For and in consideration of permitting (the "Member") to join RFC Fitness Inc (the "Health Club") and to participate in any of the available "Services" listed here under, and other activities available at or through the Health Club (collectively, the "Activities"), the Member agrees to be bound by the terms and conditions of this Membership Agreement and the attached Terms and Conditions of Membership (collectively, the "Membership Agreement").
The Membership Agreement constitutes and contains the entire and only agreement between the parties, and supersedes and cancels any and all pre-existing agreements and understandings between the parties relating to the subject matter hereof.
No representation, inducement, promise, condition, warranty or guarantee not set forth herein has been relied upon by either party.
List of available services: Cardiovascular Machines (Treadmills, Cross Trainers, Bikes, Climbers), Circuit Training, Free Weights, Locker Rooms, Cable Machines, Group Exercise Classes (when available).

PAYMENT
The Member agrees to pay their membership dues as stated here and above in the Electronic Funds Transfer Section. If the member wishes to cancel their membership they may do so by submitting a written request through registered mail or by personal service at least 60 days prior to the end of the Contract End Date. Other cancellation options can be found on the back side of this agreement under the heading; "Your rights under The Consumer Protection Act".
WAIVER, RELEASE AND INDEMNITY AGREEMENT
For and in consideration of permitting you the "Member" to join the club and to participate in the "List of available services", and other health club activities available at or through the club, the member hereby assumes all risks of such activity and voluntarily releases, discharges, waives and relinquishes any and all claims or causes of action for personal injury, property damage or wrongful death occurring to himself/herself arising as a result of engaging or receiving instructions in the Health Club Activities or any activities incidental thereto wherever or however the same may occur and for whatever period said activities or instruction may continue; and for himself/herself, his/hers heirs, executors, administrators and assign does hereby agree that under no circumstances will he/she or his/her heirs, executors administrators and assigns prosecute or present any claim for personal injury, property damage or wrongful death against the Club or any officers, agents, employees or servants for any of said causes of action, whatever the same shall arise by the negligence of any of said person or otherwise.
IT IS THE INTENTION OF THE MEMBER BY THIS INSTRUMENT TO EXEMPT AND RELIEVE THE CLUB FROM ANY LIABILITY FOR PERSONAL INJURY, PROPERTY DAMAGE OR WRONGFUL DEATH CAUSED BY NEGLIGENCE.
The member agrees that the club shall not be responsible or liable to his/her, or his/her guest for articles lost or stolen in the Club. The Club also shall not be responsible or liable for loss or damage to any property of him/her or his/her guest including his/her automobile and contents. It is agreed that any damage to the Club facilities or property of the member's guests, by any other member or his/her guest is the sole responsibility of the offending member.
The member acknowledges that he/she has read the foregoing paragraphs, has been fully and completely advised of the potential dangers incidental to engaging in the health club activities and is fully aware of the legal consequences of signing this instrument.
WE RESERVE THE RIGHT TO TRANSFER THIS AGREEMENT IN ITS ENTIRETY
TERMS AND CONDITIONS OF MEMBERSHIP
Your Rights under The Consumer Protection Act
You may cancel this contract at any time during the period that ends seven (7) business days after the later of the day you receive a written copy of the contract and the day all the services are available. You do not need to give RFC Fitness Inc a reason for canceling during this period. In addition, there are other grounds that allow you to cancel this contract. You may also have other rights, duties and remedies at law. For more information, you may contact the Consumer Protection Branch, Saskatchewan Justice. To cancel this contract, you must give notice of cancellation to RFC Fitness Inc. at PO Box 37160, Regina, SK, S4S 7K4, by personal service, by registered mail or by any other means set out in the contract. If no address is set out in the contract, use any address of the supplier that is known to you. If you cancel this contract, the supplier has fifteen (15) days to refund any payment you have made.
