Service Agreement for Special Construction

1) Service. This Special Service Agreement is between you and Butler-Bremer Mutual Telephone Company d/b/a Butler-Bremer Communications (together with any subsidiaries or affiliates providing your service, “Butler Bremer”) and covers business or residential high-speed Internet and/or CATV service (collectively, the “Service”) to be provided to you at the following address (the “Service Address”):

Among other terms, this Service Agreement establishes a minimum service term in order to recover extraordinary investment or expenses for construction and installation of facilities to extend service to your Service Address.

2) Other Terms of Service. Your Service relationship with Butler-Bremer is governed by our “Terms of Service,” including: this Special Service Agreement; our Standard Service Agreement and/or Service Catalog(s) (if and as applicable to each Service you have ordered); and your selected Service Plan or Service Package (if and as applicable to each Service you have ordered). By signing below, you affirmatively request Service and agree to comply with all applicable Terms of Service. All applicable Terms of Service are incorporated herein by reference.

3) Upfront Payment; Minimum Service Term [Please indicate which option you are selecting]. *

In order to activate service, Butler-Bremer will require an installation fee payment in the amount of $90.00, prior to service installation/activation. As a condition to Butler-Bremer’s completion of installation of service you agree to a minimum service term of 24 months (the “Minimum Term”) for Service at the Service Address. If Service is disconnected or canceled following commencement of service and prior to the end of the Minimum Term, you agree to pay to Butler-Bremer, as liquidated damages and not as a penalty, a recovery fee of $410.00. This recovery fee is cumulative and in addition to any other charges or fees you may owe Butler-Bremer and any fees or charges that Butler-Bremer may charge upon disconnection of Service in accordance with our Terms of Service. The full amount of any such charge shall be billed by Butler-Bremer within thirty (30) days of termination or cancellation of Service and shall be paid by you within thirty (30) days of your receipt of such bill. Once the Minimum Term has expired, you will receive Service on a month-to-month basis until Service is terminated by you or canceled by Butler-Bremer in accordance with the applicable Terms of Service. In order to commence construction/installation, Butler-Bremer will require an upfront fee payment in the amount of $500.00. Upon payment of the fee you will receive Service on a month-to-month basis until Service is terminated by you or canceled by Butler-Bremer in accordance with the applicable Terms of Service.

4) Credit Checks. In connection with your request or application for Service, we may conduct an investigation into your credit-worthiness, including obtaining one or more reports or ratings from one or more independent credit reporting or credit scoring agencies. By applying for Service, you authorize the Company to investigate or verify your credit history and to share credit information with credit reporting agencies

5) Deposit. Butler-Bremer may require a deposit for you to commence construction and/or establish Service at the Service Address. The deposit amount, the length of time Butler-Bremer holds the deposit and changes to the deposit amount are determined based on Butler-Bremer’s costs and risks of construction, your credit and payment history and any applicable laws or regulations. If Butler-Bremer requires a deposit to commence construction or establish Service, Butler-Bremer will hold the deposit as partial guarantee of payment for such Service, including special construction. Butler-Bremer may change the deposit at any time to reflect revised estimated monthly charges based upon your usage. A deposit may not be used to pay any bill (unless it is used to pay a final bill) or delay payment. Except as otherwise required by applicable law or regulations, the rate of interest on the deposit is subject to change, and Butler-Bremer may mix deposits with other funds. If a Service is terminated for any reason, Butler-Bremer may, subject to applicable law and regulations, apply your deposit toward payment of outstanding charges. If Butler-Bremer attempts to return all or any portion of a deposit, and if the U.S. Postal Service cannot deliver the money to you and returns it to Butler-Bremer, Butler-Bremer will hold it for you for two (2) years from the date of return and may charge a monthly servicing fee against the deposit balance. Any money held during this 2-year period will not accrue interest for your benefit. You will be deemed to have abandoned any portion of the money left after the 2-year period.

6) Service Accounts. Service accounts are assigned to customers only, and the customer signing this Special Service Agreement shall be treated as the account owner for all purposes. You are responsible for keeping all billing data with Butler-Bremer up-to-date and accurate. Furnishing false data to Butler-Bremer is grounds for immediate disconnection of Service and may subject you to civil or criminal liability.

7) Important Customer Information. In addition to the terms and conditions set forth in this Special Service Agreement, your service is subject to our Terms of Service, as identified in Paragraph 2 above, which you should read carefully before activating any Service. For additional information concerning our Terms of Service, please refer to the applicable Terms of Service (which are available on our website or will be provided to you upon request) or speak with a Butler-Bremer customer service representative.
