  • Purchase Agreement

    This purchase agreement is a contract between the Buyer and the Seller for a Specific Puppy. The SELLER take great pride in offering a health guarentee on every puppy sold. Any puppy sold is PET ONLY and SELLER does not guarentee that any puppy or dog sold is breeding quality. By purchasing from the SELLER, the sale does not include permission to breed or breeding rights at any point in their lifetime, with the exception of a seperate addendum offered by the SELLER. Accidental or intentional breedings of the puppy sold will result in a penalty and fine as described later in the contract.  Puppy payment must be completed in cash at pick up or electronic payment by 7 weeks of age. Puppy will not be released without a signed contract by the BUYER and payment completed and cleared in full. 

     

  • This contract is exclusively between SELLER and (buyer). The buyer also represents the new owner of the puppy in this contract.

  • The BUYER is purchasing one puppy named for the total price of . The purchase of the puppy includes transferring full ownership and limited rights (no breeding no showing) of PUPPY to the BUYER with final payment and signed contract.

  • ELECTRONIC PAYMENT MUST BE SENT NO LATER THAN 7 WEEKS OF AGE

  • PICK UP and TRANSPORT

  • Final balance is due in CASH at pick up or approved electronic transaction no later than 7 week sold. 

     

    BUYER agrees to activate a pet insurance policy for their PUPPY that provide ACTIVE coverage day before puppy pick up. PUPPY will NOT be released with proof of active pet insurance 

     

    PUPPY must be picked up by 8 weeks and 3 days old or within 48 hours of passing health certificate visit

     

    A $25/day boarding/holding fee will begin at 8 weeks and 3 days (or 49 hours post healht certificate). The SELLER reserves the right to deny holding the puppy past 8 weeks and 2 days

     

    BUYER must pick up puppy at SELLER'S set pick up location at the prearranged date and time. 

     

    Airport delivery is an additional $100 flat fee and includes curbside drop off without parking. Parking fee is an additional $25/hour and this is paid by the buyer.

     

    SELLER is not responsible for any of the BUYER'S changes or cancellations in travel plans under any circumstances. All travel related plans should be booked as refundable as there are many things outside of the SELLER'S control when releasing a puppy. BUYER acknowledges that even if the SELLER delays or cancels the sale, the SELLER is not finacially responsible for any of the BUYER'S travel expenses under any condition.

  • OUT OF STATE

    BUYER ACKNOWLEDGEMENTS
  • Out of state buyers (to include international) will receive up to 120 minutes of complimentary service from SELLER to assist with travel arrangement, documentations, and other types of customer service. While most domestic buyers will usually fit within this 120 minute window international buyers will not. After 120 minutes have been accumulated the hourly rate of $100 will be assessed in 15 minute intervals, which round up. 

     

    BUYER is responsible for all expenses related to out of state or international travel and shipping and a travel retainer may be assessed prior to work. 

     

    SELLER will provide a general quote for travel related expenses and fee for service for out of state or out of country BUYERS, to the best of the SELLER'S ability. 

     

    SELLER is not responsible for any of the BUYER'S changes or cancellations in travel plans under any circumstances. All travel related plans should be booked as refundable as there are many things outside of the SELLER'S control when releasing a puppy. BUYER acknowledges that even if the SELLER delays or cancels the sale, the SELLER is not finacially responsible for any of the BUYER'S travel expenses under any condition. 

     

    In the event that the SELLER has go to the airport more than one time (missed flight, cancellation, out of range temps, ect) the BUYER is assessed a second airport delivery fee. 

     

    Final payment for PUPPY must be completed no later than 7 weeks and 0 days old. Any travel fees must be paid via retainer prior to making plans.  

     

     

    AIRPORT DROP OFF: Any outgoing flight must be approved by the SELLER due to scheduling. Puppies traveling in cabin must comply with state and airline regulation at all times. BUYER is responsible for all costs associated with but not limited to airline tickets, airport delivery fee, pet carrier, and out of state flight clearance documentation. SELLER is not liable for any incident or event that occurs once puppy is released to buyer or agent of the buyer. 

