I acknowledge that I have read the foregoing Participation Form and I have had the opportunity to ask “The Good, The Bad, The Ugly Podcast” staff any questions I may have had prior to executing this form. I acknowledge that by executing this form, I will be an active Participant in a dating application (hereinafter referred to as “Pen’Pal”) owned, maintained, and operated by “The Good, The Bad, The Ugly Podcast.”I hereby consent and agree to the rules and regulations set forth to me by “The Good, The Bad, The Ugly Podcast” staff when involved Pen’Pal in any way from the execution of this Participation Form until my participation ceases. This clause will not exceed twenty (20) years as to be compliant with the Statute of Frauds. I understand and allow “The Good, The Bad, The Ugly Podcast” staff to use my personal information to communicate with me, other Participants, or other staff, affiliates, and third-parties that are deemed necessary by “The Good, The Bad, The Ugly Podcast” staff, agents, employees, employers, owners, officers, directors, affiliates. I understand that The Good, The Bad, The Ugly Podcast will have the sole discretion in the “matching process” between Participants, and consent that any and all communication between Participants is prohibited unless it is first delivered to “The Good, The Bad, The Ugly Podcast” or explicitly granted in writing by “The Good, The Bad, The Ugly Podcast” staff, agents, employees, employers, owners, officers, directors, or affiliates. I am a willing Participant in this project. I have the right to withdraw my consent in this project at any time by following the guidelines laid out to withdraw my participation. My withdrawal must be in writing to “The Good, The Bad, The Ugly Podcast staff.”I understand that my voluntary or involuntary withdrawal, discontinuance, termination, or natural conclusion does not excuse me from continuing to follow the rules and regulations provided prior or during my participation in Pen’Pal. I may not disclose any information of the use and operation of Pen’Pal, any other participants identity, any other participants personal information, my own information in relation to Pen’Pal. I understand I may only disclose information that has been explicitly allowed by “The Good, The Bad, The Ugly Podcast Staff.”I understand that my participation will not lead to any compensation from “The Good, The Bad, The Ugly Podcast” staff, agents, employees, employers, owners, officers, directors, affiliates, or other Participants.I understand that every action involved in Pen’Pal, including ancillary actions, will be monitored and screened by “The Good, The Bad, The Ugly Podcast” staff. I understand that “The Good, The Bad, The Ugly Podcast” staff cannot monitor every action during the use and operation of Pen’Pal by its Participants. Therefore, I personally indemnify and hold harmless “The Good, The Bad, The Ugly Podcast,” its staff, agents, employees, employers, owners, officers, directors, and affiliates arising out of or resulting from the negligence or misconduct from any Participant during the use of Pen’Pal. I understand this clause survives after my participation in Pen’Pal has ceased either voluntarily or involuntarily. I understand that my participation may not lead to a successful relationship with another participant. I acknowledge and agree that “The Good, The Bad, The Ugly Podcast,” its staff, agents, employees, employers, owners, officers, directors, and affiliates are not responsible for any unsuccessful relationship with any other Participant involved in Pen’Pal. I understand and agree that any and all information provided to “The Good, The Bad, The Ugly Podcast” can be used in “The Good, The Bad, The Ugly Podcast,” social media sites, podcast episodes, internet sites, blogs, promotional use, and any other use “The Good, The Bad, The Ugly Podcast deems appropriate.I understand that “The Good, The Bad, The Ugly Podcast” will not use any of my personal information in a malicious manner. I understand that “The Good, The Bad, The Ugly Podcast can use my name, email, handle, tag, or other identification characteristic for social media sites, podcast episodes, internet sites, blogs, promotional use, and any other use “The Good, The Bad, The Ugly Podcast deems appropriate.I understand that my participation as a Participant in Pen’Pal will include a five (5) week phase. Following that five (5) week phase, a “first date” will be implemented by “The Good, The Bad, The Ugly Podcast” staff. The “first date,” including the activity, restaurant, day, hour, or any other characteristic in the planning of the first date will be of the sole discretion of “The Good, The Bad, The Ugly Podcast” staff. I understand that “The Good, The Bad, The Ugly Podcast” is only responsible for the selection of the activity, restaurant, day, hour, or any other characteristic in the planning of the first date. Any action(s) during the “first date” are solely my responsibility and I hereby agree to hold harmless and indemnify “The Good, The Bad, The Ugly Podcast,” its staff, agents, employees, employers, owners, officers, directors, and affiliates from any action I take during the “first date.”I understand and agree that the “first date” will not be funded by “The Good, The Bad, The Ugly Podcast” in any way. I will not receive any form of compensation either prior, during, or after my participation in Pen’Pal.
