• Puppy Purchase Contractual Agreement

  • This document establishes the agreement between the seller hereinafter referred to as the Breeder, to sell one or more puppies to a purchaser, hereinafter referred to as the Buyer.

  • The DNA of our dogs has not been tested. The specificity of characteristics rendered by each puppy has also not been tested. Various traits may be recessive or dominant and no guarantee as to how these traits will be displayed over the age of your puppy can be provided. Both of the parents are under 20" to the shoulder and under 23 lbs in weight. The mother looks slightly more like a poodle in characteristics and manner with curly fur, while the father looks more sheepdog-like, with long wavy fur. Both have black and white coloration.

     

  • D. Terms and Conditions of Agreement

    1. Total purchase price for the puppy will be $2500, tax is included. If you decide to buy two or more puppies we may be willing to discuss a discount.

    2. Payment of the price of the puppy will be made in two installments a) a deposit of $400 upon execution of this agreement must be paid in cash or by bank certified check made payable to Flufferbutt Farm LLC, and b) the remaining will be due when the puppy is ready for final delivery to the Buyer and is to be paid in cash or also by bank certified check.

    3. The purchase price is a "Pet Only" puppy sale. We believe it is your decision whether or not to have your puppy spayed or neutered. There are conflicting theories as to whether it is the healthiest practice to follow with respect to doing so ever or at a certain point in time in your dog's life. Furthermore, the sale of one of our puppy's, as a pet only, does not convey any documentation or record of their breed and or of any testing that would provide any assurance of their ability to procreate off-spring.

    4. Timely Pick-Up is absolutely required. Breeder will notify Buyer by email 5 days prior to when puppy is ready and it must be picked up within this timeframe. Failure to pay the full remaining balance of the purchase price within this five day period, and, or failure to pick-up and take delivery will constitute forfeiture of all funds paid by the Buyer as well as the surrender of all rights to the puppy. Timely pick-up of the puppy is a crucial element of this agreement since puppies only are puppies for so long when they are best suited for adoption.

    5. Promises by Breeder as to health and fitness of the puppy:

    a) The puppy is not known to have ill health or injury at the time of sale and transfer of the puppy to Buyer. See Addendum A for complete terms and conditions as they relate to this agreement for details as to the Breeder’s Puppy Health Warranty. 

    b) The puppy has been cared for and raised in a humane and positive nurturing manner to promote good temperament, alertness, confidence, affection, health, and a general good sense of well-being. We believe our puppies have been given the attention needed to make them very people friendly.

    c) The puppy has not had its tail docked or dew claws removed. We believe that tails are an important part of the puppy’s personality and general sense of well-being. Dew claws are like the puppy’s thumbs and if normal in size and maintained as all of the other claws and paw pads, they should be healthy and also provide the puppy with improved motor skills and a better general sense of well-being. 

    d) If the Buyer decides within 8 days after purchase and taking delivery, provided the puppy has been well-kept, well-treated, and properly nourished, the puppy may be returned to the possession of the Breeder, and the Breeder will accept the return of the puppy and will arrange for a refund of the purchase price less the $400 charge for the non-refundable deposit. If however the puppy has any indication of mistreatment, malnourishment, injury, or sickness, we will need to assess the situation with our veterinarian and if medical costs are necessary, or if the puppy is permanently damaged the Breeder unilaterally maintains the right to withhold any return of payment to the Buyer. If the puppy is in good health and well cared for, the refund will be made by wire fund transfer within 30 days of the Breeder regaining control of the puppy.   

    e) If the puppy is examined within 72 hours of the Buyer taking possession of the puppy by a licensed veterinarian and it is determined that it has a life threatening illness or some genetic abnormality,  the Breeder will provide one of three remedies to the Buyer:

    (1) The Buyer may return the puppy to the Breeder within 5 days after taking initial delivery, and Buyer will receive a refund less the deposit. No medical reimbursement would be refundable and, or otherwise reimbursed by the Breeder only the balance of the amount paid for the puppy less the deposit.

    (2) The Buyer may maintain ownership, and then the Breeder will reimburse up to $1000 for medical expenses billed for care of the puppy by a licensed veterinarian. This a one-time only payment to be made to reimburse the Buyer for expenses incurred. The onetime payment by the Breeder would be complete and absolute dispensation for any and all liability by the Breeder.

    (3) The Buyer may also simply return the puppy to the Breeder up to 1 year after taking delivery but would not receive a refund. The Buyer would relinquish care and, or future rehoming of the puppy to the Breeder.

    f) The Breeder promises to be a life-long resource to the Buyer to consult with regarding the care of your puppy. Of course, the Breeder will warrant that such information is only provided to the best of their knowledge and ability, without any guarantee as to remedy or ability to cure a behavioral or medical condition without additional third-party resources being needed and paid for by the Buyer.

    g) The Breeder is inclined to focus on holistic, natural, and homeopathic solutions. Your puppy may not be vaccinated or otherwise inoculated as your veterinarian might recommend prior to your receiving your puppy. Please see Addendum B. We are adhering to the newest and most widely accepted veterinarian school best practices.

