IDENTIFICATION: You (hereafter referred to as "Student") have requested service(s) or course(s) from Rain Jordan aka Canine Fear Solutions aka The Fearful Dogs Project (hereafter referred to as "RJ"), with whom you voluntarily agree to all terms and conditions contained in this Student/Client Agreement document (hereafter "CA"). If you are registering for the Canine Fear Abatement self-study course, you understand that The Fearful Dogs Project is responsible for and collects fees for the course.*

CONFIDENTIALITY: RJ respects your privacy. There are a few situations in which sharing information would be required of or practiced by RJ: 1. For documentation such as our records, for anonymous research and published or unpublished articles, case studies, and similar; 2. Colleague input if we deem it helpful to your case. 3.You instruct us to do so and/or in order to provide the services you request; 4. We are served with a court order or subpoena; 5. Legal/regulatory authority requires disclosure; 6. We witness evidence of animal cruelty that our services cannot resolve; 6. Our attorney requires information in order to properly represent us.*

INFORMED CONSENT: In order to ensure we have the most complete data possible to help you and your case, as well as to improve public awareness and understanding of the science of canine behavior and the importance of professional, non-aversive training and behavior modification, you agree to our taking photos and making audio/video recordings of your dog and sessions (if applicable). You agree that all activity between RJ, yourself, and your affiliates become part of RJ's teaching, history, and education files. You give us permission to publish stories, photos, and recordings of your dog and/or our sessions (if applicable), so long as we do not include your name, address, or contact information. While you or your property may appear obliquely/partially in these items, we work to limit your exposure and protect your privacy. Your name is withheld unless you give us express permission to include it or you add it yourself. Note: Our confidentiality policies do not prohibit us from sharing information needed to protect ourselves from harassing, threatening, or illegal acts against us.*

RESPONSIBILITY & SAFETY: I understand that RJ will endeavor to offer credible, responsible services and instructions. However, given the fluid nature of scientific research and animal behavior, I recognize that RJ cannot not be held responsible for any unintentional errors, omissions, or incorrect assertions. I understand that RJ may express opinions or beliefs about the effectiveness of various courses of action or about results that might be anticipated. I understand that such statements are expressions of opinion only, and should not be construed as promises or guarantees. I understand that the recommendation of a product or service does not imply a guarantee of my satisfaction with that product or service. I assert that I am and will remain responsible for my decisions and actions, and for the actions of the animals in my care or control, both while under RJ's instruction and while under my own care regardless of whether I am following RJ's instructions. I understand I am responsible for the inherent risks in handling dogs and/or other pets, including but not limited to the risk of bites or illness to me and/or others, as well as the risk of loss or damage to property and/or harm to other animals.*

SCHEDULING, PAYMENT, and REFUND POLICIES: Payment is due 30 days before access to course/services. If the course does not fill and therefore is canceled or delayed, RJ will refund the amount paid less any third party fees such as paypal fees associated with your transaction (third party fees may be avoided by paying via check). Student agrees that any fees related to Student-provided failed checks shall be paid for by Student. Because learning and teaching are not returnable commodities, RJ maintains a No Refunds policy on any course or other service. There is no charge for follow up responses to your email between sessions or during courses. Unless the situation is urgent or time-dependent, Email is preferred for questions; this ensures clear, complete records for everyone.*

CANCELLATION, UNCOMPLETED, & REPLACEMENT POLICY: I understand that missed and cancelled appointments with less than 24 hours notice to RJ will cause RJ to be unable to fill that appointment time with another client; therefore such cancellations will be counted as sessions taken and charged against paid sessions/time. To avoid paying for missed appointments and to allow for rescheduling, I agree to give at least 24 hours advance notification of cancellation. I understand that missed or uncompleted courses shall be my own responsibility, not the responsibility of RJ. I understand that the course will run for 6 months, after which it will be closed. At RJ's discretion, in the event of uncontrollable circumstances such as pandemic or other uncontrollable emergencies, sessions and/or courses may either be replaced with more appropriate means such as virtual sessions or delayed courses, or these services may be delayed until the situation is resolved. I understand that all such decisions are solely at RJ's discretion.*