     

    CARGO SHIPPING: All cargo shipping is arranged by the SELLER and/or licensed shipper no earlier than 6 weeks of age. BUYER is responsible for all costs of cargo shipping to include but not limited to:  Airline fees, 3rd party shipper fees, broker fees, change fees, airline approved crate, clearance paperwork, USDA paperwork, mailing fees, processing fees, and airport delivery cost. SELLER is not responsible for flights cancelled or delayed by airlines and will not refund buyer or cancel sale in this situation. SELLER is not responsible for temperatures out of range causing a change in flight and will not refund or delay buyer. If SELLER is at the airport and is unable to ship puppy and has to return to the airport a second or subsequent time, due to a change in flight , the BUYER is responsible for any subsequent airport delivery fees, change fees, documentation fees, and any other financial responsibility associated with travel. SELLER is not responsible for any incident that occurs during shipping and does not refund full or partial payments once puppy is checked in. BUYER must dispute incident and loss of value/life with airline, or responsible party, and not the SELLER. 

     

    FLIGHT NANNY: BUYER is responsible for costs and arrangements made to secure a flight nanny. Airport delivery fee will still apply when meeting a flight nanny. All flights must be approved by SELLER due to scheduling. SELLER reserves the right to deny BUYER'S flight nanny due to reputation, poor communication, safety, licensing, or other reasons without explination. Once puppy is released to the FLIGHT NANNY or BUYER'S agent the SELLER is not responsible for any incident that may occur after that in travel. BUYER must dispute incident and loss of value/life with flight nanny or BUYER'S agent, or responsible party, and not the SELLER.

  • REGISTRATION, SHOW AND BREEDING RIGHTS

  • Most puppies are sold as PET quality and do not include breeding rights. 

    PET registration may be requested within 30 days of sterilization per policy. BUYER is responsible for the cost of the registration fees and shipment. 

    SELLER reserves the right to be listed as co-owner on any pet registration to ensure protection of the bloodlines. 

    If any type of price reduction or discount has been provided on the puppy, the SELLER will not provide the option to request registration paperwork 

    SELLER reserves the right to add a "Prefix" in front of any registration paper

    Buyer is responsible for registration paperwork fee as well as a $5 paperwork fee

     

     

    DOODLE BREEDINGS:

    If eligible, doodle litter parents will be registered with Continental Kennel Club (CKC) which is a general and mixed breed registry. Outside STUD dogs may not be eligible for CKC registry. SELLER is responsible for registering each litter except is a litter is sired by a STUD who is not able to be registered via CKC. SELLER does not guarentee registration paperwork on doodle litters. 

    SELLER reserves the right to preform the individual pet puppy registration and BUYER is responsible for said registration fees. 

    DOODLE puppies may be registered with AKC pals by BUYER for the purpose of dog activity and enrichement.

     

    POMSKY BREEDINGS:

    If eligible, pomsky parents will be registered with Continental Kennel Club (CKC)  which is a general and mixed breed registry. Outside STUD dogs may not be eligible for CKC registry.  SELLER is responsible for registering each litter except is a litter is sired by a STUD who is not able to be registered via CKC. SELLER does not guarentee registration paperwork on pomsky litters. 

    SELLER reserves the right to preform the individual pet puppy registration and BUYER is responsible for said registration fees. 

    Pomsky puppies may be registered with AKC pals by BUYER for the purpose of dog activity and enrichement.

     

    TOY and MINI AUSSIES/MINI AMERICANS/AUSSIES:

    If eligible, parent dogs are registered with American Stock Dog Registry (ASDR). Select litters may be eligilbe for AKC MINI AMERICAN PET PAPERS.  Parent pedigree (3 generation) is available upon request in writing. The SELLER is responsible to register each litter with ASDR

    SELLER reserves the right to preform the individual pet puppy registration and BUYER is responsible for said registration fees. 

    Toy, mini or standard Aussie puppies may be registered with AKC pals by BUYER for the purpose of dog activity and enrichement. 

    SHOW RIGHTS will be considered on an individual basis for toy, mini, and full size aussies. 

     

      

    MISC

     

    A $2000 penalty will apply to any BUYER who registers their puppy under a different parent/lineage, falsifies registraion and pedigree, or hardships a puppy. 

