  • TERMS AND CONDITIONS

  •  

    1.  Vehicles will be allowed in the staging area only from 6:30AM – 9AM.

    2.  You may NOT begin assembling your booth until after your vehicle is removed from the staging area. Parking is not provided, but there is ample parking available on the streets surrounding the festival grounds. DO NOT PARK IN PRIVATE LOTS—YOUR VEHICLE MAY BE TOWED!

    3.  No vehicles are allowed in the staging area during event hours. NO VEHICLES IN THE EVENT FOOTPRINT AFTER 9AM. Vehicle access will not be permitted after the event until the San Diego Police Department or Fire Marshall have cleared the area of pedestrians.

    4.  The Festival will run from 10am - 5PM on Saturday, December 11, 2021. Vendors are required to be open from 10AM - 5PM. CLOSING BEFORE THE END OF THE EVENT OR STAYING OPEN AFTER EVENT HOURS IS STRICTLY PROHIBITED. Vendors who leave early will forfeit their deposit. ALL Vendors must have their space cleared and cleaned no later than 6PM.

    5.   North Park Main Street reserves the right to refuse vendors, regulate the number of same-type vendors and will determine those businesses and activities most suitable for the event. Vendors shall not set restrictions on North Park Main Street’s regulations.

    6.    All vendors must submit their application with a detailed description of ALL merchandise and/or printed matter to be sold or distributed by them. The reproduction of any artwork, past or present, of North Park Main Street will not be permitted. The Vendor Coordinator may request additional information, pictures, or samples before the application is approved.

    7.   NO Alcohol or Tobacco can be sold. NO illegal drugs or paraphernalia or depictions of same will be allowed. NO racist, sexist, pornographic, or otherwise offensive merchandise or literature will be allowed. Any items in violation must be removed.

    8.    All vending operations must occur within the perimeter of the space they purchased. No signage, equipment, product or activities may occur outside of that space

    9.    Signage and booth decorations are encouraged so long as they are in good taste and do not interfere with neighboring vendors. North Park Main Street Committee reserves the right to remove any décor deemed inappropriate for the event.

    10.  Only Vendors marketing music, tapes, or CD’s, can use amplified devices (i.e. boom boxes) and must have prior consent from the North Park Main Street Committee. Amplified music should not interfere with neighboring vendors.

    11.  Vendor acceptance and booth assignments are made on a first-come, first served basis, per when application AND payment are received. Postdated checks will not be accepted.

    12.  An overpayment of fees is non-refundable. 

    13.  Vendor confirmation booth assignments and other communications will be by email. Please be sure  to have a valid email address on file.

    15.  ELECTRICITY: Electricity can be purchased by nonfood vendors for a fee of $60 for 5 amps or $100 for 20 amps and you must bring at least a 50-foot extension cord to access it.  Generators are not allowed except for special circumstances, must be WHISPER quiet and must be approved by Ed Decker in advance ed@mcfarlanepromotions.com / (619) 261-5664

     

  • TERMS AND CONDITIONS: ADDENDUM

    If the event is rescheduled, your fee will be honored at the rescheduled event. McFarlane Promotions, Inc. and North Park Main Street Association reserve the right to refuse service to anyone. 

    All articles are subject to search upon admission. Event producers reserve the right to use photos or graphic images taken at North Park Book Fair. No video cameras, alcohol, simulated weapons, illegal drugs, weapons, tents, tape recorders, lawn chairs, hazardous substances, portable chairs, bicycles, wagons, large backpacks, skateboards, roller blades, coolers, cans, glass containers, large bags, umbrellas, or pets will be allowed to be brought onto the premises. 

    The holder assumes all risk or danger incidental to the attraction/event whether occurring prior to, during or subsequent to the attraction/event including the risk of cancellation. No exception. This event is rain or shine.

  • Insurance Requirements

    You must provide the insurance requirements below.
  • You must provide proof of general liability insurance for $1,000,000 naming McFarlane Promotions, Inc., North Park Main Street and the City of San Diego as additionally insured. Listed below are the names and contact information of the entities that need to be additionally insured, with the 30 day insurance cancellation noted on certificate, for $1,000,000 for North Park Festival of Arts listing the date December 11, 2021. 

    *** If you are unable to provide proof of liability insurance you can choose to waive it. Please see attached document below for more details***

    You must also include the endorsement policy and it must list the below organizations on it or reference the policy number on it.  Per the City of San Diego, are also required to have you have the ‘Worker’s Compensation Statutory Limits’ box checked (regardless of your coverage amount).  If you use a different insurance company for your workers compensation you are required to provide that coverage as well. You will not be able to set up a booth without this insurance.

    In the Description Section You Must State: The City of San Diego and its respective elected officials, officers, employees, agents and representatives are additional insured as required by contract with respect to North Park Festival of Arts 2021.

    Your endorsement policy that comes with your certificate must name the City of San Diego on the endorsement, not just a blanket policy.

     

  • REFUND AND DEPOSIT POLICY AGREEMENT

    Please read carefully as this policies will be strictly followed.
  • FULL REFUNDS ARE NOT OFFERED FOR THIS EVENT. In the event of a scheduling conflict, personal emergency, sickness, death, or other unforeseen circumstances, you may request a partial refund of your booth space. The deadline to receive a refund is as follows:

    For a 75% refund - You must put in your request (90) ninety days before the start of the event

    For a 50% refund- You must put in your request (89) eighty-nine to (60) sixty days before the start of the event

    Cancellation requests received (59) fifty-nine days before the start of the event and later will not be eligible for a refund.

    Refunds will not be available for registrants who choose not to attend an event. Cancellations will be accepted in writing only and must be received by the stated cancellation deadline(s). All refund requests must be made by the attendee or credit card holder. Refund requests must include the name of the attendee and/or transaction number.

    DAMAGE/CLEANING DEPOSIT POLICY: McFarlane Promotions shall inspect your space to ensure it is undamaged, all rules have been met, all rentals have been properly returned, and has been cleaned to the satisfaction of McFarlane Promotions and North Park Main Street Association. Deposits may be withheld at the discretion of McFarlane Promotions and/or North Park Main Street Association for, but not limited to, failure to show, late arrival, early departure, and any other violations of regulations set forth by the terms & conditions page.

  • Covid-19 Release

    I understand that the Governor of the State of California and the County of San Diego have placed restrictions on businesses and are requiring them to take certain precautions to prevent further transmission of COVID-19 infections. I: (a) represent, warrant, and certify that at no time during the 14 days preceding did I have any of the following symptoms: fever or chills; cough; shortness of breath or difficulty breathing; fatigue; muscle or body aches; headache; new loss of taste or smell; sore throat; congestion or runny nose; nausea or vomiting; or diarrhea; (b) represent, warrant, and certify that at no time during the 14 days preceding have I been around anyone who has tested positive for COVID-19; (c) accept all responsibility for at all times properly using a face covering, maintaining 6 feet of distance from staff and patrons while I am on premises; (d) agree to do whatever is required by applicable Federal, state, and local regulations, including without limitation complying with all applicable travel restrictions and quarantine requirements; and (e) agree to strictly adhere to all signage posted anywhere on premises regarding COVID-19 infection prevention.

    I, for myself, my heirs, and assigns, hereby waive any and any claims, demands, causes of action, or any claims for relief whatsoever against and release naming McFarlane Promotions, Inc., North Park Main Street and the City of San Diego from all liability, claims, causes of action, demands, losses, and damages, now or in the future, related to my having or contracting COVID-19 or other illness arising out of or in connection with my attendance.
