The Applicant(s) authorize ACCFutures to retain this Statement of Personal Assets and Liabilities and any financial records, credit and reference reports for ACCFutures records and reporting to Federal Economic Development Agency for Southern Ontario / Industry Canada who oversees the Community Futures Program;
The Applicant(s) acknowledges that ACCFutures is a non-profit government-funded organization. Any recipient of ACCFutures services shall assist in completing any evaluation of the outcomes and impacts (current or in the future) as a result of obtaining services from ACCFutures; A representative from FedDev Ontario / Industry Canada/FedNor/MTCU or a consultant obtained on their behalf may contact The Applicant(s) to gather pertinent information to provide an evaluation of the impact of ACCFutures services and to request The Applicant(s) cooperation to ensure a successful outcome.
The Applicant(s) warrants that they are operating their business in conformity with all environmental legislation; confirms that their assets, including real estate, comply with all environmental legislation; have not used their assets in violation of environmental laws and no proceedings are underway, nor have any notice(s) been received concerning any alleged violation(s) of environmental laws; have not given a waiver concerning any compliance and/or violation of environmental laws to the prior owners of their assets; warrants that any environmental issues or concerns as known to the Applicant(s) and/or the Guarantor(s) have been disclosed to ACCFutures, and that activities, as required, are in compliance with all applicable
legislation, including the Canadian Environmental Assessment Act and the Canadian Environmental Protection Act.
The Applicant(s) further understands and consents to ACCFutures publicizing the Applicant’s business venture if the Applicant is successful in obtaining financing from ACCFutures, which or may not include personal information such as the name of the Applicant and name of the business.
The Applicant(s) further agrees to hold ACCFutures, its employees, volunteers, representatives, and agents harmless and hereby releases and discharges ACCFutures from any actions, damages, claims, or demands which may arise, directly or indirectly, as a result of any act or omission by ACCFutures in providing information to the Applicant(s), and to indemnify ACCFutures from any such actions, damages, claims, or demands which might be suffered by the Applicant's business or any guarantor in connection with any such information, the Applicant’s participation in any and all of ACCFutures services, or non-compliance with Federal and Provincial laws and regulations.
The Applicant(s) acknowledges that ACCFutures will be using this document in relation to one or more loan applications in which I have an interest and certify that the information reported in this document is true, accurate, and complete and acknowledge that ACCFutures will be relying on the information. If untrue or inaccurate or incomplete information is provided, ACCFutures may at its discretion decline any Application or, if a loan has already been granted, may cease disbursement of funds and demand the full repayment of loans proceeds already disbursed.
The Applicant(s) consents to ACCFutures making any inquiries, including the collection of personal information, as ACCFutures may deem necessary in order to verify the information set out herein and to reach a decision on any Application and administer such a loan if one is made; the exchange of such information by ACCFutures with other financial institutions or financial partners having an interest in the Application. The Applicant(s) is required by law to consent to such inquiries and collection; however, refusal to consent may prevent ACCFutures from considering an Application. Pursuant to the provisions of the Privacy Act, subject to certain exceptions, The Applicant(s) have the right of access to, and protection of, personal information which may be collected by ACCFutures.
