Photography Session Agreement
Client Session Agreement, Contract, Model Release, & Copyright Acknowledgement
Session Fees/Payment: Client agrees to pay photographer 30% of the session fee at the time of booking and Contract signature to secure their appointment date and time. This booking fee is a non-refundable retainer fee that goes towards the total session fee. The remainder of the balance is due 7 days prior to the session date. Once the session has been fully paid, there are NO REFUNDS ( read "reshoots and refunds" for more details). The Session Fee covers the time and talent of photographer, basic retouching, and creative editing of images, as determined by the photographer (read "Editing Policy" for more details). The images are to be downloaded by client from Pixieset.com. Additional digital images may be available for purchase at $10.00 per image.
Editing Policy: Raw and/or unedited photos will NOT be given or sold to clients under any circumstances. The photographer's editing process includes basic retouching; basic retouching may include some skin smoothening, some removal of blemishes, and basic color correction as determined by the photographer. The photographer will NOT drastically alter body type, clothes, hair, or make up. If you wish for your images to be edited with more detail, the photographer may do so at a cost determined at the discretion of the photographer.
The photographer's editing style is bold and warm. The Client agrees to not ask the photographer to completely change their editing style ( For example, should the client want light and airy edits, the client should not book the session as it is not the photographer's editing style). If the client makes a request to change the editing style, the photographer has the right to refuse.
Proofing Gallery and Gallery Downloads: A password protected proofing Gallery Will be ready within 74 hours. The proofing gallery will include unedited images along with one sample, edited image. Although making a final selection within 3 days from the proofing gallery email is highly recommended, the client will have up to 7 days to select their images. Once the Client has selected their photos, they are to notify the photographer. The photographer will then take the clients selection and finish up the detail editing ( skin retouching, removing distractions, etc). The turn around time for the final gallery is 7-14 days after the client notifies the photographer of their final selection from the proofing gallery.
Once the online gallery with final images is sent to the client, the client will have 7 days to download their images from the Pixieset online gallery; the gallery will automatically close down after 7 days. Should any gallery expire (proofing or final gallery) and the client needs the images re-uploaded, there is a re-upload fee of $20 per gallery, per 7 days.
Re-shoots / Refunds: Re-shoots are determined at the discretion of the photographer. If it is not possible for a session to take place on a scheduled day due to weather or a reasonable cause, Photographer will reschedule the mini sessions to the agreed back up date (listed above) at no additional charge. If, for whatever other reason, the Client cannot attend on the backup date, rescheduling may be determined at the discretion of the photographer. There may be a rescheduling fee added and the client agrees to pay it or the will lose their slot and retainer.
Re-shoots will NOT be given for poor choices of clothing, make-up, or hair, misbehaved children or other participants, or by not following the recommendations of the photographer.
Cooperation/No Shows/ Late arrival: Photographer is not responsible if Client and/or key individuals fail to appear or cooperate during portrait sessions. Because mini sessions are scheduled on a very tight basis, any amount of time the client is late will be deducted from their session. Client agrees to try to arrive at least 10-15 minutes before their time slot to prevent this. Please consider time driving to you session, traffic, finding parking, and walking to our meeting point, when scheduling your arrival.
Archive: After three (3) months, all images will be purged from photographer’s hard-drive, except as needed for promotional purposes, to be determined by photographer at photographer’s sole discretion. Photographer is not responsible for loss or damage to the digital files due to circumstances beyond photographer’s control. For this reason, the Photographer recommends you save multiple back up images in multiple locations/hard drives/accounts.
Liability: Photographer is NOT responsible for any injuries inflicted upon any participating parties. Client(s) will be responsible for their children and for themselves and release photographer from any claims against their person or their business.
Harassment: The Client(s) agree(s) to undertake best efforts to ensure the Photographer and the Photographer’s staff are treated with respect and dignity and that the Photographer is provided with a safe working environment. Should an issue arise, the Photographer will make reasonable effort to handle the matter. If the situation is not remedied in a reasonable amount of time, the Photographer retains the right to cancel the remainder of the event. Safe working environment issues include, but are not limited to, any instances of sexual harassment, violence, threats, or other similar behavior that would lead a reasonable person to feel unsafe in such an environment. In the event of such cancellation, the Client(s) will not be entitled to any refund.
Communication: The Client agrees to positive cooperation and communication for the best possible result within the definition of this assignment. The photographer of Joyful Moments with Juli is not responsible for key individuals' failure to be present or to fully cooperate during photography sessions, neither for missed images due to lack of cooperation from clients, models, or friends and relatives at the photo session. If the client does not feel confortable at any given moment, the client is responsible for speaking up. Communication is very important.