     

    A $2000 penalty per offspring of said puppy will apply to any BUYER who allows breeding of their purchased PET puppy whether it be intentional or accidental breeding

     

     If breeding rights are offered , both BUYER and SELLER will have a seperate addendum to this contract that specifices terms and conditions for breeding rights

  • Initial Puppy Health

  • BUYER must have immediete coverage pet insurance active no later than puppy pick up. SELLER DOES NOT RELEASE A PUPPY WITHOUT PROOF OF PET INSURANCE.

     

     

    Initial Purchase:

     

    SELLER warrents that puppy is being sold within accordance to state laws. Puppy will be asymptomatic of infectious diease at time of pick up. 

     

    SELLER warrents that puppy will be negative from PARVOVIRUS x 5 days post pick up under the following conditions:  BUYER agrees to not bring puppy into the public or areas with previous parvo during these five days AND any vet visits will include putting puppy on a clean barrier (puppy pad, towel) when being examined and puppy will not put any paws on the floor of the vet office. 

     

    SELLER does not pay for diagnostics or treatment of parasitic puppy conditions such as FLEAS, WORMS, GIARDIA, or COCCIDIA. SELLER follows vet recommended parasitic prevention protocol from 0-8 weeks to reduce parastic load and state laws are followed to maintain puppy health requirements. 

    Symptomatic and non-symptomatic parasitic puppy conditions are common within the puppy immune system.  Various things such as travel, stress, food changes, new environment and transition to a new family can all commonly create a response in the puppy's GI system that presents as parasitic puppy conditions. Bottom Line:  Parastic puppy conditions are common when puppies leave the SELLER.  

     

    Seller can not be responsible for Hypoglycemia (low blood sugar) or the effects of any stress related illness due to travel/rehoming. Buyer must make certain that their new puppy eats and drinks and gets plenty of rest. 

  • BUYER must have the dog physically examined by a licensed
    veterinarian within 72hours of receipt of puppy. If the veterinarian feels
    that the pet puppy in question is sick including critically ill, the puppy must be returned for testing and treatment to SELLER IMMEDIETLY NO EXCEPTIONS.  Written documentation from the BUYER'S veterinarian, including lab testing, must be sent via email. SELLER reserves the right to have a 2nd opinion with SELLER'S vet at SELLER'S expense.

     

    SELLER reserves the right to wait until puppy has fully recovered and complete vet  records/billing and pet insurance records/payout have been sent before starting the claim process. This allows SELLER, SELLER'S vet, and SELLER'S legal advisor to review the entire medical case. If pet insurance covers any portion of the event BUYER will not be eligible for what has been covered. SELLER does not cover exams, procedures or services associated with anything outside of the claim. SELLER does not cover any follow up vet visits or diagnostics after diagnosis has been made. If a partial or full refund  is determined the payment will be sent to the BUYER via PAPER CHECK using the U.S postal service. SELLER reserves the right to ask BUYER to complete reimbursement paperwork per policy. 

  •  SELLER agrees to provide vaccine records to BUYER at pick up. Puppy will have at least one core vaccine administration per SELLER'S state laws. 

     

    BUYER agrees to schedule the remaining puppy vaccination visits around 12 weeks and 16 weeks. BUYER agrees to vaccinate against rabies per BUYER'S state laws.

     

    Puppy will be at the lowest level of immunity of its life at 8 weeks, even after receiving first vaccinations prior to pick up. The second series of vaccinations must be done within 4 weeks from the date of the first vaccinations, and the third series four weeks after that. Final puppy vaccines should not be done prior to 16 weeks of age. Puppy is not immune to disease even with a final set of vaccinations. It is recommended that BUYER does not take puppy to public dog parks until one week following the final vaccines at 16 weeks. If BUYER must  board an under 16 week puppy, BUYER agrees to avoid boarding kennels, and keep puppy home with a trusted friend or pet sitter.

     

    SELLER is not responsible for health concerns if the exact current puppy food is not continued for at least 30 days after pick up. 

     

    The Seller will assume no responsibility if this puppy/dog is given Ivermectin, Immodium or any of the Aussie -sensitive drugs and suffers an adverse reaction. No other guarantees are given.

     

    SELLER is not responsible for Grade I-III non-life threating heart murmers detected in puppyhood.