AGREEMENT TERMINATION:
At any time, you may terminate this agreement by providing RFC Fitness Inc. with 60 days written notice prior to your next billing date. If the cancelling member is a family add on - 60 days notice is still required. If an arrears situation exists, the amount owing will remain applicable, and need to be paid along with the 60 days notice of billable fees. MEMBERSHIP DUES / FREEZE FEE DUES
1. Membership dues are collected as per the Electronic Funds Transfer section of the Membership Agreement. Rejected automatic debit charges or non-receipt of payment on credit cards and checking/savings accounts are subject to a service charge per transaction. If automatic debit charges are rejected, several attempts to re-debit the account for dues outstanding will occur. There will be a $19 fee for any rejected automatic debit charges. I understand and agree that should I discontinue this payment method, a $5.00 fee will be added to each biweekly installment to cover the costs of processing and handling. Outstanding Membership Agreement dues may result in revocation of membership. Accounts past due beyond 30 days are subject to payment in full of the entire balance payable under the Membership Agreement plus a 2% monthly service charge on the amount past due and Health Club Membership may be revoked in the absolute discretion of Health Club Management. The Club is not responsible and will not refund any sums of money that the banking or credit card institution may charge for any rejected transactions.
2. A member may Freeze(hold) their account for a minimum of 1 month and a maximum of 3 months per calendar year. There may be some exceptions to Medical scenarios. (A Doctor's note may be required) The fee to freeze any account is $5.25 bi-weekly (GST Inc.) or $10.50 monthly (GST Inc.)***Please NOTE: If you Freeze your membership for 3 months, that 3 months will extend the end date of this contract. IE: contracts ends on Jan. 1, 2021 - freeze for three months - new contract end date is Apr. 1, 2021.
INFORMATION
The Member hereby authorizes the Health Club and/or its agents to request, obtain, disclose and exchange the Member's personal information with credit bureaus for the purpose of verifying the Member's credit history, updating the Member's credit profile, processing membership dues and protecting the Health Club and the Member from fraudulent activities; as well as use the Member's personal information to provide the Member with updates and information regarding products and services which we think might be of interest to the Member. The Health Club will also co-operate with local, provincial and national authorities in the investigation of unlawful or improper activities in order to protect against fraudulent transactions. If the Member does not wish to consent to the use or disclose of this personal information in any particular way, please contact our Privacy Officer.
GENERAL RULES
1. Members are expected to leave the premises by closing time.
2. No loud or abusive language permitted.
3. No alcohol, smoking, or drugs allowed on the premises.
4. THE SALE, DISTRIBUTION, OR PROMOTION OF PRESCRIPTION OR ILLEGAL DRUGS WILL RESULT IN THE IMMEDIATE REVOCATION OF MEMBERSHIP AS DEEMED NECESSARY IN THE ABSOLUTE DISCRETION OF HEALTH CLUB MANAGEMENT.
5. No personal notices, advertising or other literature, either posted or for distribution is allowed without the express written permission of Health Club Management.
6. Adjustment to the television, radio, heater, air conditioner, fans and other equipment may be made by Health Club staff only.
7. No members are allowed behind the front desk.
8. The Health Club reserves the right to cancel this Membership Agreement, refuse admittance and the use of the facility at any time.
9. Members must remove outdoor shoes before entering the exercise floor. Only indoor shoes are allowed in the Gym.
10. No use of Chalk, or dropping of weights, not adhering to these rules will result in the immediate revocation of the membership.
11. The Health Club may require an official document from a physician issuing clearance for the Member to use the facility.
12. The Health Club will be available to members during Health Club hours, unless otherwise specified in the Membership Agreement. The Health Club may be temporarily closed for holidays and for periods of up to two weeks each year for maintenance purposes. Should the facilities be unavailable for use at any other time, due to damage by an act of God, catastrophe, accident or other reason beyond the control of the Health Club, the membership term will be extended for a period of time equal the time of such unavailability
13. Lockers are provided for daily use by members but members must provide their own lock. Locks left overnight will be cut & items removed from those lockers. Members are urged not to bring valuables onto the premises of the Health Club. The Health Club, its agents or employees shall not be liable for the loss, theft or damage to personal property of members and/or guests.
EXERCISE FLOOR
1. Members are required to wear shirts on the exercise floor.
2. Athletic shoes must be worn on the exercise floor at all times.
3. Members must be properly attired in standard workout clothes while in exercise areas. Swimsuits, underwear, and street clothes are not allowed inside the Gym. Proper athletic shoes must be worn. No sandals or street shoes allowed.
4. No food or workout bags are allowed on the exercise floor.
5. Members should replace all free weights on appropriate racks after use. Free weights and weight stacks are to be lowered carefully upon completion of an exercise. Abuse of equipment will not be tolerated.
6. Spotters and collars are required for bench presses, incline and decline presses, and squats.
7. Members shall use safety belts when provided on exercise equipment.
8. Please be courteous and mist down equipment after each use. Please do not spray TV screens. Mist touch points.
