            Deposit and Cancellation: Fifty percent (50%) of agreed upon fees is required at booking.  If a booking is more than 9 months away, we ask a twenty-five (25%) deposit at booking, fifty percent (50%) within 6 months of event, and one hundred (100%) within 3 months of event, no exceptions.  Partial refund will be made only if event is cancelled within 6 months of event.  If cancellation occurs in less than 3 months, Organizer forfeits their deposit.

            TERMS AND AGREEMENT

            1. FACILITY FEE: $    . This facility fee includes up to   GUESTS. Each additional guest will be charged $    each. A deposit of ½ of agreed upon fees is required at booking.   *   
            2. DAMAGE DEPOSIT: An additional $250 deposit will be required at the booking the event to ensure that the facilities are free from damage. This deposit will be refundable, after all inspections and repairs have been satisfied by the POC. However, should any of the terms of this agreement be violated, the $250 deposit will be forfeited.
            3. INSURANCE: To protect all parties involved, we require The Event Host to purchase event insurance for the period that they have guests here. The Host shall maintain comprehensive general liability insurance with minimum coverage of $500,000 per occurrence and in the aggregate, insuring against death or injury to any person or damage or loss or loss of use of any property. Host shall cause Marker 37, LLC and Snoopy’s at SSI, LLC to be named as an additional insured and provide certificate of proof to the Marina no later than ten (10) days prior to your event.
            4. Point of Contact: The Point of Contact (POC) is responsible for all actions and activities of the Organization and Event. This includes controlling alcohol consumption, general management of the crowd and utilized area(s). The Marina will interact with the POC for all matters. The POC may be asked to make changes or adjustments during the event if a problem arises. The POC may be asked to remove people that are in violation of the terms of behavior or the Marker 37 Rules and Regulations.
            5. Food & Beverages: All food and beverages, including water, must be purchased from Marker 37. Donated alcohol may not be served on the premises due to our TABC license. All alcohol must be purchased from Marker 37. ALL FOOD WILL BE PAID FOR IN ADVANCE 15-DAYS PRIOR TO EVENT/TOURNAMENT. NO REFUNDS WILL BE GIVEN FOR LACK OF ATTENDANCE.
            6. OUTSIDE VENDORS: NO OUTSIDE VENDORS WITHOUT PROPER AUTHORIZATION FROM MARINA PRIOR TO THE EVENT/TOURNAMENT – NO EXCEPTIONS. An outside person, or persons, supplying services here is considered a “vendor”. Many of these vendors and services do not require, or have any type of license, and may be unknown to us, (or our facility to them). To fully coordinate all facets of your event, and to assure that things run smoothly, it is necessary for us to communicate with all outside vendors before they come here. (It may be necessary for them to carry liability insurance also.) Please discuss with us as to any outside vendors that you may be hiring. WE RESERVE THE RIGHT TO TALK WITH, AND/OR DENY VENDORS THAT WE DO NOT SEE FIT. PLEASE WORK THIS OUT PRIOR TO EVENT AND HAVE APPROVAL FROM MARINA.
            7. Liability Waivers and Indemnification: We require hosts to sign liability release, indemnifying Marker 37, LLC dba Marker 37 Marina from any damages. YOU PARTICIPATE IN THIS EVENT AT YOUR OWN RISK. MARKER 37, LLC MARINA WILL NOT BE RESPONSIBLE for any injuries or property damage resulting, caused by or growing out of the use of the Marina, docks or harbor facilities, including for any negligent condition. By participating in the event, you RELEASE AND DISCHARGE THE MARINA from any and all liability for loss, injury (including death), or damages to person or property sustained while in, on or around the facilities of Marina, including but not limited to damages or injuries caused by fire, theft, vandalism, windstorm, high or low waters, hail, rain, ice, collision or accident, or any other Act of God, whether on Boat, in water, on dock, on land or otherwise. The Organizer and POC jointly and severally agree to INDEMNIFY, DEFEND and HOLD HARMLESS the Marina and its officers, managers, employees, agents, members, attorneys, insurers, representatives, affiliates, successors and assigns from any and all claims, losses, demands, debts, damages, or other causes of action from the use of the Marina that arise through the event.
            8. Behavior: Disorderly and disruptive conduct by those participating in the event will not be tolerated. If a person is demonstrating such behavior, the POC will be contacted and the event will be responsible for reprimanding or removing the individual based on the severity of their actions. Depending on the size of the event onsite security may be required to be present. Marina management reserves the right to ask anyone that is causing any type of trouble, drunken behavior, or other problems to leave the property. If subsequent problems occur, we reserve the right to have person/s removed from property by an officer of the law.
            9. Parking: On the days of events, a chain will be hung across the parking lot to ensure parking for employees, our house guides, bait deliveries and our regular customers. One POC vehicle will be allowed in the chained area at a time. NO EXCEPTIONS! Parking in the Snoopy’s parking lot will not be tolerated and vehicles will be towed. If a person is blocking a vehicle in, they will be towed. It is the event’s responsibility to convey these parking rules to the participants.
            10. ABSOLUTELY NO DRUGS ALLOWED: Persons suspected of drug use anywhere on Marina property will be asked to leave.
            11. DAMAGES: Damages to property or extra clean up, (above and beyond normal usage), or extra services, will be the financial responsibility of POC. POC acknowledges full financial responsibility for their guests at event.
            12. Terms of Venue Rental: The facility fee includes the right to the exclusive use of the “roped off” facility for a one-day event during the hours agreed upon (subject to the rules specified). Not to exceed past sundown. 
            13. DESIGNATED AREA: The Marina will provide a designated area for ALL fish cleaning. No cleaning of fish will be allowed outside of the designated area. The POC agrees to be held responsible for keeping pier clean and clear of any trash or debris.
            14. WRIST BANDS: The POC will be responsible for picking up the wrist bands prior to the beginning of the event, to be in the Marker 37 Retail Store. The POC will be responsible for the distribution of such bands to ALL guests attending event. The wrist bands MUST always be worn to access the pier. No one will be allowed into the “roped off” area without the proper bands.
            15. Authorization to Sign: The POC represents and warrants that they have the legal authority necessary to bind the Organizer to this agreement.

            These terms have been reviewed and are accepted by the following parties. This agreement must be returned within 14 days of receipt, otherwise it will be null and void.