     

    SELLER does not cover cost of dental defects or concerns

     

    SELLER is not responsible for future vet costs associated with undescended testicles, unilateral or bilateral PRIOR TO SIX MONTHS, on any puppy sold. If testicles have not descended by 9 months seller will reimburse up to $250 after confirmation of retained testicles , surgical report, and receipt have been submitted via vet office to email (iheartminiaussies@gmail.com) . Owner must complete the reimbursement form and health warrenty form. Correction must be done prior to 18 months of age to be eligilble for reimbursement.

     

    SELLER is agrees to reimburse up to $250 for an umbillical or inguinal hernia correction if detected within the first 4 months of life. This will be paid after surgery records and owner's bill has been submitted via email directly from the vet office ( iheartminiaussies@gmail.com ) and owner has completed the reimbursment form and health warrenty form. Correction must be done prior to 18 months of age to be eligilble for reimbursement.

     

    SELLER is not responsible for pre-existing conditions that have already been disclosed prior to pick up

     

    BUYER agrees to send SELLER the initial puppy wellness exam notes via email

  • 12 MONTH GENETIC HEALTH GUARENTEE

  • SELLER offers a genetic health guarentee until 12 months of age on every puppy sold.  A puppy must have had a welless exam within 72 hours of pick up to be eligible for this with office notes sent directly to seller from vet clinic within 72 hours of exam ( iheartminiaussies@gmail.com ). Only untreatable, life threatening, genetic diseases or defects will be eligible for review. Dental and jaw conditions are not included in any Health Guarentee from the SELLER. Each genetic health guarentee claim is dealt with individually after SELLER and SELLER'S vet have been able to review all existing records from BUYER'S vet and BUYER'S  pet insurance. BUYER must inform SELLER of diagnosis within 72 hours of vet encounter and supply documentation. Records must  be sent via EMAIL to SELLER without any edits to the documentation. No information can be missing including identifying information.  SELLER reserves the right to have the puppy be seen for a second opinion for the SELLER'S choosing at their expense. BUYER is responsible for transportation to the second opinion vet. BUYER'S refusal to allow puppy to attend second opinion visit, or refuse to transport puppy on scheduled appointment will null and void the health guarentee. 

     

    SELLER reserves the right to wait until puppy has fully recovered/necessary follow up visits or procedures have occured and vet records/billing and pet insurance records/payout have been sent before starting the claim process. This allows SELLER, SELLER'S vet, and SELLER'S legal advisor to review the entire medical case. SELLER will have 90 days from last vet visit specific to the claim to respond to BUYER.

     

    SELLER does not cover or reimburse exam fees, procedures or services associated with anything outside of the claim. SELLER does not cover any follow up vet exams fees, biohazard fees, vaccines, or follow up diagnostics after diagnosis has been made. Should puppy be sick with infection or injury when when the genetic diagnosis is made, the puppy must be re-evaluated for the genetic health condition no earlier than 30 days after the infection or injury has resolved and genetic claim is begin on date of re-evaluation. SELLER reserves the right to insist on certain diagnostics be completed under sedation to improve the accuracy of findings, such as BAER testing, orthopedic concerns, or biopsies. Sedation is at the expense of the BUYER. SELLER does not cover additional "workups" to try to identify the problem. If pet insurance covers any portion of the event BUYER will not be eligible for what has been covered. 

     

    Should puppy be sterilized, impregnanted, or go under anethesia within the first twelve months of life this 12 Month Genetic Health Guarentee will be null and void.

    Should BUYER change food within the first 30 days of pick up or have documented animal abuse to the puppy the 12 month Genetic Health Guarentee will be null and void.

     

    Puppy is only eligible for one approved 12 month genetic health guarantee claim over their lifetime.

  • OPTIONS for Eligible Claims

  • Should the BUYER'S claim be eligible under the 12 Month Genetic Health Guarantee the BUYER will be offered one of the following options:

     

    OPTION A: REPLACEMENT PUPPY FROM CURRENT OR FUTURE LITTER

    Breeder will re-match the BUYER with a current or future puppy of the similar coat (merle vs tri/bi) and similar eye color (1-2 blue/marbled eyes vs non-blue) and gender within a 12 month time frame. The BUYER must accept the replacement puppy choosen within 12 months and if this is offered. The puppy which is eligible was found to have a genetic claim must be sterilized prior to releasing the replacement puppy. Replacement puppy can not be sold or given away and is intended for the BUYER only.