    6. Promises by the Buyer as to their future care of the puppy purchased, over its entire lifetime:

    a) Premium nutrition will be provided to assure its health and happiness – the food used cannot be purchased at a grocery store. Flufferbutt Farm can recommend several outstanding food options as well as natural food additives that promote maintaining your puppy’s health, as well as prevent fleas and ticks without the use of toxic chemicals.

    b) Social distancing of your puppy will be always considered with respect Parvo, Covid-19, Kennel Cough, or any other airborne or water transmissible disease.

    c) Dog or other animal interactions will be carefully and closely monitored to assure that friendly and safe behaviors are maintained.

    d) Your puppy will never be subject to, or otherwise enlisted, to perform in a violent or perverted act that may harm it or another animal.

    e) You will strive to maintain your pet's proper weight throughout its lifetime to assure its health and happiness.

    f) Buyer will train, socialize, or engage the puppy in special activities at their own expense by either rendering their own training of the puppy or arranging to have their puppy attend training classes from a third-party that is reputable and knowledgeable doing so. (Puppy training or obedience classes may help your puppy become more aware of what is expected of them. Flufferbutt Farm appreciates the need to have a well-mannered puppy in your household. We suggest and strongly believe that positive reinforcement methods should always be used to train or instruct your puppy, and we do not condone the use of negative training methods. We also strongly disdain the idea that a puppy accident is a reason to punish your puppy in any adverse physical manner

    g) You will provide your puppy with appropriate living conditions to assure its comfort, health, and safety. (Dogs are pack animals and not meant to be isolated. They are a part of your family, and your family is its pack.)

    h) Age appropriate exercise, play, and rest will be provided. Please feel free to consult with us regarding what is the appropriate exercise for your puppy at various ages.

    i) Appropriate treatment, affection, nurturing, grooming and cleanliness, and medical care will be provided over the lifetime of your puppy.

    j) The tail will not be docked nor dew claws removed, unless medically advised by a veterinarian that there are extenuating reasons requiring you to do so.

    k) You will consult with multiple third-party resources before doing anything that may be harmful to your pet. Medication side effects should be carefully considered. (Treatment of behavioral issues, medical conditions, or even preventative measures should be studied to make the best well-informed decisions possible for someone that is dependent upon you to do the right thing

    l) Ownership is expected to be maintained over your puppy's lifetime, but if adoption is necessitated the Breeder will be consulted and due care by the Buyer will be used to assure the puppy will continue to receive the same treatment as it is accustomed to, or better.

    7. Legal Jurisdiction for this agreement is established to be solely in Wake County of North Carolina.

  • Breeder acknowledges receipt of deposit paid in cash by issuing a separate signed receipt voucher. Another separate signed receipt voucher for the remaining paid cash funds will also be issued.

     

  • Addendum A - Health Assurance Warranty

    Addendum is applicable to Agreement between Flufferbutt Farm LLC and

  • Initial Health Guarantee

    Flufferbutt Farm guarantees to the original purchaser that your puppy is healthy at the time of adoption and free from the following infectious diseases: Parvovirus, Distemper, Hepatitis, and Corona Viruses for a period of 72 hours from the date of taking possession. Should your veterinarian diagnose any of the aforementioned diseases within the 72 hour period after taking possession you must notify us immediately at (1) 248-701-3833 and by email.

    Buyer is Responsible for the Initial Vet Examination and Health Assessment Expense

    You are responsible for having your puppy examined by a licensed veterinarian within the first 72 hours of taking possession. This is not mandatory. This is to be done at your option, but it is a condition you need to perform if you wish to be able to opt to return the puppy to the Breeder because you are concerned that it may be ill or have some physical abnormality.

    No vaccines: Please see Addendum D. We are following the newest and best protocols regarding vaccinations, so your puppy may not have had any vaccinations. We recommend that you study this Addendum and do research to fully understand how it has been found that there is a risk associated with administering vaccines too closely together, too frequently, and, or too repeatedly.

    Limited Liability by Breeder

    If your puppy were to be diagnosed with a congenital disease by your veterinarian within the first 12 months of owning your puppy and require treatment (with limitations indicated in the next section of this agreement) the Breeder will be liable for the maximum lifetime expense of up to $1000. Any reimbursement must be submitted in writing with documentation provided by a licensed veterinarian that details the diagnosis and cost of treatment for your puppy.  

    Please see exclusions and other restrictions listed below for conditions that are not part of, and therefore not subject to the reimbursement offered herein. 

    Pursuant to receipt of the documentation and its verification, the Breeder will reimburse up to $1000, for a one time and only one time such request from the Buyer, to be full and complete payment to settle any and all liability relative to any and all current and future health issues that may arise for the puppy. 