PROCESSES, CLIENT PRACTICE, OUTCOMES. I understand that RJ will work to impart modern animal behavior knowledge, and that success with RJ services and courses depends on a combination of learned skills and consistent practice on the part of myself and my pets, and other pets and their owners. I also understand that an animal will not continue to execute taught behaviors unless I maintain them via practice and an anti-aversives lifestyle, and that although undesired behavior in an animal may be modified, an animal's behavior cannot ethically be deemed “cured” since others cannot directly control changes an animal's behavior over time and changing conditions. I understand that long breaks between training sessions may limit or reverse progress and therefore one session (for private mentoring) per week is the recommended minimum until goals are achieved. I understand that humane dog behavior treatment is not a quick fix endeavor but rather a careful, methodical process, and I declare that I am able and willing to dedicate the time needed for this process. I understand that my animals' behavior is ultimately my responsibility and that while RJ will make every reasonable effort to help me attain my goals, responsibility for outcomes is ultimately mine, and that RJ can make no guarantees regarding outcomes.*

ANTI-AVERSIVES. I understand that RJ is against the use of pain, force, intimidation, coercion, and fear-leveraging or scare tactics. I acknowledge nevertheless that behavior modification/training/handling/care are activities in which there is always risk of accidental damage or injury to pets or persons, and I assume full responsibility, whether financial, physical, emotional, or otherwise, for the actions of myself and my pet, and for my implementation of what I have learned during RJ courses. I declare that RC will not be held responsible for situations outside its control. I further understand that RJ recommends I avoid and discourage aversives to the highest extent possible at all times.*

CLIENT AUTHORITY TO CONTRACT. To the extent that any additional person(s), animals, and/or entity/entities is/are, in whole or in part, my affiliates of any type, I (a) hereby represent and warrant that I have the right, power, and authority to enter into this CA on his/her/its/their behalf/behalfs and to bind any such person(s) and/or entity/entities to the terms hereof, and (b) I agree to indemnify and hold harmless RJ from any and all claims made by any such person(s) and/or entity/entities with respect to this CA AND RJ services and/or courses.*

I understand and agree

NOT FOR RESALE OR REPRODUCTION. I understand and agree that I have engaged RJ to teach me solely, and that teachings, materials, and courses provided by RJ contain proprietary and/or copyrighted material. I agree that I shall not sell, trade, give away, or otherwise share, whether for value or for free, any part of RJ's offerings including but not limited to protocols, training, interventions, materials, outlines, plans, ideas, products, services, and/or information provided to me by RJ to any other(s), nor assist/allow others to do so. If I am a dog trainer, animal behavior consultant or behaviorist, dog walker, rescue/shelter worker, or other dog services provider, I understand and agree that all content provided to me by RJ is to improve my own, individual knowledge, skills, and services to my individual, non-dog-pro clients, but is NOT to be repackaged or resold in any format at any time whether in whole or in part(s). I agree that if I wish to share or otherwise repeat content taught in RJ courses, I will first obtain written permission from RJ and permission is granted I will also credit RJ as the source of the information, together with a link to www.caninefearsolutions.com .*

I understand and agree

WAIVER AND RELEASE OF LIABILITY. I agree that I, my heirs, assignees and legal representatives will not make claim against, sue, or attach the property of Rain Jordan and/or Canine Fear Solutions, or owner, affiliates, family, acquaintances, or any other person affiliated with or acting on RJ's behalf for injury or other harm resulting from action or negligence, however caused, by RJ. I forever release RJ from any and all liability and demands that I and/or my heirs, assignees, and/or legal representatives may have or may hereafter have for injury or damage to or by me/us and/or dog(s), and I assume all risks thereof.*

SIGNATURES AND SUPERCEDENCE. This CA may be executed in several counterparts, each of which shall be an original, but all of which shall constitute one and the same instrument. This contract contains the entire agreement between the parties regarding the subject matter hereof. This CA may not be modified except by a later written agreement executed by all of the parties. This CA supersedes all other agreements, written or oral, previously made between myself and RJ.*