     

    OPTION B: RETURN OF PUPPY

    BUYER can return the puppy to the SELLER within 5 days of eligible claim and receive a refund of the original puppy purchase price minus any expenses or reimbursements that the BREEDER has paid until the point of surrender.

     

    OPTION C: REIMBURSEMENT FOR TREATMENT ONLY UP TO THE ORIGIONAL PURCHASE PRICE

    BUYER will be reimbursed up to the purchase price of the puppy for medical treatment associated with the claim, and not eligible for pet insurance coverage. BUYER will have up to the first birthday of the puppy to submit a claim for reimbursement under Option C. After the puppy is 12 months old the claim will expire the BREEDER will no longer reimburse any portion of the claim. BREEDER will only offer OPTION C on a case to case basis and not every claim in eligible for financial reimbursement. Puppy must be sterilized prior to any reimbursement sent. 

     

     

    All reimbursement payments will be sent to the BUYER via PAPER CHECK using the U.S postal service. SELLER reserves the right to ask BUYER to complete reimbursement paperwork per policy.

     

    SELLER reservers the right to require proof of spay/neuter prior to proceeding with the replacement pup or reimbursement.

  • Additional Health Warranties

  • SELLER reservers the right to require proof of spay/neuter prior to proceeding with the reimbursement, discount, or replacement

  • EYES: 

    SELLER warrants that puppy is free and clear of genetic eye conditions that are life threating and untreatable for 12 months. Eye conditions associated with excessive tearing, light sensitivity, or injury are not covered. Colobomas and "starburst" pupils are not covered. 

     

    Should a genetic eye condition outside of injury or accident, that is life threatening occur or causing permenant blindness be suspected, the BUYER must schedule an opthamologist appointment for OFA eye evaluation between 10- 12 months. Findings must be submitted to OFA. SELLER reserves the right to a second opinion or repeat evaluation at SELLER'S expense. A repeat evaluation should be done 12 months after the initial OFA eye exam. Should the eye condition be resolved at follow up the SELLER is not responsible for reimbursement.

     

    SELLER reserves the right to wait until after all vet records AND OFA results (including follow up findings) are completed before addressing the claim. 

     

    Should EYE claim be eligible and SELLER agrees to reimburse BUYER up to 25% of the original puppy purchase price

    If BUYER breeds their puppy, accidentally or intentionally the EYE WARRANTY IS NULL AND VOID.

  • HIP WARRANTY

      

    PENN HIP EVALUATION

    BUYER agrees to take puppy to PENN HIP evaluation between 4-6 months of age. 

    SELLER warrants that puppy will achieve score that falls into the category of "low risk" , "mild risk" or "moderate risk". 

    Should PENN HIP fall into the "high risk" catergory,  SELLER reserves the right to a second opinion and evaluation at the SELLER'S expense with a repeat PENN HIP or OFA, with at least 6 months in between the preliminary evaluation. SELLER will set up the follow up appointment with a vet of their choosing and the BUYER is responsible for taking their dog to the appointment. Any other hip condition will be reviewed on a case to case basis. 

     

     

    DISQUALIFICATIONS

    BUYER must take puppy to a preliminary evaluation to be eligible for this HIPS EXTENDED HEALTH WARRANTY. If a preliminary evaluation is not done within the time frame per contract and policy the HIPS WARRANTY is null and void. 

    If puppy has had an accident or injury with or without treatment prior to baseline or in between preliminary and final evaluations the HIP WARRANTY is null and void.

    If BUYER allows puppy to participate in inappropriate jump heights, agility training or competition, or long distance running prior to prelims the HIP EXTENDED WARRANTY IS NULL AND VOID. SELLER can not warranty hips if puppy is running more than 15 miles per week or working livestock.

    If BUYER raises puppy on concrete or slippery surfaces the HIP WARRANTY IS NULL AND VOID. 

    If BUYER breeds their puppy, accidentally or intentionally the HIP WARRANTY IS NULL AND VOID. 

    If BUYER refuses to take dog to second opinion which is set up and paid for by SELLER.