    This reimbursement disbursement is limited to one payment to be made by the Breeder within 60 days after receipt and pursuant to verification of the request being attested to by a licensed veterinarian treating the puppy.

    Medical Expenses that are excluded from the Reimbursement / Liability of the Breeder:

    • Non-life threatening conditions examples: inguinal and umbilical hernias, retained testicles, recessed vulva, and cherry eyes.
    • Vaccinations subsequent to your purchase.
    • Grade 1 or 2 luxating patellas
    • Parasites such as giardia, coccidia, or other common types of parasite except as outlined above and diagnosed within the specific timeframes.
    • Respiratory infections
    • Low blood sugar (hypo-glycemia). This is preventable and it is your responsibility to make sure your puppy is provided sugar during and following transport after your purchase pick-up.
    • Diagnostics related to grade 1 or 2 heart murmurs.
    • Any infectious diseases contracted after the date of sale.
    • All allergies.
    • Malocclusions-(crooked teeth placement) As your puppy grows and develops the teeth are ever changing and it can be difficult to predict their final placement. Due to this, we do not cover any costs associated with any dental or bite abnormalities or vet bills associated with your puppy's teeth.
    • Any diagnostic tests including X-Ray, Ultrasound, MRI, or other form of scanning.
    • Any claims for kenneling, feeding, training, prosthetics, or other services that are not related to medical treatment or medication.
  • Buyer also should understand that there are not any guarantees of hypoallergenic qualities, breeding qualities, show qualities or in final size or disposition of any pet whether expressed or implied. Buyer agrees that upon delivery of puppy to them or local pick-up of puppy by them, that they have carefully examined puppy and accepts puppy as is with regard to physical appearance and breed conformation. Buyer understands and agrees that under no circumstances will any claim be made by buyer with regards to any DNA test results or opinion disputing breed.

  • There is no guarantee or assurance, nor can it be offered that the puppy will not develop Cushing's, Addison's or Sebaceous Adenitis. 

    No guarantee or assurance can be, nor is offered that the puppy has internal or external parasites, as these are easy to treat. (The parents of your puppy have been tested and do not have these conditions.)

    It should also be noted that we do not cover any warranty claim asserted by an animal clinic chain such as Banfield Animal Hospital, Petsmart, or Thrive Affordable Vet Care (Petco). We have made this decision because our clients have had disappointing experiences with them in the past and we want all of our puppies to have a positive vet experience.

    Important First Steps

    A change in environment, general surroundings, the separation from siblings, and the introduction of a new family can be stressful to your puppy and can have a serious impact on your puppy’s immediate health, especially during the first several days from leaving their puppy litter. If you notice any signs of stress: such as a change in attitude, appetite, bowel movements or lack of bowel movement, or other symptoms, please contact us from 9 AM to 7 PM EST by calling 248 701 3833, or your veterinarian for assistance in helping to alleviate this situation.

  • Some of the most important factors to consider for a new puppy parent are: 

    • Is my puppy eating enough? 
    • Is my puppy drinking water?
    • Is my puppy pooping and urinating normally and regularly?
    • Does my puppy have any breathing difficulties?
    • Does my puppy have trouble sleeping?
    • Is my puppy being given adequate downtime and rest?
    • Is my puppy being given appropriate care, attention, and affection?
    • Is my puppy lethargic or listless?
    • Does my puppy make eye contact and appear to clearly see things clearly around it?
    • Is my puppy constantly barking or howling?
    • Is my puppy overly aggressive and biting?
    • Is my puppy’s nose cool to the touch, or does it seem warm?
    • Is my puppy being kept adequately warm and dry?
    • Is my puppy safe and not threatened by anyone or anything?
  • Rehoming a puppy at any time in its life

    We hope that you are making a commitment for life to your puppy. Yet, life presents us all with unexpected events and, or challenges. If you are unable to keep your dog, please contact us to discuss this situation fully with us.

     

  • Addendum B - Holistic Best Practices for Puppies Regarding Vaccinations

    Addendum is applicable to Agreement between Flufferbutt Farm LLC and

  • On Tuesday, November 2nd, 2021, your puppy visited our veterinarian and received four inoculations. Stool samples were also taken to assure that your puppy does not have any parasites or worms. We will provide you with a copy of that report when you pick-up your puppy. Your soon-to-be puppy was found to be in great health from the examination performed!

    Please do not over vaccinate your puppy. Vaccines used properly are a miracle, but over-vaccination can be extremely harmful to the immediate and, or long term health and life expectancy of your puppy. Always remember to inform your veterinarian of what inoculations your puppy has had, and do not allow your veterinarian to believe he or she is just being cautious by re-vaccinating your puppy. Only you can protect and be responsible for your puppy – they look to you to be their guardian and to research and know what is in their best interest.

    These protocols are new and recently have been adopted by all 27 North American Veterinarian Schools. These protocols may not be consistent with other vets. We believe that these protocols are the best possible methods to protect the long term health of your puppy.
