BRICKEY FILMS — CLIENT AGREEMENT TERMS & CONDITIONS (2026)
At Brickey Films, our mission is to preserve your story with intention, artistry, and excellence. The following terms outline the professional agreement between Brickey Films LLC ("Filmmaker") and the Client.
PAYMENT & BOOKING:
The Client agrees to pay the total investment as outlined in the official Brickey Films invoice. This amount includes all services, agreed coverage, and applicable fees.
A non-refundable retainer of 25% and a signed agreement are required to officially reserve your event date. Until both are received, Brickey Films cannot guarantee availability.
The remaining balance is due no later than 21 days prior to the event date. Failure to complete payment by this date may result in forfeiture of services and reservation.
For locations beyond 50 miles from St. Louis, Missouri, travel fees will apply at a rate of $1.00 per mile (roundtrip). Any required lodging will be discussed in advance and included in the invoice.
DELIVERY TIMELINE:
Brickey Films carefully crafts each film to reflect the emotion, atmosphere, and story of your event.
Typical delivery timelines are as follows:
- Teaser Film: 1–3 weeks
- Highlight Film: 6–10 weeks
Delivery timelines may vary depending on seasonal workload, project complexity, and creative process. Final films will be delivered digitally.
CANCELLATION & RESCHEDULING:
The Client understands that Brickey Films reserves event dates exclusively and declines other work for that date.
All retainers are non-refundable. However, retainers may be transferred to a new event date if Brickey Films is available.
If circumstances beyond either party’s control (including weather, emergencies, or venue issues) require rescheduling, both parties will work together in good faith to secure a new date.
CREATIVE RIGHTS & COPYRIGHT:
All footage and finished films created by Brickey Films remain the exclusive intellectual property of Brickey Films LLC and are protected under federal copyright law.
Brickey Films retains full rights to:
- Edit, reproduce, publish, and distribute all media
- Use footage for portfolio, website, marketing, advertising, and promotional purposes
- Submit films for publication, awards, or educational use
The Client is granted a non-exclusive, perpetual personal-use license, which allows the Client to:
- Share films on social media
- Download and store files
- Share with family and friends
The Client may NOT:
- Edit, alter, or modify the films
- Sell or license the footage commercially
- Apply for copyright ownership
- Create derivative works from the footage
CREATIVE CONTROL:
The Client acknowledges familiarity with Brickey Films’ style and artistic approach. Brickey Films retains full creative discretion over filming, editing, music selection, and final delivery.
This ensures every film reflects the Brickey Films cinematic standard and storytelling vision.
MODEL RELEASE:
The Client grants Brickey Films permission to use video footage and likeness for portfolio, website, social media, marketing, and promotional purposes.
This permission is granted without compensation and is essential to the continued growth of Brickey Films.
LIMITATION OF LIABILITY:
Brickey Films takes the highest level of care in capturing and preserving your footage.
However, in the unlikely event of unforeseen circumstances including but not limited to:
- Equipment failure
- Loss, theft, or damage of footage
- Illness or injury
- Acts beyond reasonable control
Liability is limited to the total amount paid by the Client.
Brickey Films will make reasonable efforts to provide a replacement filmmaker if necessary.
EVENT CONDITIONS & COOPERATION:
The Client agrees to provide a safe working environment and reasonable cooperation from guests, venue staff, and vendors.
Brickey Films is not responsible for missed moments due to:
- Timeline delays
- Venue restrictions
- Guest interference
- Lighting or environmental limitations beyond control
ARCHIVAL POLICY:
Brickey Films archives footage for up to 12 months after delivery. After this period, archival storage is not guaranteed.
The Client is responsible for downloading and safely storing all delivered files.
INDEPENDENT CONTRACTOR:
Brickey Films operates as an independent contractor and is not an employee of the Client.
ENTIRE AGREEMENT:
This document represents the complete agreement between Brickey Films and the Client. Any modifications must be agreed upon in writing and signed by both parties.
ACCEPTANCE:
By signing, the Client acknowledges they have read, understood, and agree to all terms outlined above.