     

    Should hip claim be eligible the SELLER agrees to reimburse BUYER up to 50% of the origional puppy purchase price on bilateral  MODERATE or SEVERE hip dysplasia Other diagnosed conditions will be looked at on an individual basis.

     

    **schedule the PENN HIP between 4 and 6 months with an experienced PENN HIP provider**

  • TESTED AND VERIFIED GENETIC CONDITIONS: LIFETIME

     

    SELLER warrants that the puppy will not inherit two copies of the following GENES

     

    Collie Eye Anomaly (NHEJ1)

    Cone degeneration (CNGB3)

    Craniomandibular Osteopathy (SLC37A2)

    Hereditary Cataracts (Aussie type) (HSF4)

    Hyperuricosuria (SLC2A9)

    Intestinal Cobalamin Malabsorption (AMN)

    Multifocal Retinopathy 1 (BEST1)

    Neuronal Ceroid Lipofuscinosis 6 (CLN6)

    Progressive Retinal Atrophy, Progressive Rod-Cone Degeneration gene (PRCD)

     

    Seller does not warrant carrier status.

    Seller does not warrant CDPA or CDDY or IVDD gene status on any puppy sold 

    If a puppy has been tested by SELLER prior to sale and has two copies, the BUYER has the option to transfer their puppy selection prior to puppy pick up. No refund is given.

  • TRAINING AND TITLE INCENTIVE PROGRAM

  • AKC STAR PUPPY AND CGC

    SELLER agrees to reimburse BUYER up to $200 for the cost of an AKC STAR PUPPY CLASS with proof of completion AND passing CGC certificate. Both AKC STAR PUPPY and CGC must be done in order to be eliglble for reimbursment. Puppy must complete AKC STAR PUPPY and CGC no later than 7 months and 29 days old, as evidenced by receipt of attendance, receipt of completion, and CGC official title.

     

    CONFORMATION TITLE

    SELLER agrees to reimburse BUYER up to $100 per conformation champion title done through AKC, IABCA or ICE, from 3-11 months old, for a max of TWO (2) titles. Proof of champion title must be provided. See rules and regulations from AKC, IABCA and ICE regarding earning completion of champion titles

     

    ADDITIONAL AKC TITLES

    SELLER offers a $50 thank you bonus to dogs that achieve an AKC trick title, rally title, obedience title, fast cat title, or dock diving title. Title certificate and AKC pals certificate must be submitted via reimbursement system

     

    REIMBURSMENT:

    Reimbursement requests should be done through designated reimbursement system, within 30 days of completed CGC/title. If more than 30 days have passed BUYER is not longer eligible.

    BUYER must have an active ZELLE account to receive reimbursement 

    AKC STAR and CGC must be completed and passed FIRST no later than 7 months 29 days old , in order to be eligible for the  additional AKC TITLES OR CONFORMATION TITLES.

  • If at any time the BUYER/SELLER believe there is some type of problem with the puppy, the purchase, or the SELLER/BREEDER, it is expected that the issue and/or situation will be handled in a professional and civil manner. SELLER and BREEDER will attempt to resolve any issues within our control and within the terms and conditions of the contract.

     

    BUYER agrees to no engage, post, or communicate anything negative about any issue and/or situation verbally or in a public forum of any kind including but not limited to: FACEBOOK, INSTAGRAM, SOCIAL MEDIA, public or private blogs, ect.

     

    If the BUYER makes the choice to post and/or communicate negative information of any kind THE CONTRACT AND ALL HEALTH GUARANTEES ARE NULL AND VOID. ANY CLAIMS IN PROGRESS OR DEEMED ELIGIBLE WILL NO LONGER BE ELIGIBLE. In addition, the BUYER'S actions or that of their representatives will be viewed as taking steps to harm the SELLER'S reputation, business and/or it's relationship with current or future clients. Should this occur, the SELLER will have no choice but to initiate legal action for any damage to reputation and business. SELLER takes such matters seriously and will take whatever steps are necessary to protect itself and its business relationships.

     

    In the event of a dispute it is agreed the place and venue and jurisdiction shall be in SEMINOLE COUNTY FLORIDA. Prevailing party will be responsible for court costs.
