It should contain a whistle, mirror, flashlight, sunscreen, water and a power bar or granola bar if you are venturing away from Frankton Arm. Purchase a dry bag for your cell phone. Dress in consideration of the weather and water temperature and NOT the air temperature.
