Terms & Conditions
Please read all terms and conditions carefully before placing your order. By submitting payment, you acknowledge and agree to all policies listed below.
1. Retainer Fees
A non-refundable retainer fee is required to secure your order date and must be paid before your booking is confirmed.
All retainers are:
NON-REFUNDABLE
transferable ONE time only to a new available date
If an order is canceled after full payment has been made, no refunds will be issued. However, the balance may be transferred one time to a future available date.
Please review your order details carefully before submitting payment to avoid any misunderstandings.
2. Final Balances & Unclaimed Orders
All remaining balances must be paid in full BEFORE the scheduled pickup date.
If your order is not picked up and a balance remains unpaid:
An inconvenience fee will be added
The outstanding balance and fee must be paid before booking future orders
If your order is not picked up on the scheduled date:
a $25 per day storage fee will be added. Storage is limited to a maximum of 2 days and is only available if space permits
Please understand that it is the client’s responsibility to arrange timely pickup.
3. Rush Orders
Orders placed less than 7 days before the pickup date are considered rush orders and will incur a $50 rush fee.
All rush orders must be paid in full at the time of booking.
Rush availability is not guaranteed and is subject to schedule availability.
4. Order Changes
No changes will be accepted during the week of pickup.
This includes:
flavor changes
color/theme changes
sizing changes
pickup date/time adjustments
design modifications
Please ensure all details are finalized before your order week.
5. Cake Care & Storage
All cakes should remain refrigerated until approximately 1–2 hours before serving.
To preserve the quality and appearance of your desserts:
Do NOT place cakes in direct sunlight
Do NOT leave cakes inside vehicles
avoid excessive heat and outdoor exposure
Failure to follow proper cake care instructions may result in melting, shifting, or sweating, and KAKED by Kay will not be held responsible for damages caused after pickup.
Cupcakes and treats may remain at room temperature unless otherwise instructed.
6. Damage Policy
KAKED by Kay is not responsible for any damage that occurs after your order has been picked up or delivered.
This includes damages caused during:
transportation
setup
handling
storage
weather exposure
event service
No exceptions.
7. Pickup Times & Late Fees
Clients are granted a 10-minute grace period for pickups.
After the grace period:
A late fee of $1 per minute will apply
All late fees must be paid before the order is released
Please respect pickup times, as multiple orders and schedules are managed daily.
Pickup times are strictly enforced.
8. Creative Freedom
While inspiration photos are welcomed and used as reference, KAKED by Kay reserves the right to maintain creative freedom when designing your order.
We strive to recreate inspirational images as closely as possible; however:
Exact duplication is not guaranteed
We will not copy another artist’s work exactly
Each creation is uniquely crafted with our own artistic style and techniques.
9. Agreement to Terms
By submitting your retainer fee and/or final payment, you acknowledge that you have read, understood, and agreed to all terms and conditions listed above.
10. Client Responsibility
KAKED by Kay is not responsible for misunderstandings resulting from failure to review these terms and conditions thoroughly.
These policies are in place to protect both the client and the business while ensuring the best possible experience for every order.
